AUTHORIZING PAYMENT OF LIBRARY SYSTEM IMPACT
FEES, PARKS AND RECREATIONAL FACILITIES IMPACT
FEES, ROAL' IMPACT FEES, EMERGENCY MEDICAL
SERVICES SYSTEM IMPACT FEES AND EDUCATIONAL

WHEREAS, Collier County has rl ceived funding pursuant to the
Housing Initiatives Partnership Program set forth in
'.;ection 420.907 et. sea., Florida Statutes and Cha,'lter 91-37,
I'lorida Administrative Code; and
WHEREAS, in al~cordance with Collier County Or inance No.
9~-19, the County is authorized) use funding fro. the State
Initiatives Partnership l lHIP] Program for waivers of

WHEREAS, Shelclon G. Powell and Elizabeth L. Powell are
seeking a waiver of impact fees; alld

System Impact Fee Ordinance, Ordinance No. 88-97, 3S amended;

Ordinance, Ordinance No. 88-96, a~ amended; Section 3.04 of the
Road Impact Fee )rdinance, Ordi.,ance No. 92-22, IS amended;

No. 92-33, as amended; an applicant may obtain a waiv"r of impact
fees by qualifying for a waiver; a.d
WHEREAS, Sheldon G. Powell lOd Elizabeth L. Powell have
qualified for an impact fee wai ',er based upon th8 following
representations made by Sheldon G. Powell and Elizabeth L.
Powell:
A. The Dwelling Unit shall be owned by a fir,-t-time home
buyer.
B. The Dwell:ng Unit shall Je owned by a hous.hold with a
very low income level ,'; that term is del \ned in the
Appendices to the respeccive Impact Fee Ordinances and
the monthly payment to purchase the unit must be within
the affo:'dable housing guidli;lines establhhed in the
Appendice; to the respective Impact Fee Ordinances.
c. The Dwelling Unit shall be the Homestead of the owner.
D. The Dwell ing Unit shall remain affordable for fifteen
(15) years from th~ date the certificatel:f occupancy
is issued.
WHEREAS, Shelton G. Powell and Elizabeth L. Powell have
:-equested that the County suborcitnate its rights, interest and
lien to Owner's pr nary lendeh .

WHEREAS, Owner has provided sufficient documentation that it
requires a subordination of the County's impact fees to Owner's
.primary lender.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that:
1. The Board of County Commissioners hereby authorizes the
County Manager to issue an Authorization for waiver of
impact fees to SheldoTl G. Powell and J.lizabeth L.
Powell ~.'or one (1) hous0. which shall be cc.,structed on
Lot 26, Block 252, Gold€n Gate, Unit 7, Naf'les, Collier
County, Florida.
2. Upon receipt by the Housing and Urban Development
Director of an agreement for waiver signe.' by Sheldon
G. Powell and Elizabeth L. Powell, or other
documentation acceptable, to the County At.torney, the
Board of County Commi ;;!oners hereby au ::-.horizes the
payment hy Collier Coun y of the following impact fees
from the Affordable Housing Trust Fund, Fund (191), in
the following amounts for the one (1) hOUSe' to be built
on Lot 26, Block 252, Golden Gate, Unit 7, Naples,
Florida by Sheldon G. P ,.ell and Elizabeth ~. Powell:
