Ladies and Gentlemen:
I am very pleased to welcome you to this joint meeting of the Marco Island City Council and the
Collier County Board of Commissioners, and appreciate your engagement, your participation, and
your commitment to constantly improving our Island community and all of Collier County.
I believe that our combined hope is that we can continue to discuss, debate, and resolve issues facing
our communities, and reach mutually acceptable resolution to the challenges that we face in our roles
as legislators and governors.
In the attached binder you will find a series of presentations, focusing primarily on the services
shared or provided by the City and the County on Marco Island. Most of this is good news - we
have a number of very good things going on in this community as we continue to improve the quality
and level of service for our residents. At the same time, there are always concerns that the residents
and businesses of Marco Island should receive a fair return on tax dollars with the appropriate level
of service as dictated by need and availability, ifnot a dollar for dollar return on these taxes.
Our staffs have coordinated these discussions, and I hope that the facts and information presented
will lead to substantive discussion on the policy issues that we face. I am looking forward to this
discussion, and look forward to many such discussions in the upcoming years.
Thank you again for your efforts to constantly improve services on Marco Island and in Collier
County, and [look forward to seeing you on December 4th.

Services (EMS)
64J-l.004 Medical Direction.
(I) Each ALS, BLS or air ambulance provider shall maintain on file for inspection and copying by the
department its current contract for a medical director by which it employs or independently contracts with a
physician qualified pursuant to this section to be its medical director.
(2) There is no standard format for a medical director's contract, however, in drafting such an instrument, the
following provisions may be addressed:
(a) Name and relationship of the contracting parties.
(b) A list of contracted services inclusive of medical direction, administrative responsibilities, professional
membership, basic and advanced life support review responsibilities, and reporting requirements.
(c) Monetary consideration inclusive of fees, expenses, reimbursement, fringe benefits, clerical assistance and
office space.
(d) Termination clause.
( e) Renewal clause.
(I) Provision for liability coverage.
(g) Effective dates of the contract.
(3) Qualifications:
(a) A medical director shall be a Florida licensed M.D. or D.O.
(b) In addition to all other provisions applicable to medical directors in this rule, an air ambulance medical
director shall be knowledgeable of the aeromedical requirements of patients and shall evaluate each patient in person
or by written protocol prior to each interfacility transfer flight for the purpose of determining that the aircraft, flight
and medical crew, and equipment meet the patient's needs.
(c) A medical director shall be board certified and active in a broad-based clinical medical specialty with
demonstrated experience in prehospital care and hold an ACLS certificate or equivalent as determined in Chapter
64J-l.022, F.A.C. Prehospital care experience shall be documented by the provider.
(d) A medical director shall demonstrate and have available for review by the department documentation of
active participation in a regional or statewide physician group involved in prehospital care.
(4) Duties and Responsibilities of the Medical Director.
(a) Develop medically correct standing orders or protocols which permit specified ALS and BLS procedures
when communication cannot be established with a supervising physician or when any delay in patient care would
potentially threaten the life or health of the patient. The medical director shall issue standing orders and protocols to
the provider to ensure that the provider transports each of its patients to facilities that offer a type and level of care
appropriate to the patient's medical condition if available within the service region. The medical director or his
appointee shall provide continuous 24-hour-per-day, 7-day-per-week medical direction which shall include in
addition to the development of protocols and standing orders, direction to personnel of the provider as to availability
of medical direction "off-line" service to resolve problems, system conflicts, and provide services in an emergency
as that term is defined by Section 252.34(3), F.S.
(b) Develop and implement a patient care quality assurance system to assess the medical performance of
paramedics and EMTs. The medical director sha1l audit the performance of system personnel by use of a quality
assurance program to include but not be limited to a prompt review of patient care records, direct observation, and
comparison of performance standards for drugs, equipment, system protocols and procedures. The medical director
sha1l be responsible for participating in quality assurance programs developed by the department.
(c) With the exception of BLS medical directors each ALS or air ambulance service medical director sha1l
possess proof of current registration as a medical director, either individua1ly or through a hospital, with the U.S.
Department of Justice, DEA, to provide contr01led substances to an EMS provider. DEA registration shall include
each address at which controlled substances are stored. Proof of such registration sha1l be maintained on file with
each ALS or air ambulance provider and sha1l be readily available for inspection.
(d) Ensure and certity that security procedures of the EMS provider for medications, fluids and contr01led
substances are in compliance with Chapters 499 and 893, F.S., and Chapter 64F-12, F.A.C.
(e) Create, authorize and ensure adherence to, detailed written operating procedures regarding a1l aspects of the
