PROCLAMATION/RESOLUTION NO. 95-435
RESOl.OTION OF THE BOARD OF COUNTY COMMISSIONERS
PROCLAIMING A STATE OF LOCAL EMERGENCY; DECLARING
VOLUNTARY EVACUATION; DESIGNATING CERTAIN SHELTERS
THAT MAY BE OPENED; AUTHORIZING THE COUNTY MANAGER
TO ~ETERMINE EMPLOYEES' WORK SCHEDULE; AND
DECU RING THAT ITS REGULAR BOARD MEETING ON
TUESDAY, AUGUST 1, 1995 AT 9:00 A.M. SHALL BE HELD
AS SCHEDULED.
WHERE}. S, the National Tropical Storm Center has recognized
the danger to coastal residents of Southwest Florida from Tropical
Storm Erin by posting a Hu !~ricanl'! Watch from Venice to Sebastian
Inlet; and
WHERE/S, Tropical stO"lrl Erin has the pc :ential for causing
extensive ,'lamage to publi. utilities, publi.: buildings, public
communications systems, public streets and roads, public drainage
systems, commercial and residential buildings and areas; and
WHEREAS, Chapter 252.38 (3) (a) (5), Florid, Statutes, provides
authority for a political ~ubdivision such a:: Collier County to
declare a "State of Local \:mergency" and to "3ive the procedures
and formalit.ies otherwise ~equired of political SUbdivisions by
law pertaining to:
1. Performance of public work and' tak:' ,19 whatever prUdent
action is necessary to ensure the :'lealth, safety, and
welfare of the cc munity;
2. En':ering into con racts;
3. Incurring obligat ons;
4. Employment of permanent and temporary workers;
5. Ut.lization of volunteer workers;
6. Re Ital of equipmeolt;
7.
Acquisition
distribution,
and
with
or
without
compensation, of ~upplies, materials, and facilities;
8. Appropriation and expenditure of publlc funds;
NOW, THEREFORE, BE IT PROCLAIMED AND RESOL~ED BY THE BOARD OF
COUNTY COMMJ ;SIONERS OF cor ':'IER COUNTY, FLORIDA, that a state of
local emergEncy is hereby :leclared' for all territory within the
legal bounda "les of Collier County.

BE IT FURTHER PROCLAIMED AND RESOLVED that:
1. Evacuation is on a voluntary basis only.
2. Shelters designated as Pine Ridge Middle School,
Immokalee Middle School and Lely Elementary School shall be opened
by the Red::ross as needed.
3. The regular meeting of the Board of County Commissioners
on Tuesday, August 1, 1995, at 9:00 A.M. will remain as scheduled.
4. The work schedule of County employoes will be left to
the discretion of the Count { Manager.
BE IT FURTHER PROCLAIJ eo AND RESOLVED that the state of local
emergency ,ieclared herein ;shall automaticall~ expire after seven
days pursu~nt to Section 2~2.38(3)(a)(5), FloIida Statutes, unless
otherwise extended by the toard of County Commissioners.
This Resolution adopted after second and majority vote
favoring same.
