AUTHORIZING WAIVER OF LIBRARY SYSTEM IMPACT

address the lack of adequate and affordable housing for moderate,

objective 2.1, policy 2.1.1, policy 2.1.2, polie] 2.1.3, policy

State Housing Initiatives ~ rtnership ~rogram set forth in
Section 420.907 .r-t. seq., Florida Statutes and Chapter 91-37,
Florida Administrative Code; and
WHEREAS, in accordance with Collier County Ordinance No.

Collier County impact fees; an,
WHEREAS, Immokalee Habitat for Humanity, Inc. is seeking a
waiver of impact fees; and
WHEREAS, Inmokalee Habitat for Humanity, Inc. will construct
one (1) three-bedroom unit (.:he "Dwelling Unit") on Lot 3,
Highlands Habitat Subdivision, Immokalee which j s proposed to
sell for Forty-Six Thousand Five Hundred Dollarr- ($'46,500.00) ;
and ~~
WHEREAS, tJ a Dwelling Unit will be purchased by a very low
income householcl which is req.,.ired to invest a ml.nimum of five

hundred (500) hours of "Sweat Equity" before it obtains title to
the house; and
WHEREAS, Hr. Charles C. Smith, Vice President of Immokalee
Habitat for Humanity, Inc., submitted to the Office of Housing
and Urban Impr.ovement an Affordable Housing Application dated
August 23, 199,'; for a waiver of impact fees for the construction
of a house on Lot: 3, Highlands Habitat SUbdivision, Immokalee, a
copy of said ,lpplication is on file in the Housing and Urban
Improvement Department; and
WHEREAS, in accordance \:ith Section 3.04 of the Library
System Impact Fee Ordinance, Ordinance No. 8 8-~ 7, as amended;
Section 4.05 o~ the Parks and ~ecreational Facilities Impact Fee

Ordinance, Ordinance No. 88-9~, as amended; Sect ..on 3.04 of the
Road Impact Fee ordinance, 0rdinance No. 92-22, as amended;
Section 3.05 of the Emergency Medical Services System Impact Fee
Ordinance, Ordinance No. 91-71, as amended; and Section 3.05 of
the Educational Facilities Sys'_em Impact Fee Ordh,ance, Ordinance
No. 92-33, as amended; an applcant may obtain a baiver of impact
fees by qualifying for a waive'; and
WHEREAS, I.nmokalee Habitat for Humanity, Inc. has qualified
for an impact fee waiver based upon the following representations
made by Immokalee Habitat for Humanity, Inc.:
A. The Dwelling unit st all be sold to a :irst-time home
buyer.
B. The Dwelling Unit sl III be sold to a hmsehold with a
vnry low income level as that term is defined in the
Appenc1ices to the respective Impact Fee Ordinances and
the m',nthly payment to purchase the unit must be within
the affordable hOUSJ ng guidelines established in the
Appendices to the re~pective Impact Fee 0rdinances.
C. The D~elling unit shall be the Homestead of the owner.
D. The Dwelling Unit shall remain affordal'le for fifteen
(15) -rears from the :late the certif icate of occupancy
is is~ued.

NOW THERBFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that:
1. The Board of County commissioners hereby authorizes the
County Manager to issue an Authorization for waiver of
impact fees to Immokalee Habitat for Humanity, Inc. for
one (1) house which shall be constructed on Lot 3,
Highlands Habitat SUbdivision,
Coun':y, Florida.
2. Upon receipt by the Housing and Urban Development

signed by Immokalee ~{abitat for Humanit y, Inc., and/or
the ,JUrchaser, or ot: .er documentation a1ceptable to the