handling of medications, fluids and controlled substances by the provider.
(I) Notity the department in writing of each substitution by the EMS provider of equipment or medication.
(g) Assume direct responsibility for: the use by an EMT of an automatic or semi-automatic defibri1lator; the
performance of airway patency techniques including airway adjuncts, not to include endotracheal intubation, by an
EMT; and on routine interfacility transports, the monitoring and maintenance of non-medicated LV.s by an EMT.
The medical director shall ensure that the EMT is trained to perform these procedures; shall establish written
protocols for the performance of these procedures; and shall provide written evidence to the department
documenting compliance with provisions of this paragraph.
(h) An EMT employed by a licensed ALS provider is authorized to start a non-medicated IV under the
following conditions:
I. A non-medicated IV is initiated only in accordance with department approved protocols of the licensed ALS
provider's medical director. These protocols must include a requirement that the non-medicated IV be initiated in
the presence of a Florida certified paramedic (of the same licensed provider) who directs the EMT to initiate the IV.
2. If the licensed ALS provider elects to utilize EMTs in this capacity, the licensed EMS provider shall ensure
that the medical director provides training at least equivalent to that required by the 1999 U.S. D.O.T. EMT-
Intermediate National Standard Curriculum relating to IV therapy which is incorporated by reference and available
from the Superintendent of Documents, Post Office Box 371954, Pittsburg, PA 15250-7954. The licensed EMS
provider shall document successful completion of such training in each EMTs training file and make documentation
available to the department upon request.
(i) Ensure that all EMTs and paramedics are trained in the use of the trauma scorecard methodologies as
provided in Rule 64J-2.004, F.A.C., for adult trauma patients and Rule 64J-2.005, F.A.C., for pediatric trauma
patients.
(j) Develop and revise when necessary TTPs for submission to the department for approval.
(k) Participate in direct contact time with EMS field level providers for a minimum of 10 hours per year.
Notwithstanding the number of EMS providers served by the medical director, direct contact time shall be a
minimum of 10 hours per year per medical director, not per provider.
(I) Ifhe is a medical director of a training program:
1. Be responsible for the instruction of the Department of Transportation (DOT) approved training program for
EMTs and paramedics.
2. Have substantial knowledge of the qualifications, training, protocols, and quality assurance programs for the
training facility.
3. Maintain current instructor level training in Advanced Cardiac Life Support (ACLS), or equivalent, or
Advanced Trauma Life Support (A TLS), maintain provider level training in International Trauma Life Support
(ITLS) or Prehospital Trauma Life Support (PHTLS); and Advanced Pediatric Life Support (APLS), Pediatric
Advanced Life Support (PALS) or Pediatric Education for Prehospital Professionals (PEPP).
4. Act as a liaison between training centers, local EMS providers and hospitals.
5. Participate in state and local quality assurance and data collections programs.
6. The EMS training center shall by contract, require such medical director to be available 4 hours per month
for classroom teaching or review of student performance, and participate in direct contact time with EMS field level
providers for a minimum of 10 hours per year. Notwithstanding the number of training centers or EMS providers
served by the medical director, direct contact time shall be a minimum of 10 hours per year per medical director, not
per training center.
7. Participate in the recruitment, selection, and orientation of instructors and preceptors.
8. Participate in student selection, mid-term evaluation and final practical examination of students.
(5) The medical director of a licensed EMS provider may authorize paramedics under his or her supervision to
perform immunizations pursuant to a written agreement with a County Health Department in the county in which the
immunizations are to be performed. Should the medical director elect to utilize paramedics in this capacity, he or she
shall verify on DH Form 1256, Certification of Training, July 98, which is incorporated by reference and available
from the department, that each paramedic authorized to administer immunizations has completed training consistent
with that of other staff giving immunizations in the County Health Department as required by the Director of that
County Health Department.

The objeetive of this plan is to develop a Pilot Program Inteoded to evaluate a modified
supervisory span-of-eontrol and IeSpODSe plan to maximize the utilization of all pro-hospital
BLSI ALS resources, provide cosl effeetivene&8, and improve operational eflk:lencies. This
Operational Plan is delJisned to improve the availability of n:SO\II\:CS during concurrent incidents,
maximize command oversight, and to maintain readiness and availability of the transport unit for
incldenls involving pstienta ofhigh-aculty. The Pilot Program will commence Octobet27, 200B
through Man:h 27, 2009 for cwaluation purposes.
Procedure
Marco Island Fire Rescue and Collier County EMS units 81ationed al Slation 50/51 willl\l8pond
10 medical emergencies utilizing the following procedure:
1. An ALS Engine will be fU'81 OUI for all incidents of medical emergeney. On arrival the
cn:w will initiate palient assessment Ilteatmenl and detennlne the transportation need. If
the palient requests tranaport by CCEMS, the Company Officer will make the request to
ControL If consenl is implied the Company Officer will notifY Control to dispatch
CCEMS for lransport The on-scene Company Officer will also detenniml the CCEMS
unit mode ofzesponsll (respond or enroute)

3. In si1uations of concurrent calls nol meeting exception #2. the ALS Engine n:sponds to
the IllSt incident, MR 50 ~ds to the second incident if staffed al 3 pelSOllJlel,
leaving an ALS Engine available tor fire and medical emergencies.
4. The Marco Island Fire Rescue BatlB/ion Chief in cooperation with Battalion Chief 80
will maintain direct supervisory oversight of all BLSI ALS resources and baa the latilude
10 send Marco Island n:sources to in-dlstrIcllncidenls based on additional Information
received. Oul-of-district IeSpOnsesloperations witl be coordinated through Battalion
Chief 80.
5. Both agencies aaree to hold bi-weekly reviewa between Command staffinclllSive of
Battalion 50 and Ba<<alion BO. Reviews will inclnde QAlQI review witb tbe Fire Rescue /
EMS crews.

WHEREAS. Collier County desires to facilitate the provision of such services and has the
necessary equipment, training. expertise. professional certifications and licenses to do so; and
WHEREAS. the amendment to Ordinance Number 04-12 results in a benefit to Collier
County by reducing response times for ccrt<lin transporls and providing for the availability of

purpose of this ordinance is to provide better protection for the health, safety and <<rglare of the
residents ofeollier County, in ambulance and ALS matters, by establishing unifonn county-wide
standards for certification of ambulance or advanced life support or services, or operations by
promulgating complete and clear rules and regulations tor operation of all ambulance or rescue
companies Of services in Collicr County.
Section 2: Definitions
A. Advanced Life Support (ALS) shall mean procedures conducted as defined in applicable
Florida Statutes and Florida Administrative Code, Section 64E.
B. Administrator shall mean the County Manager or his designee.
C. Ambulance means any privately or publicly owned land, air, or water vehicle that is
designed, constructed, reconstructed. maintained, equipped or operated, and is used tor or
intended to be used for air, land, or water transportation of persons, who are sick, injured,
or otherwise helpless.
D. Board shall mean the Collier County Board of County Commissioners.
E. Certificate means a certificate of convenience and necessity as authorized in Section
401.25 (2)(d), Florida Statutes.
F. Emergency Call shall mean the transit of an ambulance under conditions which warrants
travel with flashing lights and siren operating.
G. Operator shall mean any person, organization or governmental entity providing
amhulant:c or A LS services.
H. Patient shall mean .1Il individual who is ill, sick, injured, wounded, or otherwise
incapacitatcd or helpless.
\. Routine Call or Routine Transfer shall mean the transportation of a patient under nOI1-
emergency call conditions.
J. Rescue Service shall mean first response treatment of patients but does 110t include
Advanced Life Support (ALS) or transport.
Section 3: Requirements For Certificate
It shall be unlawful for any person, firm, agency, or any other entity, including
governmental units, to provide an ambulance service or provide advanced life support without
tirst obtaining a certiticale therefore from the Board of County Commissioners of Collier
County.
Section 4: Exemptions and Exclusions Prom Certitlcate Requirement
Certificates shall not be required for:
A. Rescue Services.
B. The use of a non.ambulance for any transport of a patient pursuant to the Good Samaritan
Act, Section 768.13, Florida Statues.
C. Vehicles rendering ambulance.type services when requested to do so by the Board of
County Commissioners or County Manager in the event of a major catastrophe or other
such emergency which requires more ambulances that are available in the county.
D. Ambulances based outside the county which pick up a patient in the county and transport
him out of the county, or which pick up a patient out of the county and transport him into
the county.
E. Vehicles used to transport persons for routine scheduled medical treatments. Vehicles
transporting persons who require services en route 8r .vhe rollSt he aRed 8ft a atrets'her
are not covered by this exemption.
SectloR 5: Procedure For Obtaining Certlneate
An applicant for a certificate shall obtain forms from the department to be completed and
returned to the Division Administrator. Each application shall contain:
A. The name, age. and address of the owner of the ambulance or ALS provider, or if the
owner is a corporation, then of the directors of the corporation and of all the stockholders

J. Financial data including assets and liabilities of the operator. A schedule of all debts
encumbering any equipment shall be included.
Section 6: Review of Application
The Administrator shall review each application and shall investigate the applicant's
reputation, competence, financial responsibility, and any other relevant factors. The
Administrator shall also make an investigation as to the public necessity for an ambulance or
ALS operation in the territory requested, and shall then make a report to the Board containing his
recommendation whether to grant a certificate to the applicant within sixty (60) days of the time
the Administrator determines the application is complete.
Section 7: Requirement For Board Approval In Granting Certificate
The Board of County Commissioners shall not grant a certificate unless it shall find. after
public hearing and based on competent evidence that each of the following standards has been
satisfied:
A. That there is a public necessity for the service. In making such determination, the Board
of County Commission shall consider, as a minimum, the following factors:
(l) The extent to which the proposed service is needed to improve the overall
Emergency Medical Services (EMS) capabilities of the County.
(2) The effect of the proposed service on existing services with respect to quality of
service and cost of service.

