COMMISSIONERS, COLLIER COUNT'{, FLORIDA,
AUTHORIZING PAYMENT OF REGIONAL WATER SYSTEM
IMPACT FEES, REGIONAL SEWER SYSTEM IMPACT
FEES, LIBRARY SYSTEM IMPACT FEES, PARKS AND
RECREATIONAL FACILITIES IMPACT FEES, ROAD
IMPACT FEES, EMERGENCY MEDICAL SERVICES SYSTEM
IHPACT FEES AND EDUCATIONAL FACILITIES SYSTEM
IMPACT FEES FOR ONE HOUSE TO BE CONSTRUCTED BY
IMMOKALEE HABITAT FOR HUMANI~Y, INC. ON LOT 5,

WHEREAS, Coli ier County has rE!cognized and attempted to
address th.! lack of adequate and affordable housing for moderate,
low, and very-low income households in the County and the need
for creati Ie and innovati',e programs to assi it in the provision
of such housing by incluc ing several provis ons in the Collier
County Grc ....th Management 'lan, including: ot jecti ve 1. 4, policy
1.4.1: objective 1.5, pol:cy 1.5.2, policy J ,5.3, policy 1.5.4,
policy 1.5.5, policy 1.5.6: objective 1.6, policy 1.6.3;
objec~ive 2.1, policy 2.1.1, policy 2.1.2, policy 2.1.3, policy
2.1. 5, and policy 2.1. 6 of the Housing Elemen:.; and
lolHEREAS, Collier Coun.y has received fun '1ng pursuant to the
State Housing' Initiative
Partn~rship Pro~ram set forth in
Section 420,907 et. seq. Florida Statutes and Chapter 91-37,
Florida Administrative Code; and
WHEREAS, in accordance with Co:'lier C unty Ordinance No.
93-19, the County is authorized to use funlting from the State
Housing Initiatives Partr ~rship [SHIP] Prog'~am for waivers of
Collier Cou~ty impact fees and
WHEREAS, Immoka lee H, 'Ji tat for Humanity, Inc. is seekin9 a
waiver of impact fees; and
WHEREA>, Immokalee Habitat for Humanity, Inc. will construct
one (1) th13e-bedroom unit (the "Dwelling Unit") on Lot 5, Block
6, Naples Manor Extension, Naples, Florida which is proposed to
sell for Forty Six Thousalld Five Hundred D(,Llars ($46,500.00);

WHEREAS, the Dwelling Unit will be owned by a very low
income household, and
WHEREAS, Mr. Charles C. Smith, Executive Vice President of
Immokalee Habitat for Humanity, Inc., submitted to the County
Manager's Office an Affordable Housing Application dated May 26,
1995 for a waiver of impact fees for the construction of a house
on Lot 5, Block 6, Uaples Manor Extension, Naples, Florida, a
copy of s~id application is on file in thf' Housing and Urban
Improvement Department; and
WHERE\S, in accordance with Section 3.04 of the Regional
Ordinance, Ordinance No.
0-87, as amended; Section 3.04 of the
Library S stem Impact Fe! Ordinance, Ordin mce No. 88-97, as
amended; Section 4.05 of the Parks and Reel eational Facilities
Impact Fe,~ Ordinance, Ord l.nance No. 88-96, IS amended; Section
3.04 of tho Road Impact Fee Ordinance, Ordinance No. 92-22, as
amend9d; Set:;tion 3.05 of the Emergency Medj ':al Services System
Impact Fee Ordinance, O~.dinance No. 91-71, as amended: and
Section 3.05 Of the Edul ltional . FacilitieF System Impact Fee
Ordinance, Ordinance No. 92-33, as amended; an applicant may
obtai n a wcdver ot impact ;'ees by qualifying for a waiver; and
WHEREAS, Immokalee Habitat tor Humanity. Inc. has qualified
for an impact fee waiver based upon the folio 'ing representations
made by Immokalee Habitat ~or Humanity, Inc.:
A. T:le Dwelling Un t shall be owned I r a first-time home
buyer.
B. The Dwelling Uni~ shall be owned by a household with a
very low income level as that terl is defined in the
1 ,pendices to the respective Impact Fee Ordinances and
t:le monthly paymE:,nt to purchase the unit must be within
the affordable housing guidelines established in the
Appendices to thf'J respective Impact Fee Ordinances.

C. The Dwelling Unit shall be the Homestead of the owner.
D. The Dwelling Unit shall remain affordable for fitteen
(15) years from the date the certificate of occupancy
is issued.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSION~~S OF COLLIER COUNTY, FLORIDA, that:
1.
The Board of County Commissioners hereby authorizes the
County Manager to issue an Authorization for waiver of
',mpact fees to Immokalee Habitat for Humanity, Inc. for
"ne (1) house which shall be constructed on Lot 5,
;ilock 6, llaples Manor Extensior, Naples, Collier
-:ounty, Flot'ida.
2. Upon receipt b) the Housing and Urban Improvement
'ir"!ctor of an :lriginal purchase contract signed by
1mmokalee Habita..: for Humanity, Inc and the Purchaser,
or other dOCUfl !ntation acceptab e to the County
A~~orney, the Board of County Commissioners hereby
authorizes the payment by CoiL er County of the
following impact fees from the Affo;dable Housing Trust
Fund,' Fund (191) in the' following lmounts for the one
(1) house to be ~uilt on Lot 5, B]0ck 6, Naples Manor
E:tension, Naplc-;, Florida by Immokalee Habitat for
Humanity, Inc.
