RESOLUTION OF THE BOARD OF COUNTY
COMMISSIONERS, COLLIER COUNTY, FLORIDA,
AUTHORIZING PAYMENT OF REGIONAL WATER SYSTEM
IMPACT FEES, REGIONAL SEWER SYSTEM IMPACT
FEES, LIBRARY SYSTEM IMPACT FEES, PARKS AND
RECREATIONAL FACILITIES IMPACT FEES, ROAD
IMPACT FEES, EMERGENCY MEDICAL SERVICES SYSTEM

IMPACT FEES FOR ONE HOUSE TO BE CONSTRUCTED BY
IMMOKALEE HABITAT FOR HUMANITY, INC. ON LOT
35, BLOCK 5, NAPLES MANOR EXTENSION, NAPLES,
FLORIDA.
WHEREAS, Collier County has recognized and attempted to
address th,~ lack of adequate and affordable housing for moderate,
low, and very-low income households in the County and the need
for creati Ie and innovati\'!i programs to assi'lt in the provision
of such hc..using by includ~.ng several provis: ons in the Collier
County Groith Management llan, including: Objective 1.4, policy
1.4.1; obj,!ctive 1.5, pOll,:y 1.5.2, policy 15.3, policy 1.5.4,
policy 1.5.5, policy 1. !;). 6; Objective 1.6, policy 1.6.3;
objective 2.1, policy 2.1.1, policy 2.1.2, policy 2.1.3, policy
2.1.5, and policy 2.1.6 of the Housing ElemenT'; and
WHEREAS, Collier Coun~y has received funo,ing pursuant to the
State Housing' Initiative', Partnership pronram set forth in
Section 420.907 .t. seq., Florida Statutes and Chapter 91-37,
Florida Administrative Code; and
WHEREAS, in accordance with Collier Cr. mty Ordinance No.
93-19, the County is authorized to use func' Lng from the State
Housing Initiatives Partn rship [SHIP] prog:.'am for waivers of
Collier County impact fees and
WHEREAS, Immokalee Ha ,itat for Humanity, Inc. is seeking a
waiver of impact fees; and
WHEREAl;, Immokalee Habitat for Humanity, Inc. will construct
one (1) thr:e-bedroom unit (the "Dwelling Unit") on Lot 35, Block
5, Naples Manor Extension, Naples, Florida which is proposed to
sell for Forty Six Thousa:,ld Five Hundred Dol.lars ($46,500.00);
and

WHEREAS, the OWelling Unit will be owned by a very low
income household, and
WHEREAS, Mr. Charles C. Smith, Executive Vice President of
Immokalee Habitat for Humanity, Inc., submitted to the County
Manager's Office an Affordable Housing Application dated May 26,
1995 for a waiver of impact fees for the construction of a house
on Lot 35, Block 5, Naples Manor Extension, Naples, Florida, a
copy of s'lid application is on file in the Housing and Urban
Improvement Department; and
WHERE,o\S, in accordance with Section 3.04 of the Regional
Water Sysl:em Impact Fee Ordinance, Ordinance No. 90-86, as
amended; f ection 3.04 of the Regional Sewer System Impact Fee
Ordinance, Ordinance No. ;0-87, as amended; Section 3.04 ot the
Library S, stem Impact Fet Ordinance, Ordir. lnce No. 88-97, as
amended; Section 4.05 of the Parks and ReCl' eational Facilities
Impact Fe\1 ordinance, Orchnance No. 88-96, 18 amended; Section
3.04 ot the Road Impact Fee Ordinance, Ordinance No. 92-22, as
amended; Section 3.05 of the Emergency Med: oal Services system
Impact Fee Ordinance, O~dinance No. 91-7~, as amended; and
Section 3.05 Of the Edul.ational' Facilitiel, System Impact Fee
Ordinance, Ordinance No. 92-33, as amended; an applicant may
obtain a w,iver of impact fees by qualifying for a waiver; and
WHEREAS, IMDlokalee Habitat for Humanity. Inc. has qualified
for an impact fee waiver based upon the toIle" ring representations
made by Immokalee Habitat ,tor Humanity, Inc.:
A. TIle Dwelling Un! t shall be owned i ( a first-time home
buyer.
B. The Dwelling Unit shall be owned by a household with a
very low income level as that tert'\ is defined in:.the

the affordable housing quidelines established in the

The OWelling Unit shall be the Homestead of the owner.
The Dwelling Unit shall remain affordable for fifteen
(15) years from the date the certificate of occupancy
is issued.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that:
1. ~he Board of County Commissioners h~reby authorizes the
l.:ounty Manager to issue an Authorization for waiver of
:I,mpact fees to I1D1Ilokalee Habitat for Humanity, Inc. for
nne (1) house which shall be constructed on Lot 35,
~lock 5, Naples Manor Extension, Naples, Collier
l:ounty, Florida.
Vpon receipt by the Housing and Urban Improvement
Jirector of an original purchase contract signed by
'!mmokalee Habita" for Humanity, Inc and the Purchaser,
or other documentation acceptable to the County
Attorney, the Board of County Commissioners hereby
authorizes the payment by Collj~r County of the
following impact tees from the Affo~:dable Housing Trust
Fund,' Fund (191) I in the' following "mounts for the one
('1) house to be JUilt on Lot 35, Block 5, Naples Manor

Humanity, Inc.

3. The payment of impact fees by Collier County is subject
to the execution and recordation of an Affordable
Housing Agreement for payment of Collier County Impact
'ees between the property owner and/or purchaser and
\:he County.