(3) The effect of the proposed service on the overall cost of EMS service in the
County.
(4) The effect of the proposed service on existing hospitals and other health care
facilities.
(5) The effect of the proposed service on personnel of existing services and the
availability of surticient qualified personnel in the local area to adequately staff
all existing services.
B. That the applicant has sufticient knowledge and experience to properly operate the
proposed service.
C. That, if applicable, there is an adequate revenue base for the proposed service.
D. That the proposed service will have suft1cicnt personnel and equipment to adequately
cover the proposed service area.
Section 8: Appointment of Hearing Offlccr
In making the determinations provided for in Section 7 above, the Board may, in its sole
discretion, appoint a Hearing Officer to hold a public hearing and to make factual findings and
conclusions as a result of the hearing. Should a Hearing Ofticer be appointed. said Hearing
Officer shall render a written report to the Board within 30 days of the hearing, which report
shall contain the officer's findings and conclusions of fact, and a recommended order. The
findings and conclusions of fact shall be binding upon the Board. but the recommended order
shall be advisory only.
Section 9: Rights and Duties Granted By Certificate
The certificate grantcd by lhe Board shall be valid for one calendar year and 'shall be
personal to the applicant and not transferable. In the case of a corporation, if there occurs such a
transfer of stock or other incidents of ownership as to change the majority or largest stockholder,
a new certificate must be applied for. Changes in the officers of the corporation will not require
a new certificate.
Acceptance ofthe certificate by the applicant shall obligate the applicant to:
A. Service the entire zone granted to the applicant.
B. Provide coverage to adjoining zones, when requested to do so by Emergency Control for
emergency calls when the certificate holder for that zone is unable to respond.
C. Keep posted at his place of business a copy of the fee schedule, which must be filed with
the Administrator (Ifapplicable).

D. Operate in accordance with the rules and regulations adopted pursuant to this Ordinance
and any applicable County Ordinances, and Chapter 401 Florida Statutes, and any
administrative regulatiul1s adopted pursuulll thereto.
E. Employ at all times sufficient personnel experienced in operation and management of
emergency medical services to ensure proper and efficient operation.
Section 10: Renewal of Certificate
Each certiticate holder shall tile within ninety (90) days of expiration, an application for
renewal of his certiticate. Renewals shall be based upon the same standards. as the granting or
the original certificate along with such other factors as may be relevant. The renewal application
shall be accompanied by a two hundred and fifty dollar ($250.00) renewal fee.
The renewal certificate may be approved routinely by the Board, upon advice of the
Administrator, or the Board may hold a hcaring on samc.
Section 1 t: Emergency Provisions
The Board may modify, suspend or revoke a certificate in the interest of the public
health, safety and welfare, only at public hearing and after reasonable notice has been given to
the certiticate holder affected. However, if a situation exists which poses a serious lhrcat that
ambulance or rescue service will not be available to any certain area of Collier County, the
Administrator shall have such temporary emergency powers as are necessary to provide that
service. These temporary powers are intended to provide interim protection until such time as
the Board meets to resolve the emergency.
Section 12: Classifications of Certificates
There shall be two (2) classifications of service in Collier County, as follows:
A. Class 1: Collier County EMS:
ALS Rescue: An EMS provider with the capability of rendering on the scene
prehospital ALS services and who mayor may not elect to transport patients. An
EMS provider rendering this level of service for a governmental entity shall be.
deemed to be operating under the Class I . ALS rescue certificate of public
convenience and necessity held by the governmental entity. An EMS provider
holding a Class 1 - ALS rescue certificate may provide post-hospital interfacility
medical transfer services and routine ALS and BLS calls within the County. A
Certificate Of Public Convenience and Necessity must be obtained from the
County before engaging in this level of medical service.

