Addendum to As Is Contract Exhibit" A" Addendum to "As Is" Contract for Sale and Purchase (the "Contract") Seller: Suncoast Schools Federal Credit Union Buyer: Property: 4141 47TH Ave NE Naples FI 34120 Notwithstanding the terms and conditions of the Contract (as referenced above), Seller and Purchaser further agree as follows: 1. Warranties. Supplementing the terms of the Contract it is agreed that the Property is being purchased "As Is", "Where Is", without any warranties whatsoever, express or implied, oral or written, including but not limited to any warranty of merchantability or fitness for purpose of/or use. 2. Buver/Seller Acknowledament and Aareement. Buyer and Seller acknowledge that the Property was acquired by Seller through judicial foreclosure action or Deed in Lieu of Foreclosure. Seller was not an owner-occupant and Seller's information concerning the Property and the condition of the Property is extremely limited. Buyer is hereby informed by Seller that Seller is unaware of any defects (latent or otherwise) in or about the Property or any appurtenant systems related thereto, including but not limited to plumbing, heating, air conditioning, electrical fixtures, appliances, roof, sewers, septic, soil conditions, foundation, structural integrity, environmental condition, swimming pool, hot tub or related equipment thereto. Further, Seller makes no warranties or representations as to any of the above, which would include, but not be limited to, the condition of the Property, the Property's systems, the serviceability or fitness for any particular use of the Property, or any component of the Property. By execution hereof, Buyer acknowledges and agrees that in executing the Contract, Buyer has not relied to the Buyer's detriment upon any warranty, representation or otherwise made by Seller, any parent, subsidiary, affiliate, assign or successor thereof or any of Seller's officers, directors, employees, agents or representatives. 3. Conflict. In the event of a conflict between the terms and conditions of this Addendum and the terms and conditions of the Contract, the terms and conditions of this Addendum shall control. 4. Radon. Is a naturally occurring radioactive gas that when accumulated in a building in sufficient quantities may present health risks to persons who are exposed to it over time. Levels of radon that exceed federal and state guidelines have been found in buildings in Florida. Additional information regarding radon or radon testing may be obtained from your County Public Health unit. 5. Broker Sales Commissions. Paragraph 6 of Purchase Agreement is not applicable as there are no Brokers participating in this transaction.
