RESOLUTION OF TH! BOARD OF COUNTY
COMMISSIONERS, COLLIER COUNTY, FLORIDA,
AUTHORIZING PAYMtNT OF REGIONAL WATER SYSTEM
IMPACT FEES, REGIONAL SEWER SYSTEM IMPACT
FEES, LIBRARY SYSTEM IMPACT FEES, PARKS AND
RECREATIONAL FACILITIES IMPACT FEES, ROAD
IMPACT FEES, EMERGENCY MEDICAL SERVICES SYSTEM
IMPACT FEES AND EDUCATIONAL FACILITIES SYSTEM
IMPACT FEES FOR ONE HOUSE TO BE CONSTRUCTED BY
IMMOKALEE HABITAT FOR HUMANITY, INC. ON LOT 8,

WHEREAS, Collier County has recognized and attempted to
address thf,~ lack of adequate and affordable housing for moderate,
low, and very-low income households in the County and the need
for creati,'e and innovativ! programs to assi.Jt in the provision
of such hc.using by includ! ng several provis; ons in the Collier
County Gro;{th Management Ilan, including: oblective 1.4, policy
1.4.1; obj.~ctive 1.5, poli =y 1.5.2, policy 1 5.3, policy 1.5.4,
policy 1. 5.5, policy 1. ';. 6; objective 1. 6, policy 1. 6.3;
objective 2.1, policy 2.1.1, policy 2.1.2, policy 2.1.3, policy
~.1.5, and policy 2.1.6 of the Housing Elemen1 j and
WHEREAS, Collier Coun"f has received func:ing pursuant to the
State Housing Initiative.. Partnership PrO(1 roam set forth in
Section 420.907 at. seq., Florida Statutes and Chapter 91-37,
Florida Adm~nistrative Code; and
WHEREAS, in accordance with Collier Cc mty Ordinance No.
93-19, the County is authorized to use fund ',ng from the State
Housing Initiatives partn t'ship [SHIP) Progl am for waivers of
Collier Courty impact fees and
WHEREAS, Immokalee Ha .itat for Humanity, Inc. is seeking a
Iwaiver of impact feesj and
WHEREA', Immokalee Habitat for Humanity, [nc. will construct
one (1) thrle-bedroom unit (the "Dwelling Unit") on Lot 8, Block
6, Naples Manor Extension, Naples, Florida which is proposed to
sell for Forty Six Thousal.d Five Hundred Do: lars ($46,500.00);
and

WHEREAS, the Dwelling Unit will be owned by a very low
income household, and
WHEREAS, Mr. Charles C. Smith, Executive Vice President of
Immokalee Habitat for Humanity, Inc., submitted to the County
Manager's Office an Affordable Housing Application dated May 26,
1995 for a waiver of impact fees for the construction of a house
on Lot 8, Block 6, Naples Manor Extension, Naples, Florida, a
copy of s lid application is on file in the Housing and Urban
Improvement Department; and
WHERE.\S, in accordance with Section 3.04 of the Regional
Water Syst;em Impact Fee Ordinance, Ordinance No. 90-86, as
amended j faction 3.04 of the Reqiona 1 Sewel System Impact Fee
Ordinance, Ordinance No. '0-87, as amended; 3ection 3.04 of the
Library S~stem Impact Fe' Ordinance, Ordin mce No. 88-97, as
amended; ~ection 4.05 of :he Parks and Recl sational Facilities
Impact Fee Ordinance, OrdInance No. 88-96, as amended; Section
3.04 of the Road Impact Fee Ordinance, Ordinance No. 92-22, as
amended~ Section 3.05 of the Emergency Medil~al Services System
Impact Fee Ordinance, 0: Unance No. 91-71
as amended; and
Section 3.05 of the Edu( ltional . Facilities System Impact Fee
Ordinance, Ordinance No. 92-33, as amended; an applicant may
obtain ~ walver of impact fees by qualifying for a waiver; and
WHEREAS, Immokalee Habitat for Humanity. Inc. has qualified
for an impact fee waiver based upon the follo\l1ng representations
made by Immokalee Habitat "or Humanity, Inc.:
A. T'le Dwelling Un. : shall be Clwned t ' a first-time home
buyer.
B. The Dwelling Unit shall be owned by a household with a
v'lry low income level as that tern- is defined in the
A'lpendices to th! respective Impact Fee Ordinances and
the monthly paymlnt to purchase the unit must be within
the affordable t ousing guidelines astablished in the
A~pendices to the respective Impact Pee Ordinances.

C. The Dwelling unit shall be the Homestead of the owner.
D. The Dwelling Unit shall remain affordable for fifteen
(15) years from the date the certificate of occupancy
is issued.

NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that:
1. The Board of County Commissioners hE!reby authorizes the
I~unty Manager to issue an Authorization for waiver of
impact fees to Immokalee Habitat for Humanity, Inc. for
I.ne (1) house which shall be constructed on Lot 8,
lilock 6, naples Manor Extension, Naples, Collier
iounty , Florida.
2.
TJpon receipt b) the Housing and Urban Improvement
i drector of an ::lrigin8l purchase :::ontract signed by
:{mmokalee Habitaf for Humanity, Inc, and the Purchaser,
or other docum~ntation acceptable to the County
Attorney, the Board of County Commissioners hereby
authorizes the payment by ColU'!r County of the
following impact fees from the Affol~able Housing Trust
Fund,' Fund (191) in the' following :amounts for the one
(t) house to be )uilt on Lot 8, Block 6, Naples Manor
E;,tension, Naples, Florida by Immokalee Habitat for