B. Class 2: Collier Counly Hospilals:
I. ALS Transfer: An EMS provider who renders ALS interfacility medical
transfer services. An EMS provider who is awarded a Class 2 ALS transfer
certitlcate nod does not poss~ss a Class I ALS rescue certificate shall not
respond to an emergency catt and provide ALS rescue services unless called upon
by the appropriate Class t -- ALS rescue provider to provide emergency backup
service. In these instances, it shall be deemed to be operating under the Class I
ALS rescue certificate of the governmental entity requesting such emergency
backup service.
2. Class 2 _ ALS transfer certificate holders may provide post-hospital
inteffacility medical transfer services and routine ALS and BLS calls within the
County but only to hospitals owned by the certificate holder, however, the Class 2
certificate holder may provide out-of-County transports. Unless an EMS provider
possesses a Class 1- ALS Rescue certificate issued by the County, a Certificate
Of Public Convenience and Necessity must be obtained from the County before
engaging in this level of medical service.
3. Class-2 transfer certificate holders shall contract with the Class I rescue
certificate holder's Medical Director for the perfonnance of services set forth in
Florida Statutes. Section 40 1.265 and as speci fically set forth herein as follows:
a. He shall supervise and accept direct responsibility for the medical
performance of the paramedics and Emergency Medical Technicians (hereinafter
EMTs).
b. He shall develop medically correct standing orders or protocols
relating to life support system procedures when communication cannot be
established with a supervising physician or when any delay in patient care would
potentially tlueaten the life or health oCthe patient.
c. He shall issue standing orders and protocols to ensure that the
Class.2 transfer certificate holder transports each of its patients to facilities that
offer a type and level of care appropriate to the patient's medical condition.
d. He or his appointee shall provide continuous 24-hour-per-day,
7_day_per_week medical direction which shaU include. in addition to the
development of protocols and standing orders, direction to the Class-2 transfer

certificate holder's personnel as to the availability of "off-line" service to resolve
problems, system conflicts, and provide services in an emergency as that term is
dclincd by section 252.34(3), Fiorida Statutes.
c. He shall establish a quality assurance committee to provide for
quality assurance review of all EMTs and paramedics operating under his
supervision.
f. He shall audit the performance of system personnel by use of a
quality assurance program that includes but is not limited to a prompt review of
patient care records, direct observation, and comparison of perfonnance standards
tor drugs, equipment, system protocols and procedures. He shall be responsible
tor participating in quality assurance programs developed by the Class-2 transfer
certificate holder.
g. He shall cnsure and certify that security procedures of the Class-2
transfer certificate holder for medications, fluids and controlled substances are in
compliance with chaplers 401, 499 and 893, Florida Stall/les, and chapter IOD-45
of the Florida Administrative Code.
h. He shall create, authorize and ensure adherence to, detailed written
operating procedures regarding all aspects of the handling of medications, fluids
and controlled substances by the EMS personnel and comply with all requirements
of chaplers 401,499 and 893, Florida Statl/tes.
I. He shall notify the Florida Department of Health, (hereinafter the
"Department") in writing when the use of telemetry is not necessary.
J. He shall notify the department in writing of each substitution of
equipment or medication.
k. He shall assume direct responsibility for the use by an EMT of an
automatic or semi-automatic defibrillator; the performance of esophageal intubation
by an EMT; and on routine interfacility transports, the monitoring and maintenance
of non-medicated LV.s by an EMT. He shall ensure that the EMT is trained to
perform these procedures; shall establish written protocols for the performance of
these procedures; and shall provide written evidence to the Florida Department of
Health documenting compliance with the provisions of this paragraph.

1. He shall ensure that a\1 EMTs and paramedics are trained in the use
of the trauma scorecard methodologies as provided in sections 64E-2.017 of the
F.A.C., for adult trauma patients and 64E-2.0175, F.A.C., for pediatric trauma
patients.
m. He shall participate as a crewmernber on an EMS vehicle for a
minimum of to hours per year and complete a minimum of to hours per year of
continuing medical education related to pre~hospilal care or leaching or a
combination of both.
n. He shall ensure that all of the Class-2 transfer certificate holder's
EMTs and paramedics have all proper certitications and receive all training
necessary to maintain their certification.
Section 13: Transfer Or Assignment of Certificates
No certificate issued under this Ordinance shalt be assignable or transferable by the
person to whom issued except unless approval is obtained from the Board in the same manner
and subject to the same application, investigation, fees and public hearing as original
applications tor certiticates. Any majority transfer of shares or stock or interesL orallY person or
operator so as to cause a change in the directors, otlicers, majority stockholders or managers of
such person or operator shall be deemed a transfer or assignment as contemplated in this
Ordinance and subject to the same rules and regulations as any other transfer or assignment.
Section ]4: Revocation, Alteration Or Suspension Grounds
A. Every certificate issued under this Ordinance shall be subject to revocation, alteration
and/or suspension of operation. by the Board, for a period of up to one year, where it
shall appear that:
I. The operator has failed or neglected for a period of thirty (30) days during any
calendar year to render all services authorized by his certificate.
2. The operator has been convicted of a felony or any criminal offense involving
moral turpitude.
3. The certificate was obtained by an application in which any material fact was
omitted or falsely stated.
4. The operator has knowingly permitted any of its motor vehicles to be operated in
violation the laws which result in conviction of the driver or operator of a

