\-. WHEREAS, Collier Coun y has received funr1ing pursuant to the
State Housing Initiativ~
Partnership Pro;ram set forth in
Section 42('.907 at. seq., Florida statutes and Chapter 91-37,
Florida Administrative Code; and
WHER~S, in accordance with Collier C .unty Ordinance No.
93-19, th~. County is aut~orized to use funt'ing from the State
Housing In; tiatives Partr !rship [SHIP) Pro~ 'am for waivers of
Collier County impact fee!, and
WHEREAS, Immokalee H.,itat for Humanity, Inc. is seeking a
waiver of impact fees; and
WHEREA;, Immokalee Habitat for Humanity, Inc. will construct
one (1) thl ee-bedroom unit (the "Owelling Unit") on Lot 4, Block
13, Naples Manor Extension, Naples, Florida which is proposed to
sell for Fcrty Six Thousa,nd Five Hundred Do Llars ($46,500.00);

WHEREAS, the Owelling Unit will be owned by a very low
income household, and
WHEREAS, Mr. Charles C. Smith, Executive Vice President of
Immokalee Habitat for Humanity, Inc., submitted to the County
Manager's Office an Affordable Housing Application dated May 26,
1995 for ~ waiver of impact fees for the construction of a house
on Lot 4, Block 13, Naples Manor Extension, Naples, Florida, a

3.04 of the Road Impact Fee Ordinance, Ordinance No. 92-22, as
amended; Section 3.05 of the Emergency Med cal Services System
Impact Fee Ordinance, Ot'dinance No. 91-71, as amended; and
Section 3.05 of the Edu ational Facilitie... System Impact Fee
Ordinance, Ordinance No. 92-33, as amendeu; an applicant may
obtain a w,'iver of impact fees by qualifying for a waiver; and
WHEREAS, Immokalee Habitat for Humanity, Inc. has qualified
for an impact fee waiver based upon the foll(,ling representations
made by Immokalee Habitat for Humanity, Inc.:
A. The Dwelling Ur t shall be owned y a first-time home
buyer.
B. The Dwelling Un.t shall be owned by a household with a
very low income level as that ter.\ is defined in the
hppendices to the respective Impact Fee Ordinances and
t he monthly paYll"mt to purchase the unit must be within
the affordable housing guidelines established in the
A")pendices to th.! respective Impact Fee Ordinances-.

c. The owelling Unit'shall be the Homestead of the owner.
D. The OWelling Unit shall remain affordable for fifteen
(15) years from the date the certificate of occupancy
is issued.

NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that:
1. The Board of County Commissioners hereby authorizes the
County Manager to issue an Authorization for waiver of
impact tees to Immokalee Habitat for Humanity, Inc. tor
one (1) house which shall be constructed on Lot 4,
Block 13, Naples Manor Extensicn, Naples, Collier
:ounty, Florida.
2. Upon receipt t, the Housing 8n< Urban Improvement
Director of an original purchase contract signed by
Immokalee Habitpt for Humanity, Inc'. and the Purchaser,
or other docu~ent8tion acceptakle to the County
Attorney, the Board of County Commissioners hereby
authorizes the payment by Collier County of the
~ollowing impac' fees from the Affordable Housing Trust
Fund, Fund (191 , in the followin~ amounts for the one
(1) house to be built on Lot 4, Block 13, Naples Manor
::xtension, Nap~l!s, Florida by Immokalee Habitat tor
Humanity, Inc.

3. The payment of impact tees by Collier County is subject
to the execution and recordation of an Affordable
Housing Agreement for payment of Collier County Impact
Pees between the property owner and/or purchaser and
the County.
This Resolution adopted after motion, second and majority
vote favoring same.
