RESOLUTION OF THE BOARD OF COUNTY
COMMISSIONERS, COLLIER COUNTY, FLORIDA,
AUTHORIZING PAYMENT OF REGIONAL WATER SYSTEM
IMPACT FEES, REGIONAL SEWER SYSTEM IMPACT
FEES, LIBRARY SYSTEM IMPACT FEES, PARKS AND
RECREATIONAL FACILITIES IMPACT FEES, ROAD
IMPACT FEES, EMERGENCY MEDICAL SERVICES SYSTEM
IMPACT FEES AND EDUCATIONAL FACILITIES SYSTEM
IMPACT FEES FOR ONE HOUSE TO BE CONSTRUCTED BY
IMMOKALEE HABITAT FOR HUMANITY, INC. ON LOT

low, and very-low income households in the County and the need
for creati',e and innovath.! programs to assilt in the provision

County Grc~h Management Ilan, including: oblective 1.4, policy
1.4.1; objoctive 1.5, polj.~y 1.5.2, policy 1.5.3, policy 1.5.4,

objective 2.1, policy 2.1.1, policy 2.1.2, policy 2.1.3, policy
2.1. 5, and policy 2.1. 6 of the Housing Elemeni.; and
WHEREAS, Collier Coun' y has received funoinq pursuant to the
State Housing Initiative' PartnerShip Pr~;~am set forth in
Section 42C'.907 eta seQ., Florida Statutes and Chapter 91-37,
Florida Administrative Coder and
WHEREAS, in accordance with Collier CL mty Ordinance No.
93-19, the County is authorized to use func: lng from the State
Housing Initiatives Partr. rship [SHIP) procr am for waivers ot
Collier COUllty impact fees and
WHEREAS, Immokalee Hz: >itat for Humanity, Inc. is seeking a
waiver ot impact fees; and
WHEREA:, Immokalee Habitat tor Humanity, Inc. will construct

one (1) thr'le-bedroom unit (the "Dwelling Unit") on Lot 36, Block
5, Naples Manor Extension, Naples, Florida which is proposed to
sell for Forty Six Thousand Five Hundred Do\lars ($46,500.00);
and

WHEREAS, the Dwelling' Unit will be owned by a very low
income household, and
WHEREAS, Mr. Charles C. Smith, Executive Vice President of
Immokalee Habitat tor Humanity, Inc., submitted to the County
Manager's Office an Affordable Housing Application dated May 26,
1995 for a waiver of impact fees for the construction of a house
on Lot 36, Block 5, Naples Manor Extension, Naples, Florida, a
copy of s.,dd application is on file in the Housing and Urban
Improvement Department; and
WHERE,\S, in accordance with Section 3.04 of the Regional
Water Sys~em Impact Fee Ordinance, Ordinance No. 90-86, as
amended; f,ection 3.04 ot the Regional Sewel System Impact Fee
Ordinance, Ordinance No. ~0-87, as amended; 3ection 3.04 ot the
Library S~. stem Impact Fe, J Ordinance, Ordin Inca No. 88-97, as

amended; eection 4.05 ot1 the Parks and Rec:r eational Facilities
Impact Fee ordinance, orAiriance No. 88-96, as amended; Section

3.04 of the Road Impact Fe. Ordinance, Ordinance No. 92-22, as
amended; Section 3.05 of the Emergency Medi'.:al Services System
Impact Fee ordinance, Orjinance No. 91-71. as amended; and
Section 3.05 of the Edu(ltional Facilities System Impact Fee
Ordinance, Ordinance No. 92-33, as amended; an applicant may
obtain 8 waiver of impact tees by qualifying for a waiver; and
WHEREAS, Immokalee Habitat for Humanity Inc. has qualified
for an impact fee waiver based upon the foll~ling representations
made by Immokalee Habitat or Humanity, Inc.:
A. TI'le Dwelling Un; : shall be owned t.f a first-time home
buyer.

The Dwelling Unit shall be owned by a household with a
v, try low income level as that tern, is defined in the
A ,pendices to th.;' respective Impact Fee Ordinances and
the monthly paymc'nt to purchase the unit must be within
the atfordable t.ousing guidelines established in the
Appendices to the respective Impact Fee Ordinances.

C. The Dwelling Unit shall be the Homestead of the owner.
D. The Dwelling Unit shall remain affordable for fifteen
(15) years trom the date the certificate of occupancy
is issued.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONeRS OF COLLIER COUNTY, FLORIDA, that:

The Board of County Commissioners hereby authorizes the
~ounty Manager to issue an Authorization for waiver ot
impact fees to Immokalee Habitat for Humanity, Inc. for
me (1) house which shall be constructed on Lot 36,
'Hock 5, Naples Manor Extensior, Naples, Collier
~ounty, Florida.

Upon receipt b
the Housing ant Urban Improvement
)irector of an original purchase contract signed by
!mmokalee Habitat for Humanity, Inc and the Purchaser,
or other docu~entation acceptab.e to the County
Attorney, the Board of County Commissioners hereby
authorizes the payment by CoIl er County ot the
following impact fees from the Affcrdable Housing Trust
Fund, Fund (191; I in the following amounts for the one
(1) house to be built on Lot 36, Biock 5, Naples Manor