misdemeanor in the second degree or greater, or has knowingly permitted a driver
with more than two previous convictions to operate emergency vehicles.
5. The operator has failed to comply with any orthe provisions of\his Ordinance.
6. The public interest will best be served by revocation, alteration, or suspension of
any certificate upon good cause shown.
7. The operator or his agent has demanded money or compensation other that that
established and prescribed under this ordinance. (I f applicable).
8. The operator has without sutlicient justification failed or refused to furnish
emergency care and/or transportation promptly for a sick or injured person.
9. The operator or his agent has been found guilty of malpractice or willtlll and
wanton misconduct in the operation of its service.
B. All complaints shall be investigated and a report thereon made to the Board, together
with findings and recommendations, within tifteen (15) days. If revocation, suspension
or alteration of any certificate appears warranted, the Board shall give notice to the
operator holding the certificate that the same will be considered at a specific commission
meeting, provided the date of such meeting shall not be less than five (5) days from the
date of the notice. The Board shall thereupon consider the complaint and either revoke,
suspend or alter the certificate or dismiss the complaint.
Sectlon 15: General Operatlng Regulations
All certificate holders, operators. and drivers shaH comply with all state statutes and
administrative regulations as following regulations:
A. Twenty-four Hour Service. Every certificate holder shall be required to operate
sufficient ambulances, as stated on the certificate of operation and determined by the
Board. on immediate call at all times.
B. Prompt Service Required. Every call for ambulance service shall be answered promptly.
Patients shall be loaded and transported without being subject to unreasonable delays..
All calls for emergency assistance requiring over twenty (20) minutes from time of
notification to arrival on scene shall be reported to the Administrator with complete
documentation of the circumstances, which delayed the response. Those instances where
more that three (3) minutes elapse between receipt of an emergency call and dispatch of
an ambulance shall also be reported to the Administrator with documentation of
circumstances.

C. Bed Linens. Clean and sanitary bed linens shaH be provided for each patient carried and
shall be changed as soon as practicable after the discharge of the patient.
D. Daily Log. Every operator shall maintain in a daily log upon which shall be recorded the
place or origin, time of call, time of dispatch, time of arrival at scene, time len for
hospital, time of arrival at hospital. and charges for each trip made and such other
operating and patient information as may be required by Ordinance. Every operator shall
retain and preserve all daily logs for at least two (2) years, and such logs shall be
available for inspection by the Administrator.
E. Communications. Each ambulance shall maintain two-way radio communication with the
location of primary dispatch from which it operates, as well as any additional
communication capabilities required by Ordinance or state law.
F. Vehicles and Equipment. Each vehicle shall be equipped with the proper medical and
emergency equipment as required by the laws of the State of Florida and shall be
subjected to inspection from time to time to insure compliance with the laws of Florida
and this Ordinance.
G. Certification. In addition to the State of Florida Department of Health, Bureau of
Emergency Medical Services requirements for certification, each paramedic must be
certified by the County Medical Director. Each paramedic must work with a Collier
County EMS ambulance for a sufficient length of time for the ambulance service medical
director to properly judge his capability. At minimum, the paramedic must work in that
capacity not less than one full month's work shift annually. Salaries of other than Collier
County EMS paramedics will be paid by the agency seeking the Med;cal Director
Certification.
H. Application. Each ambulance or ALS setvice shall be subject to those rules and
regulation as promulgated by Ordinances of the Board for the purpose of carrying out
this ordinance.

Each operator shall maintain a central place of business which shall be entirely within his
designated operating zone, at which place he shall provide two~way radio communication with
his vehicles, the County Emergency ControL Communications Center, and his place of business,
a properly listed tclcphone for receiving all calls for sctvice and at which central place of
busincss he shall keep such business records and daily logs available for inspection or audit by

