RESOLurION OF THE BOARD OF COUNTY
COMMISSIONERS, COLLIER COUNTY, FLORIDA,
AUTHORIZING WAIVER OF LIBRARY SYSTEM IMPACT
FEES, PARKS AND RECREATIONAL FACILITIES IMPACT
FEES, ROAD IMPACT FEES, EMERGENCY MEDICAL
SERVICES IMPACT FEES AND EDUCATIONAL
FACILITIES SYSTEM IMPACT FEES FOR ONE HOUSE TO
BE CONSTRUCTED BY IMMOKALEE HABITAT FOR
HUMANITY, INC. ON LOT 15, HIGHLANDS HABITAT
SUBD!VISION, IMMOKALEE.
WHEREAS, Collier County has recognized and attempted to
address the ILck of adequate and affordable housing for moderate,
low, and very-low income households in the County and the need
for creative .md innovative programs to assist in the provision
of such housjng by including several provisions in the Collier
County Growth Management PIal', including: objec:ive 1. 4, policy
1.4.1; objective 1.5, policy 1.5.2, policy 1.5. I, policy 1.5.4,
policy 1.5.f I policy 1.5.1; objective 1.6, policy 1.6.3;
objective 2.1, policy 2.1.1, policy 2.1.2, poli':y 2.1.3, policy
2.1.5, and policy 2.1.6 of th~ Housing Element; &nd
WHEREAS, Collier County has received funding pursuant to the
State Housin9 Initiatives Partnership Progra~. set forth in
Section 420.907 et. seq., F. orida Statutes anl: Chapter 91-37,
Florida Administrative Code; nd
WHEREAS, in accordance "ith Collier County Ordinance No.
93-19, the County is authorized to use funding from the State
Housing Initia.tives Partnership (SHIP] progran for waivers of
Collier County impact fees; and
WHErtEAS, Immokalee Habit- 'it for Humanity, I'lc. is seeking a
waiver of impa:t fees; and
WHEREAS, Immokalee Habit t for Humanity, In'.. will construct
one (1) three-bedroom unit (the "Dwelling Unit") on Lot 15,
Highlands Hab: tat Subdivision, Immokalee which is proposed to
sell for FortJ-Six Thousand Five Hundred Dollars ($46,500.00);
and
WHEREAS, the Dwelling Urit will be purchas'ild by a very low
income household which

a minimum of five
hundred (500) hours of "Sweat Equity" before it obtains title to
the house; and
WHEREAS, Mr. Charles C. Smith, Vice President of Immokalee
Habitat for Humanity, Inc., submitted to the Office of Housing
and Urban Improvement an Affordable Housing Application dated
August 23, 1955 for a waiver of impact fees for the construction
of a house on Lot 15, Highlands Habitat Subdivision, Immokalee, a
copy of said application is on file in the Housing and Urban
Improvement Department; and
WHEREAS, in accordance with Section 3.04 of the Library
System Impact Fee Ordinance, Ordinance No. 88-'n, as amended;
Section 4.05 cf the Parks and Recreational Facilities Impact Fee
Ordinance, Orainance No. 88-9" as amended; Sec1ion 3.04 of the
Road Impact Fee Ordinance, ')rdinance No. 92-; 2, as amended;
Section 3.05 Gf the Emergency Medical Services S:'stem Impact Fee
Ordinance, OrQinance No. 91-71, as amended; and Section 3.05 of
the Educational Facilities System Impact Fee Ordinance, Ordinance
No. 92-33, as amended; an applicant may obtain a ~aiver of impact
fees by qualifying for a waiver.; and
WHEREAS, Immokalee Habit. : for Humanity, In'". has qualified
for an impact fee waiver basec upon the following representations
made by Immokal'ae Habitat for ,~umanity, Inc.:
A. The Dwelling Unit shall be sold to a first-time home
buyer.
B. The Dwelling Unit stlall be sold to a ltousehold with a
very low income le\ 1 as that term i! defined in the
Appendices to the rl;pective Impact Fet Ordinances and
the monthly payment ..0 purchase the unit must be wi thin
the affordable housing guidelines esti~blished in the
Apper..Hces to the respective Impact Fee Ordinances.
C. The O"elling Unit shall be the Homestead of the owner.
D. The Dwelling Unit shall remain afforda'.,le for fifteen
(15) ~'ears from the date the certifica::e of occupancy
is issued.

NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that:
1. The Board of County Commissioners hereby authorizes the
County Manager to issue an Authorization for waiver of
impact fees to Immokalee Habitat for Humanity, Inc. for
one (1) house which shall be constructed on Lot 15,
Highlands Habitat Subdivision, Immokalee, Collier
Counr.y, Florida.
2. Upon receipt by the Housing and Urban Development
Dire.~tor of an agreement for waiver of impact fees
sign~d by Irnrnokalee Habitat for Humanity, Inc., and/or
the . lurchaser, or other documentation ar:ceptable to the
County Attorney, tIle Board of Count' Commissioners
hereby authorizes th! payment by ColliEr County of the
following impact feel:i from the Affordab'e Housing Trust
Fund, Fund (191), in the following amo~nts for the one
(1) house to be built on Lot 15, Highlands Habitat
SUbdivision, Irnrnokalee by Immokale; Habitat for
Humanity, Inc.:
A. Library Impact ee $ 180.52
B. Road Impact FeE: 1,379.00
C. .'?arks and Recre ltional Facilities
Impact Fee:
(1) Community Parks 399.00
(2) Regional Pilrks 179.00
D. ;1oIS Impact Fee 14.00
E. Educational Fac : li ties System
Impact Fee Ll. 778.00
Total Impact Fees $ 3,929.52
3. The p'lyment of impact fees by Collier Cc unty is subject
to tlle execution o;'1d recordation of an Affordable
Housing Agreement for payment of Collie: County Impact
Fees ',etween the prnperty owner and/o)' purchaser and
the County.
