RESOLUTION OF THE BOARD OF COUNTY
COMMISSIONERS, COLLIER COUNTY, FLORIDA,
AUTHORIZING PAYMENT OF REGIONAL WATER SYSTEM
IMPACT FEES, REGIONAL SEWER SYSTEM IMPACT
FEES, LIBRARY SYSTEM IMPACT FEES, PARKS AND
RECREATIONAL FACILITIES IMP~CT FEES, ROAD
IMPACT FEES, EMERGENCY MEDICAL SERVICES SYSTEM
IMPACT FEES AND EDUCATIONAL FACILITIES SYSTEM
IMPACT FEES FOR ONE HOUSE TO BE CONSTRUCTED BY
IMMOKALEE HABITAT FOR HUMANITY, INC. ON LOT 4,
BI~CK 6, NAPLES MANOR EXTENSION, NAPLES,
FLORIDA.
WHEREAS, Collier County has recognized and attempted to
address th(, lack of adequate and affordable housing for moderate,
low, and v<3ry-low income households in the County and the need
for creati','e and innovati v'~ programs to assi:.t in the provision
of such hcusing by includ.ng several provisj ::ms in the Collier
County Gra~h Management Ilan, including: ob ective 1.4, policy
1.4.1: obj"!ctlve 1.5, poU:y 1.5.2, policy 1 5.3, policy 1.5.4,
policy 1.5.5, policy 1.5.6: objective 1.6, policy 1.6.3;
objective 2.1, policy 2.1.1, policy 2.1.2, policy 2.1.3, policy
2.1.5, and policy 2.1.6 of the Housing Elemen1: and
WHEREAS, Collier COUnl I has received func tng pursuant to the
State Housing Initiative, Partnership Proclram set forth in
Section 420.907 et. seq., Florida Statutes and Chapter 91-37,
Florida Adm~nistrative Code; and
WHEREAS, in accordance with Collier Cc mty Ordinance No.
93-19, the County is authorized to use fund ",ng from the State
Housing Initiatives Partn- rship [SHIP] Program for waivers of
Collier Coulty impact fees and
WHEREAS, Immokalee Ha itat for Humanity, Inc. is seeking a
waiver of impact fees; and
WHEREA:, Immokalee Habitat for Humanity, Tnc. will construct
one (1) thr :e-bedroom unit (the "Dwelling Unit~") on Lot 4, Block
6, Naples Manor Extension, Naples, Florida which is proposed to
sell for Forty Six ThouS81'd Five Hundred DOllars ($46,500.00);
and

WHEREAS, the Dwelling Unit will be owned by a very low
income household, and
WHEREAS, Hr. Charles C. Smith, Executive Vice President of
Immokalee Habitat for Humanity, Inc., submitted to the County
Manager's Office an Affordable Housing Application dated May 26,
1995 for a waiver of impact fees for the construction of a house
on Lot 4, Block 6, Naples Manor Extension, Naples, Florida, a
copy of sclid application is on fil"3 in the Housing and Urban
Improvement Department; and
WHEREl s, in accordance with Section 3.14 of the Regional
Water System Impact Fee Ordinance, Ordinance No. 90-86, as
amended; S'~ction 3.04 of:he RE'gional Sewer System Impact Fee
Ordinance, Ordinance No. S)-87, as amended; :ection 3.04 of the
Library S~'stem Impact Fef Ordinance, Ordini nee No. 88-97, as
amended; S"ction 4.05 of ',he Parks and Recr ~ational Facilities
Impact Fee Ordinance, Ordinance No. 88-96, as amended; Section
3.04 of the Road Impact Fee ordinance, Ordi'lance No. 92-22, as
amended; Section 3.05 of the Emergency Medi"al Services System
Impact Fee Ordinance, Or linance Nc. 91-71. as amended; and
Section 3.05 of the Educ ',tional Facilities System Impact Fee
ordinance, :lrdinance No. }2-33, as amended; an applicant may
obtain a waiver of impact fees by qualifying for a waiver; and
WHEREAS, Immokalee Habitat for Humanity, Inc. has qualified
for an impact fee waiver based upon the follo~ ing representations
made by Irnmokalee Habitat )r Humanity, Inc.:
A. TLe Dwelling Uni shall be o'M'ned b a first-time home
buyer.
B. The Dwelling Unit shall be owned by a household with a

The Dwelling Unit shall be the Homestead of the owner.
D. The Dwelling Unit shall remain affordable for fifteen
(15) years from the date the certificate of occupancy
is issued.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that:
1. The Board of County Commissioners hereby authorizes the
county Manager to issue an Authorizltion for waiver of
impact fees ~o Immokalee Habitat for Humanity, Inc. for
une (1) house which shall be constructed on Lot 4,
Block 6, Naples Manor Extension, Naples, Collier
':ounty, f lor ida.
2. Jpon receipt b~ the Housing and Urban Improvement
Jirector of an original purchase contract signed by
Immokalee Habita' for Humanity, Inc and the Purchaser,
or other docul'l,entation acceptab..,e to the County
Attorney, the Board of County Commissioners hereby
authorizes the payment by Coll er County of the
following impact fees from the Affo'dable Housing Trust
Fund, Fund (191\ / in the following amounts for the one
(1) house to be built on Lot 4, Block 6, Naples Manor
~xtension, Naples, Florida by Immokalee Habitat for
Humanity, Inc.