the Administrator. Every operator shall keep on file with the Administrator and the County
Emergency Control Communications Center a business address and telephone number at which
the operator may be reached at all times. This information will be maintalned at the Emergency
Control Center.
Section 17: Records To Ue Kept
Every operator shall keep accurate records of receipts from operations, operating and
other expenses, capital expenditure and such other operating and patient infonnation as may be
required by the Board.
Section 18: Rates
Every operator shall file with the Board a schedule of the rates. Such rates shall be tiled as
a part of each new or renewal application, and a rate schedule shall also be filed when
changes in rates are proposed. All such rates shall be subject to review and approval by the
Board.
Section 19: Operator's Insurance
Every ambulance operator shall carry bodily injury and property damage insunmce with
solvent and responsible insurers authorized to transact business in the State of Florida to secure
payment for any loss or damage resulting from any occurrence arising out of or caused by the
operation or use of any of the operator's motor vehicles. Each vehicle shall be insured for the
som of al leasl one hundred thousand dollars ($100,000.00) for injuries 10 or death of anyone
person arising out of anyone accident and the sum of at least three hundred thousand dollars
($300,000.00) for injuries to or death or more than one person in anyone accident and for the
sum of at leasl fifty thousand dollars ($50,000.00) for damage 10 property arising from anyone
accident. They shall also have malpractice insurance. Every insurance policy or contract for
such insurance shall provide for the payment and satisfaction of any financial judgment entered
against the operator and present insured or any person driving the insured vehicle. Such
inswance shall be obtained and certificates or certified copies of such policies shall be filed with.
the Board. All such insurance policies, certificates thereof or certified copies of such insurance
policies shall provide for a thirty (30) day cancellation notice to the Board.
Section 10: Conduct of Drivers And Attendants
All drivers, EMT's and paramedics shall comply with the Jaws of the State of Florida, in
order to meet the requirements set out in this Ordinance and no driver. EMT or paramedic
registered hereunder shall:

A. fail or refuse to promptly transport, if applicable. or attend any sick or injured person
after responding to a catl.
B. Demand or receive compensation other that that established and approved in
accordance with this ordinance or fail to give a receipt for moneys received. (If
applicahle).
C. Give or allow rebate, commission. discount or any reduced rate not provided in the
established rate. (If applicable.)
D. At any time induce or seek to induce any person engaging an ambulance or ALS selVice
to patronize or retain the services of any hospital, convalescent home, mortuary,
cemetery, attorney, accident investigator, nurse, medical doctor or other service
occupation or profession.
E. At any time release his patient from his care until he is assured that some responsible
person is available to receive such patient.
F. At any time use a siren or flashing red Ught unless on an emergency call.
G. Disobey the lawful orders of the law enforcement officer at the scene of an accident, or
other similar such emergency or at a fire scene, the fire officer in charge.
H. Smoke while within the confines of an ambulance.
1. Operate or ride in an ambulance without using seatbelts. (Personnel attending patients
are exempt).
Section 21: Passengers
No person shall be aboard ambulances when engaged in emergency or routine medical calls
except the following:
A. Driver, attendants and fire or law enforcement personnel;
B. Patients;
c. Not more that one relative or close friend of the patient, or if the situation warrants, the
paramedic in charge may authorize more than one passenger.
D. Physicians and nurses;
E. Personnel in an observing capacity that are being trained for ambulance or ALS service.
F. Operator's supervisory personnel.
Sedlon 22: Obedience to Trame Laws, Ordinances or Regulations.
A. The driver of an ambulance or ALS vehicle when responding to an emergency call or while
transporting a patient may exercise the followin.g privileges when such driver has

reasonable grounds to believe that an emergency in fact exists requiring the exercise of
such privileges:
I. Park or l'itand, irrespective of the otherwise applicable provisions oflaw, ordinance
or regulations.
2. Proceed past a red light or stop signal or stop sign, but only after slowing down as
may be necessary for safe operations.
3. Exceed the maximum speed limits permitted by law so long as he does not
endanger life or property.
4. Disregard laws, ordinances or regulations governing direction or movement or
turning in specified directions so long as he does not endanger life or property.
B. The exemptions herein granted shall apply only when such vehicle is making use of
audible and/or visible signals meeting the requirements of this Ordinance.
C. The foregoing provisions shan not relieve the driver of a vehicle from the duty to drive
with due regard for the safety of all persons, nor shall such provisions protect the driver
from the consequences of his reckless disregard for the safety of others.
Section 13: Violations
In addition to the remedies provided herein, a violation of any provision of this ordinance
shall be punishable as provided by law for the violation of County ordinances.
Section 14: Uniformity of Application
The Ordinance shall constitute a uniform law applicable in all of Collier County.
Section 15: Anthority To Enforce
it is hereby declared to be the duty of the Board of County Commissioners of Collier
County, its officers, agents, employees and other governmental agencies, the sheriffs
department of Collier County, its deputies and agents, fire departments, as well as the police
departments of the various municipalities falling under the provisions of this Ordinance to
strictly enforce the provisions of this Ordinance.
Section 16: Repeal and Codification
Ordinance 75-50 is hereby repealed. This Ordinance shall be codified in the Collier
County Code as Chapter 4 of said Code, and said Code is hereby amended accordingly.
Section 17: Conflict and Severahlllty
In the event this Ordinance should ever conflict with any other ordinance of CotHer
County, or applicable ordinance of any municipality, or oth~r applicable law, rule or regulation,

the more restrictive shall apply. If any section, sub-section, sentence, clause, phrase or portion of
this Ordinance is for any reason held invalid or unconstitutional by any court of competent
jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such
holding shall nouffectthe validity of the remainder ofthe Ordinance.
Section 28: Effective Date
This Ordinance shall become effective upon receipt of notice that it has been Ii led with
the Secretary of State.

