RESOLUTION FOR PETITION AV 92-020 TO VACATE A
60 FOOT ROAD RIGHT-OF-WAY (ROMANO TERRACE),
LOCATED ON A PORTION OF THE PLAT OF MARCO BEACH
UNIT 3 AS RECORDED IN PLAT BOOK 6, PAGES 17-24,
INCLUSIVE OF THE PUBLIC RECORDS OF COLLIER
COUNTY, FLORIDA.
WHEREAS, pursuant to sections 336.09 and 366.10 Florida
Statutes, Thomas Kalbfus as agent for owner, United Church of
Marco Island, Inc., (hereinafter referred to as "Church") does
hereby request the vacation of 60 foot road right-Of-way
--..
(Romano Terrace) located on a portion of the plat of Marco
Beach Unit 3 as recorded in Plat Book 6, Pages 17-24,
inclusive, of the Public Records of Collier County, Florida;
and
WHEREAS, the Board has this day held ~ public hearing to
consider vacating a portion of said pl;t as more fully
described below, and notice of said public hearing to vacate
was given as required by law; and
WHEREAS, the Church has agreed to deed restrict the five
lots owned by the Church which do not constitute the Church
facilities from future use as parking facilities for the
Church. These lots are more particularly described as Lot 1,
Block 79, Unit 3; Lot 2, Block 79, Unit 3; Lot 1, Block 80,
Unit 3; Lot 19, Block 81, Unit 3; and Lot 18, Block 81, Unit 3
all as recorded in Plat Book 6, Pages 17-24; and
WHEREAS, the recording of the above referenced deed
restriction is a condition precedent to the vacation of Romano
Terrace; and
WHEREAS, the Board o~ County Commissioners of Collier
County, Florida, hereby finds that the vacation of Romano
Terrace is for the benefit of the general public in that the
County will no longer be required to maintain that roadway; and
WHEREAS, the vacation of Romano Terrace is in the best
interests of Collier County.
NOW THEREFOR~, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, fLORIDA, that the following be
and is hereby vacated:
See Exhibit "A" attached to and incorporated herein

BE IT FURTHER RESOLVED, that the Clerk is hereby directed
to record this Resolution in the Public Records of Collier

TIIIS AGREEMENT, made this (5TH day of Mt:>.y , 1993 between the BOARD
OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, AS TilE
GOVERNING BODY OF COLLIER COUNTY AND EX-OFFICIO THE GOVERNING
BOARD OF MARCO WATER AND SEWER DISTRICT (hereinafter referred to as "County")
and UNITED CHURCH OF MARCO ISLAND, INC. (hereinafter referred to as "Church"),
.
WHEREAS, County is the holder of certain easements as described in that certain Utility
Easement between BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY,
FLORIDA AS TIlE GOVERNING BOARD OF COLLIER COUNTY AND AS EX-OFFICIO
TIIE GOVERNING BOARD OF TIlE MARCO WATER AND SEWER DISTRICT, and
Church, its predecessors or assigns, dated , as recorded in the Official
Records of Collier County Florida in Book , Page (hereinafter referred to as the
-Easement"), and;
WHEREAS, Church is the owner of a tract of land described as the vacated street of Romano
Terrace, Marco Island, Florida, which tract is encumbered by the Easement; and
WHEREAS, Church desires to construct, install, maintain and utilize certain facilities within and
on a portion of County's easement as described in said Agreeme,nt; and

WHEREAS, Collier County is willing to consent thereto subject to the following terms,
stipulations and conditions;
I. Notwithstanding any of the provisions of the Easement which prohibits such
construction and installation and subject to the terms, stipulations and conditions
stated herein, consent is hereby given by County to Church to install, maintain
and utilize paving across the surface of County's easement; and allow landscaping
within the easement.
2. Church hereby accepts this "Consent to Use Easement Area" with full knowledge
of County's prior rights and existing facilities, This consent shall not be
construed to reduce or diminish County's prior rights in any way,
3, All of Church's facilities located within County's casement shall be so
constructed, utilized and maintained as to not, in any way, prevent the safe and
uninterrupted operation of and access to and across the casement and facilities of
County.
4, County will have the right to remove that part of said landscaping, curbing,
parking area and asphalt paving as may be reasonably necessary for the purpose
of constructing, maintaining, repairing, altering, replacing, and for removal of
said utility facilities as determined by County,

corporation, hereinafter referred to as "Declarant".
WIT N E SSE T H:
WHEREAS, Declarant is the owner of certain real property
(the "Property") located in Collier County, Florida, which is
.ore particularly described in Exhibit "A", attached hereto and ~

WHEREAS, Declarant has determined that it is necessary to
place land use restrictions on the Property to preserve the
property value of the owners.

NOW, THEREFORE, Declarant hereby decla~es that the Property
is and shall be held, transferred, sold, conveyed, used and
occupied in accordance with and subject to the fOllowing
restriction, covenant and condition which shall run with the
title to the Property and be binding on all parties having any
right, title or interest in the Property or any part thereof,
their heirs, successors and assigns:
No parking lots or areas, whether permanent or
temporary, shall be used, designated, constructed,
cleared or marked on the Property except as
permitted for a single family residence or zoning,
unless approved by Declarant and Collier County.
This restrictive covenant shall run in favor of the
Declarant or Collier County, or any successor to either of them.
