RESOLUTION OF THE BOARD OF COUNTY
COMMISSIONERS, COLLIER COUN'l'Y, FLORIDA,
AUTHORIZING PAYMENT OF REGIONAL WATER SYSTEM
IMPACT FEES, REGIONAL SEWER SYSTEM IMPACT
FEES, LIBRARY SYSTEM IMPACT FEES, PARKS AND
RECREATIONAL FACILITIES IMPACT FEES, ROAD
IMPACT FEES, EMERGENCY MEDICAL SERVICES SYSTEM
IMPACT FEES AND EDUCATIONAL FACILITIES SYSTEM
IMPACT FEES FOR ONE HOUSE TO BE CONSTRUCTED BY
IMMOKALEE HABITAT FOR HUMANITY, INC. ON LOT
10, BLOCK 2, NAPLES MANOR EXTENSION, NAPLES,

WHEREhS, CoIl ier County has recognized and attempted to
address th. lack ot adequate and affordable housing tor moderate,
low, and very-low income households in the <.:ounty and the need
tor creati 'e and innovati\9 programs to assiJt in the provision
ot such hC"using by includ i.ng several provis: ons in the Collier
County Gro,lth Management 1 lan, including: ob lective 1. 4, policy
1.4.1; obj~ctive 1.5, poljcy 1.5.2, policy 1 5.3, policy 1.5.4,
policy 1.5.5, policy 1.~.6; objective 1.6, policy 1.6.3;
objective 2.1, policy 2.1.1, pOlicy 2.1.2, policy 2.1.3, policy
2. 1.5, and pol icy 2. 1.6 ot the Housing Elemen ':; and
WHEREA:3, Collier Coun'y has received tun('ing pursuant to the
State Housing' Initiative:' Partnership PrOt" ram set forth in
Section 420.907 et. seQ., Florida Statutes and Chapter 91-37,
Florida Adm~nistrative Code: and
WHEREAS, in accordance with Collier Cc 'Jnty Ordinance No.
93-19, the County is authorized to use funC: Lng from the State
Housing Initiatives Partn.rship [SHIP] prog:am tor waivers ot
Collier Cou,',ty impact fees and
WHEREAS, Immokalee Ha litat tor Humanity, Inc. is seeking a
waiver ()f impact fees; and
WHEREAr., Immokalee Habitat for Humanity, [nc. will construct
one (1) thr e-bedroom unit (the "Dwelling Unit~) on Lot 10, Block
2, Naples Manor Extension, Naples, Florida which is proposed to
sell for Forty Six Thousand Five Hundred Do~ lars ($46,500.00);

WHEREAS, the Dwelling Unit will be owned by a very low
income household, and
WHEREAS, Mr. Charles C. Smith, Executive Vice President of
I1II1Ilokalee Habitat for Humanity, Inc., submitted to the County
Manager's Oft ice an Affordable Housing Application dated May 26,
1995 for a waiver of impact fees for the construction of a house
on Lot 10, Block 2, Naples Manor Extension, Naples, Florida, a
copy ot s.lid application is on file in the Housing and Urban
Improvement Department; and
WHERl'S, in accordance with Section J. 04 of the Regional
Water Sys':em Impact Fee Ordinance, Ordinance No. 90-86, as
amended; . ection 3.04 of the Regional Sewer System Impact Fee
Ordinance, Ordinance No. 0-87, as amended; Section 3.04 of the
Library S ,'stem Impact Fe) Ordinance, Ordir mce No. 88-97, as
amended; [iection 4.05 ot the Parks and Rec:' eational Facilities
Impact Fe. Ordinance, Ordinance No. 88-96, !s amended; Section
3.04 ot the Road Impact Fee Ordinance, Ordinance No. 92-22, as
amended; Section 3.05 of the Emergency Med" cal Services System
Impact Fee Ordinance, O'dinance No. 91-7) , as amended; and
Section 3.05 of the Edu 'ational . Facilitiel. System Impact Fee
Ordinance, Ordinance No. 92-33, as amended; an applicant may
obtain a w~' iver of impact tees by qualifying for a waiver; and,
WHEREAS, Immokalee Habitat for Humanity Inc. has qualified
for an impact fee waiver based upon the foIl,. ling representations
made by Immokalee Habitat for Humanity, Inc.:

buyer.
B. The Dwelling Unit shall be owned by a household with a

the affordable housing. guidelines established in the

C. The Dwelling Unit shall be the Homestead of the owner.
D. The Dwelling Unit shall remain affordable for fifteen
(15) years from the date the certificate of occupancy
is issued.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that:
1. The Board of County Commissioners hereby authorizes the
:ounty Manager to issue an Authori~ation for waiver of
impact tees to Immokalee Habitat for Humanity, Inc. tor
one (1) house which shall be constructed on Lot 10,
Block 2, Naples Manor Extension, Naples, Collier
County, Florida.
2. Upon receipt tr the Housing anc Urban Improvement
Director of an original purchase contract signed by
Immokalee Habitrt for Humanity, In<. and the Purchaser,
or other doculr.entation acceptable to the County
Attorney, the Board of County Commissioners hereby
authorizes the payment by Coll'~er County of the
following impac fees from the Atftrdable Housing Trust
Fund,' Fund (191 , in the' followinC} amounts for the one
:1) house to be built on Lot 10, Block 2, Naples Manor
~xtension, Naples, Florida by Immokalee Habitat for
Humanity, Inc.

Housing Agreement for payment of Collier County Impact
