RELATING TO PETITION NO. CU-92-4 FOR
EXTENSION OF CONDITIONAL USE OF PROPERTY
HEREINAFTER DESCRIBED IN COLLIER COUNTY,
FLORIDA
WHEREAS, the Leqislature of the State of Florida in Chapter 125,
Florida Statutes, has conferred on all Counties in Florida the power to
establish, coordlnate and enforce zoninq and such business requlations
as are necessary for the protection of the public; and
WHEREAS, the County pursuant thereto has adopted a Land
Development Code (Ordinance No. 91-102) which establishes comprehensive
zoninq regulations for the zoninc of particular divisions of the
County, amonq which is the qrant:' nq and extendinq tt e time period of
Conditional Uses; and
WHEREAS, on September 8, 19!'.2, the Board of ZOl.inq Appeals enacted
Resolution No. 92-67, attached hereto and incorporated herein, which
qranted a conditional use pursuant to Ordinance No. 91-102, for a
sinqle-family detached cluster development, on the below described
property; and
WHEREAS, on September 7, 19 3, the Board of ZOl.inq Appeals enacted
Resolution No. 93-'371, attached l.ereto and incorporated herein, which
qranted the first of potentially three one (1) year extensions to the
Provisional Use qranted in Resolution No. 92-67; anI,:
WHEREAS, on August 9, 1994, the Board of Zonin~' Appeals enacted
Resolution No. 94-585, attached ereto and incorpor'ted herein, which
qranted the second of three (3) i~e (1) year extens:on to the
Provisional Use qranted in Resoll,tion No. 92-67; and
WHEREAS, Subsection 2.7.4.5 of the Land Develorment Code provides
that the Board of Zoninq Appeals may extend the one (1) year time
period for a cond,.tional use whi.:h has not been commenced;
NOW, THEREFORE BE IT RESOLVED, by the Board of Zoninq Appeals of
Collier County, Florida that:
