RESOLUTION OF THE BOARD OF COUNTY
COMMISSIONERS, COLLIER COUNTY, FLORIDA,
At11'HORIZING PAYMENT OP,REGIONAL WATER SYSTEM
IMPACT FEES, REGIONAL SEWER SYSTEM IMPACT
FEES, LIBRARY SYSTEM IMPACT FEES, PARJeS AND

WHEREAS, Collier County has recognized and attempted to
address thf lack of adequate and affordable housing for moderate,
low, and v,!ry-low income households in the (,ounty and the need
for creati e and innovativ! programs to assi:-.t in the provision
of such housing by includ ,ng several provisj ons in the Collier
County Gro~h Management I lan, including: ob'ective 1.4, policy
1.4.1; obj~ctive 1.5, pollzy 1.5.2, policy 1 5.3, policy 1.5.4,
policy 1.5.5, policy 1.5.6; objective 1,6, policy 1.6.3;
objective 2.1, policy 2.1.1, policy 2.1.2, policy 2.1.3, policy
2.1.5, and policy 2.1.6 of the Housing Elemen',; and
WHEREAB, Collier Coun~ y has received func(ing pursuant to the
State Housing Initiative:' Partnership PrOl,' ['am set forth in
Section 420.907 et. seg., Florida Statutes .and Chapter 91-37,
Florida Adm.nistrative Cod~;' and
WHEREAS, in accordance with Collier C('lunty Ordinance No.
93-19, the County is authorized to use tum: 1ng from the State
Housing Initiatives Partnorship [SHIP) Prog'''am tor waivers ot
Collier Cou'.ty impact tees and
WHEREAS, Immokalee He ,itat tor Humanity, Inc. is seeking a
waiver of impact tees; and
WHEREA~, Immokalee Habitat tor Humanity, Inc. will construct
one (1) thr!e-bedroom unit (the "Dwelling Uni';") on Lot 9, Block
2, Naples ~anor Extension, Naples, Florida which is proposed to
sell for Forty Six Thousand Five Hundred DO,.lara ($46,500.00);

WHEREAS, the Dwelling' Unit wi Ll be owned by a very low 1
income household, and
WHEREAS, Mr. Charle. C. Smith, Executive Vice President of
Immokalee Habitat tor Humanity, Inc., submitted to the County
Manager's Office an Affordable Housing Application dated May 26,
1995 for a waiver of impact fees for the construction of a house
on Lot 9, Block 2, Naples Manor Extension, Naples, Florida, a
copy of s'lid application is on tile in thE~ Housing and Urban
Improvemenc Department; and
WHERE\S, in accordance with Section 3.04 of the Regional
Water Sys';em Impact Fee Ordinance, Ordinance No. 90-86, as
amended; : ection 3.04 of the Regional Sewer System Impact Fee
Ordinance, Ordinance No. '0-87, as amended; Section 3.04 of the
Library S, stem Impact Fe.J Ordinance, Ordin mce No. 88-97, as
amended; r.ection 4.05 of the Parks and Rec}' eational Facilities
Impact Fe\! Ordinance, OrcHnance No. 88-96,lS amended; Section
3.04 of tho Road Impact Fee Ordinance, Ordinance No. 92-22, as
amended; Section 3.05 of the Emergency Med; .:al Services System
Impact Fee ordinance, ~dinance No. 91-71, as amended; and
Section 3.05 ot the Edu, ational Facilitiel, System Impact Fee
Ordinance, Ordinance No. 92-33, as amendeQj an applicant may
obtain a w~iver of impact iees by qualifying tor a waiver; and
WHEREAS, Immokalee Habitat for Humanity Inc. has qualified
tor an impact fee waiver based upon the folloAing representations
made by Immokalee Habitat eor Humanity, Inc.:
A. 'I ae Dwelling Un t shall be owned I ,{ a first-time home
buyer.
B. The Dwelling Unit shall be owned by a household with a
very low income level as that ten,! is detined in the
], ~pendices to tb9 respective Impact Fee Ordinances and
the monthly paynwnt to purchase the unit must be within
the affordable l10using guidelines established in the
A..Jpendices to thu respective Impact Fee Ordinances.

C. The owelling Unit'shall be the Homestead of the owner.
D. The OWelling Unit shall remain affordable for fifteen
(15) years from the date the certificate of occupancy
is issued.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that:
1. The Board of County Commissioners hereby authorizes the
County Manager to issue an Authoriz;)tion for waiver of
impact fees to Immokalee Habitat for Humanity, Inc. for
c ne (1) house which shall be constructed on Lot 9,
flock 2, Naples Manor Extension, Naples, Collier
I ounty, Florida.
2. TJpon receipt b} the Housing and Urban Improvement
\ irector of an >riginal purchase :ontract signed by
~mmokalee Habitat for Humanity, Inc. and the Purchaser,
or other docuJl',':!ntation acceptab19 to the County
Attorney, the Board of County Commissioners hereby
authorizes the payment by Collj~r County of the
following impact tees tram the Aftordable Housing Trust
Fund, Fund (191) in the following lmounts for the one
(1) house to be )uilt on Lot 9, Block 2, Naples Manor

Humanity, Inc.
