RESOLUTION NO. 95-~
RELATING TO PETITION NUMBER V-95-8, FOR
A VARIANCE ON PROPERTY HEREINAFTER
DESCRIBED IN COLLIER COUNTY, FLORIDA.
WHEREAS, the Legislature of the state of Florida in Chapter 125,
Florida statutes, has conferred on all counties in Florida the power to
establish, coordinate and enforce zoning and such business regulations
as are necessary for the protection of the public; and
WHEREAS, th~ County pursuant thereto has adopte1 a Land
Development Code (ordinance No. 91-102) which establishes regulations
for the zoning of partiCUlar ge~raphic divisions of the County, among
which is the gral ting of variancf s; and
WHEREAS, the Board of Zonin~ Appeals, being the duly elected
constituted Board of the area hel" tby affected, has },.!ld a public
hearing after notice as in said regulations made and provided, and has
considered the advisability of a 14-foot variance f~om the required
front setback of 30 feet, established for gas pumps, to 16 feet and a
12-foot variance from the requirl 1 front setback of 20 feet,
established for pump island canoi,ies, to 8 feet as I,nown on the
attached Plot Pla:-;, Exhibit "A" or an existing automobile service
station, in a C-3 zone for the property hereinafter described, and has
found as a matter of fact that satisfactory provisi'n and arrangement
have been made concerning all applicable matters re(;uired by said
regulations and in accordance wi h Section 2.7.5 of the Zoning
Regulations of sa~d Land Develop ,ent Code for the Ul incorporated area
of Collier County; and
WHEREAS, all interested parties have been giver opportunity to be
heard by this Boa~d in public meeting assembled, ant' the Board having
considered all ma:ters presented;
NOW THEREFORE BE IT RESOLVE\') BY THE BOARD OF ZONING APPEALS of
