Addendum #2 _I PROPERTY ADDRESS: 2540 50th Avenue NE, Naples, FL 34120 ADDENDUM THIS ADDENDUM Is entered Into this ~ day of~1 '-1 . 2009, by and between DEUTSCHE BANK NATIONAL TRUST COMPANY, AS TRUSTEE FOR DOS 2006-HE 1, Seller, and COLUER COUNTY, a Political Subdivision of the State of Florida, Purchaser. Purchaser and Seller entered Into that certain "As Is" Contract for Sale and Purchase, and Counterproposal to Real Estate PurchaSe Contract attached thereto, dated April 27, 2009 (the "Agreement''). Subsequent to entering Into the Agreement and pursuant to provisions of the Agreement, Purchaser and Seller wish to amend the Agreement with the following terms and conditions: 1. Paragraph VI and the revised dosing date on the Counterproposal are changed to reflect that the closing date shall be on or before July 9, 2009. 2. Paragraph IT and the Counterproposal are changed to remove any requirement for pay $1,000 Earnest Money. The full purchase price of $69,900 will be paid at closing. 3. Paragraph 12 of the Counterproposal Is changed to remove any requirement for payment of per diem penalties, and Seller waives same. 4. Paragraph I Is revised to correct the legal descrlptlon to read "The East 75 feet of the East 150 feet of Tract 33, GOLDEN GATE ESTATES UNIT NO. 44, according to the map or plat thereof, as recorded In Plat Book 7, Page 29, of the Public Rec;ords of Collier County, Florida. ' Except as expressly provided herein, the Agreement between the Purchaser and the Seller remains In full force and effect according to the terms and condItions contained therein, and said terms and condItions are applicable hereto except as expressly provIded otherwise herein.
