RESOLUTION OF THE BOARD OF COUNT~
COMMISSIONERS, COLLIER COUNT~, FLORIDA,
AUTHORIZING WAIVER OF LIBRAR~ S~STEM IMPACT
FEES, PARKS AND RECREATIONAL FACILITIES IMPACT
FEES, ROAD IMPACT FEES, EMERGENC~ MEDICAL
SERVICES IMPACT FEES AND EDUCATIONAL
FACILJTIES SYSTEM IMPACT FEES FOR ONE HOtlSE TO
BE CONSTRUCTED B~ IMMOKALEE HABITAT FOR
HUMAN:. T~, INC. ON LOT 5, HIGHLANDS HABITAT
SUBDIVISION, IMHOKALEE.
WHEREAS, Collier County has recognized and attempted to
address the la~k of adequate and affordable housing for moderate,
low, and very- low income hous,~ holds in the Count.y and the need
for creative and innovative ~ograms to assist il the provision
of such housh.g by including several provisions in the Collier
County Growth Management Plan. including: object .ve 1.4, policy
1.4.1; objective 1.5, policy 1.5.2, policy 1.5.3, policy 1.5.4,
policy 1.5.5, policy 1.5.6; objective 1.6, policy 1.6.3;
objective 2.1, policy 2.1.1, policy 2.1.2, polic~ 2.1.3, policy
2.1. 5, and policy 2.1. 6 of the Housing Element; a1.d
WHEREAS, Collier County h',s received funding pursuant to the
State Housing Initiatives ~ ~tnership Program set forth in
Section 420.907 et. seq., Florida Statutes and Chapter 91-37,
Florida Administrative Code; and
WHEREAS, in accordance with Collier County Ordinance No.
93-19, the County is authori:, 1d to use funding from the state
Housing Initiat ives Partnersh p [SHIP] Program Eor waivers of
Collier County impact fees; an,
WHEREAS, Immokalee Habitat for Humanity, Inc. is seeking a
waiver of impac1; fees; and
WHEREAS, L.rnokalee Habita1. for Humanity, Inc. will construct
one (1) three-bedroom unit ,the "Dwelling Unit") on Lot 5,
Highlands Habitat Subdivision,) Immokalee which :i.s proposed to
sell for Forty-six Thousand Five Hundred Dollar:: ($46,500.00);
and
WHEREAS, t 1e Dwelling Uni~: will be purchased by a very low
income househol j which is rec .tired to invest a minimum of five

hundred (500) hours of "Sweat Equity" before it obtains title to
the house; and
WHEREAS, Mr. Charles C. Smith, Vice President of Immokalee

Habitat for Humanity, Inc., submitted to the Office of Housing
and Urban Improvement an Affordable Housing Application dated
August 23, 1995 for a waiver of impact fees for the construction
of a house on Lot 5, Highlands Habitat Subdivision, Immokalee, a
copy of said ~pplication is on file in the Housing and Urban
Improvement Department; and
WHEREAS, in accordance ,.,ith Section 3.04 of the Library
System Impact Fee ordinance, Ordino.nce No. 88-"7, as amended;
section 4.05 c~ the Parks and Recreational Facil~ties Impact Fee
Ordinance, Or~inance No. 88-9l, as amended; Sectlon 3.04 of the
Road Impact Fee Ordinance, \..rdinance No. 92-~~, as amended;
Section 3.05 of the Emergency Medical Services System Impact Fee
Ordinance, Ordinance No. 91-71, as amendedj and Section 3.05 of
the Educational Facilities System Impact Fee Ordi~ance, Ordinance
No. 92-33, as amendedj an appl:cant may obtain a ~'aiver of impact
fees by qualifying for a waive.; and
WHEREAS, Il:unokalee Habita..; for Humanity, Inc. has qualified
for an impact fee waiver based upon the following representations
made by Imrnokalee Habitat for Humanity, Inc.:
A. The Dwelling Unit shall be sold to a first-time home
buyer,
B. The Dwelling unit sl 1\11 be sold to a t. :>usehold with a
very low income level as that term is defined in the
Appendices to the respective Impact FeE Ordinances and
the m.>nthly payment to purchase the unit must be within
the ,ffordable hous ing guidelines established in the
Appendices to the respective Impact Fee Ordinances.
C. The D~elling Unit shall be the Homestea~ of the owner.

NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNT~, FLORIDA, ,that:
1. The Board of County Commissioners hereby authorizes the
County Manager to issue an Authorization for waiver of
impact fees to Immokalee Habitat for Humanity, Inc. for
one (1) house which shall be constructed on Lot 5,

2. Upon receipt by the Housing and Urban Development
Dire'l::tor of an agr',:ement for waiver of impact fees
signed by Irnrnokalee Habitat for Humani1y, Inc., and/or
the $)urchaser, or ot'ler documentation a :ceptable to the
Cour..ty Attorney, tl.e Board of Count.' Commissioners
hereby authorizes the payment by Collier County of the
following impact fees from the Affordable Housing Trust
Fund, Fund (191), in the following amOl"nts for the one
(1) house to be b lilt on Lot 5, Hi'Jhlands Habitat
