RESOLUTION OF THE BOARD OF COUNTY
COMMISSIONERS, COLLIER COUNTY, FLORIDA,
AUTHORIZING PAYMENT OF REGIONAL WATER SYSTEM
IMPACT FEES, REGIONAL SEWER SYSTEM IMPACT
FEES, LIBRARY SYSTEM IMPACT FEES, PARKS AND
RECREATIONAL FACILITIES IMPACT FEES, ROAD
IMPACT FEES, EMERGENCY MEDICAL SERVICES SYSTEM
IMPACT FEES AND EDUCATIONAL FACILITIES SYSTEM
IMPACT FEES FOR ONE HOUSE TO BE CONSTRUCTED BY
IMMOKALEE HABITAT FOR HUMANITY, INC. ON LOT 3,
BLOCK 6, NAPLES MANOR EXTENSION, NAPI,ES,
FLORIDA.
WHEREAS, Collier County has recognized and attempted to
address th,~ lack of adequate and affordable housing for moderate,
low, and very-low income households in the County and the need
for creati~ and innovati\~ programs to assiJt in the provision
of such hc..using by includ "ng several provis.ons in the Collier
County Gro4th Management 1 lan, including: otjective 1.4, policy

policy 1.5.5, policy 1.5.6; objective 1.6, policy 1.6.3;

2.1.5, C'lnd policy 2.1.6 of the Housing Elemen"; and
WHEREAS, Collier Coun'y has received fun(,ing pursuant to the
State Housing Initiative Partnership Proqram set forth in
Section 42C. 907 et. seg., Florida statutes and Chapter 91-37,
Florida ~dm~nistrative Code; and
WHEREAS, in accordance with Collier C( .1nty Ordinance No.
93-19, the County is authorized to use func ing from the State
Housing Initiatives Part" rship (SHIP) prog' am for waivers of
Collier County impact fees and
WHEREAS, Immokalee He- dtat for Humanity, Inc. is seeking a
waiver of impact fees; and
WHEREA!:, Immokalee Habitat for Humanity, Inc. will construct
one (1) thr !e-bedroom unit (the "Dwelling Unit") on Lot 3, Block
6, Naples Manor Extension, Naples, Florida which is proposed to
sell for Forty Six Thousa"d Five Hundred DOllars ($46,500.00);
and

WHEREAS, the Dwelling Unit will be owned by a very low
income household, and
WHEREAS, Mr. Charles C. Smith, Executive Vice President of
Immokalee Habitat for Humanity, In-:., submitted to the County
Manager's Office an Affordable Housing Application dated May 26,
1995 for a waiver of impact fees for the construction of a house
on Lot J, Block 6, Naples Manor Extension, Naples, Florida, a
copy of s lid application is on file in thE' Housing and Urban
Improvemen~ Department; and
WHERE ~S, in accordance with Si!ction J. 04 of the Regional
Water SysT~m Impact Fee ordinance, Ordinance No. 90-86, as
amended; ! action 3.04 of the Regional Sewel System Impact Fee
Ordinance, Ordinance No. 10-87, as amended; 3ection 3.04 of the
Library S: stem Impact Fe: Ordinance, Ordin mce No. 88-97, as
amended; S.action 4.05 of the Parks and RecI eational Facilities
Impact Feu Ordinance, Ordinance No. 88-96, IS amended; Section
3.04 of the Road Impact Fee Ordinance, Ordinance No. 92-22, as
amended; Section 3.05 of the Emergency Medi ":al Services System
Impact Fee Ordinance, 0, iinance ~o. 91-71. as amended; and
Section 3.05 of the Edu< Jtional Facilities System Impact Fee
Ordinance, Ordinance No. 92-33, as amended i an applicant may
obtain a we.iver of impact ~ees by qualifying for a waiver; and
WHEREAS, Immokalee Habitat for Hu~anity( Inc. has qualified
for an impact fee waiver based upon ~he folio' ing representations
made by Immokalee Habitat ;'or Humanity, Inc.:
A. Ti.e Dwelling Un : ~;hall be owned t ' a first-time home
buyer.
B. The Dwelling Unic shall be owned by a household with a
v"!ry low income level as that terr: is defined in the
A'~endices to thn respective Impact Fee Ordinances and

C. The Dwelling Unit shall be the Homestead of the owner.
D. The Dwelling Unit shall r~main affordable for fifteen
(15) years from the date the certificate of occupancy
is issued.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLOHIDA, that:

The Board of County Commisfjioners hereby authorizes the
~ounty Manager to issue an Authori.~ation for waiver of
impact fees to Immokalee Habitat for Humanity, Inc. for \
me (1) house which shall be constructed on Lot 3,
