RESOLUTION OF THE BOARD OF COUNTY
COMMISSIONERS, COLLIER COUNTY, FLORIDA,
AUTHORIZING PAYMENT OF REGIONAL WATER SYSTEM
IMPACT FEES, REGIONAL SEWER SYSTEM IMPACT
FEES, LIBRARY SYSTEM IMPACT FEES, PARKS AND
RECREATIONAL FACILITIES IMPACT FEES, ROAD
IMPACT FEES, EMERGENCY MEDICAL SERVICES SYSTEM
IK9ACT FEES AND EDUCATIONAL FACILITIES SYSTEM
IMPACT FEES FOR ONE HOUSE TO BE CONSTRUCTED BY
IMMOKALEE HABITAT FOR HUMANITY, INC. on LOT 8,
BLOCK 5, NAPLES MANOR EXTENSION, NAPLES,

WHEREAS, Collier County has recognized and attempted to
address thE lack of adequate and affordable housing for moderate,
low, and v.!ry-low income households in the County and the need
for creati 'e and innovativ~ programs to assist in the provision
of such hCtusing by includ"ng several provis; ons in the Collier
County Grc~h Management; lan, including: otjective 1.4, policy
1.4.1; objactive 1.5, po11cy 1.5.2, policy] .5.3, policy 1.5.4,
policy 1.5.5, policy 1.5.6; objective 1.6, policy 1.6.3;
objective 2.1, policy 2.1.1, policy 2.1.2, policy 2.1.3, policy
2.1.5, and policy 2.1.6 ot the Housing Elemerti and
WHEREJ.S, Collier cour-:y has received fur.rJing pursuant to the
State Housing' Initiativt) partn..rship Pro'Jram set forth in
Section 420.907 et. seq. Florida Statutes and Chapter 91-37,
Florida Ad:Jinistrative COtLe; and
WHEREAS, in accordance with Collier County ordinance No.
93-19, the County is authorized to use fUr. :ling from the State
Housing Initiatives Partlership [SHIP] Pro:/ram for waivers of
Collier CO'Jnty impact feE 0; and
WHEREAS, Immokalee 'lbitat for Humanit., Inc. is seeking a
waiver of impact fees; anj
WHERFAS, Immokalee Habitat for Humanity. Inc. will construct
one (1) t'ree-bedroom unit (the "Dwelling UI;it") on Lot 8, Block
5, Naples Manor Extension, Naples, Florida which is proposed to
sell for Forty Six Thousand Five Hundred r'ollars ($46,500.00);

WHEREAS, the Dwelling Unit will be owned by a very low
income household, and
WHEREAS, Mr. Charles c. smith, Executive Vice President of
Immokalee Habitat for Humanity, 'Inc., submitted to the County
Manager's Office an Affordable Housing Application dated May 26,
1995 for a waiver of impact fees for the construction of a house
on Lot 8, Block 5, Naples Manor Extension, Naples, Florida, a
copy of s'-lid application is on file in the Housing and Urban
Improvement Department; and
WHERE'IS, in accordance with Section 3.04 of the Regional
Water Syst.em Impact Fee Ordinance, Ordinailce No. 90-86, as
amended; !.lction 3.04 of the Regional Sewer System Impact Fee
Ordinance, Ordinance No. ~ 0-87, as amended; ;ection 3.04 of the
Library Srstem Impact Fel. Ordinance, Ordin Ince No. 88-97, as
amended; Sl!ction 4.05 of the Parks and Rect' !ational Facilities
Impact FeEl Ordinance, Ordinance No. 88-96, "tS amended; Section
3.04 of the Road Impact Fee Ordinance, Ordinance No. 92-22, as
amended; Section 3.05 of the Emergency Medj ~:al Services System
Impact Fee Ordinance, 011inance No. 91-71. as amended; and
Section 3.05 of the EdU( ltional 'Facilities System Impact Fee
Ordinance, ordinance No. 92-33, as amended; an applicant may
obtain a w6iver of impact ~ees by qualifying for a waiver; and
WHEREAS, Immokalee Habitat for Humanity, Inc. has qualified
for an impact fee waiver based upon the follo'~ing representations
made by Immokalee Habitat .'or Humanity, Inc.:

C. The Dwelling Unit shall be the Homestead of the owner.
D. The Dwelling Unit shall rem~in atfordable for fifteen
(15) years from the date the certificate of occupancy
is issued.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER CoUNTY, FLORIDA, that:
1. 'rhe Board of County Commissioners hereby authorizes the
:ounty Manager to issue an Authorization for waiver ot
impact fees to Immokalee Habitat for Humanity, Inc. for
.)ne (1) house which shall be cOJ'\structed on Lot 8,
,lock 5, Naples Manor Extension, Naples, Collier
County, Florida.
2. 1pon receipt b' the Housing ant Urban Improvement
l)irector of an original purchase contract signed by
Lmmokalee Habit8t: for Humanity, Inc and the Purchaser,
or other documentation acceptable to the County
Attorney, the Board of County r'ommissioners hereby
authorizes the payment by Colll.er County of the
following impac1 fees from the Affo:~dable Housing Trust