Desian Charrette
A Charrette is an intensified, highly interactive and participative community based
planning process. The Charrette allows community participants to work together
in a forum to identify and examine planning issues, generate and exchange ideas
and potential solutions, evaluate alternatives, and ultimately reach consensus
with regard to a final plan of action.
The term "Charrette" originates from the French word for "little cart". At the Ecole
des Beaux Arts in Paris in the 19th Century, architecture students had a limited
amount of time to complete their final design projects. Students would frantically
rush to put the finishing touches on their work as examin~rs circulated with little

Community Reinvestment Area and Tax Increment Financing
Overview
Information regarding CRAs and Tax Increment Financing may be found in the
Florida Statutes. An excerpt from materials provided by Collier County regarding
CRAs is provided below.
In 1969, the Florida State Legislature enacted Part II, Chapter 163, Florida
Statutes, enabling local units of government to set up a COl'llmunity
Redevelopment Agency (CRA). The overall goal of the I~l~ature was to
encourage local initiative in downtown and neighborhoQitlnrevitalization and to
provide maximum opportunity for private enterprisestd'p8i:ticipate in the
redevelopment and revitalization of the designated areas. The. five primary

To be designated as a redevelopment area, the area must meet the criteria
outlined in Chapter 163.340, Florida Statutes. Areas can meet the requirements
for establishment of CRAif:
1) There is a sU~~Cl,'i!~'li!1 number of deteriorated, or deteriorating structures and
conditions that er\d~r\ger life or property by fire or other causes; or there is the
presence of one or more of the following factors which substantially impairs or
arrests the sound growth of a county or municipality and is a menace to the
public health, safety, morals, or welfare in its present condition and use:
a. Predominance of defective or inadequate street layout;
b. Faulty lot layout in relation to size, adequacy, accessibility, or
usefulness;
c. Unsanitary or unsafe conditions;
d. Deterioration of site or other improvements;
e. Tax or special assessment delinquency exceeding the fair value of
the land; and
f. Diversity of ownership or defective or unusual conditions of title
which prevent the free alienability of land within the deteriorated or
hazardous area; or
2) There is faulty or inadequate street layout; inadequate parking facilities; or
roadways, bridges, or public transportation facilities incapable of handling the
volume of traffic flow into or through the area, either at present or following
proposed construction.

As required by State Sta~llte, a redevelopment plan that provides the framework

be p~pared if CitY Council desides to establish a CRA. In addition to providing
flexibl~y for implementation dftl;l9 goals outlined for a eRA, a plan may
recognIZe several funding sources for implementation including the use of Tax
Increment Financing (TIF);

Tax Increment Financing realizes the incremental increase in property tax
revenues resulting fI'om redevelopment and uses it to pay for public
improvements needed to support and encourage new development. As value of
property rises due to redevelopment investments, increased property taxes that
result will be available to repay the public infrastructure costs associated with
redevelopment. TIF is designed to allow local governments to finance, over the
long term, front-end costs associated with adoption of a redevelopment plan,
repaving or rerouting of streets, providing open space, housing, redevelopment
assistance or incentives and property acquisition. For purposes of calculating the
amount of tax increment revenues, the frozen tax base is the final tax roll for the
year in which the CRA is established.
Tax increment revenues can be used for the following purposes when directly
related to redevelopment in the designated redevelopment areas:
. Administrative and overhead expenses incidental to a redevelopment
plan;
. Redevelopment planning and analysis;
. Acquisition of real property in the redevelopment area;
. Clearance and preparation of redevelopment sites, and relocation costs;
. Repayment of indebtedness and payment of expenses incidental to
indebtedness;
. Development of affordable housing within the red~jl!iil()pment area;
. Development of community policing innovation~;,~rii::l
. Construction of streets, utilities, parks, public;!!!rea$i,~arking garages, and
other improvements necessary to carrying out the r~yelopment plan.
To most effectively use the tax increment revenues, the CRA and the City may
use other State and Federal funding sources such as advances, 10anli1. tax
increment revenue bonds and grants as appropriate and available to carry out

The statutory provisions for establishing a eRA can be found in Chapter 163, Part III
"Community Redevelopment/I! Florida Statutes. More specifically, a governing body would
have to meet the llFindings and declarations of Necessityll set forth in Section 163.335.
The primary consideration with respect to Marco Island would have to be a finding of slum
or blight. The terms slum or blight have had a very wide application in the State of
Florida as blight is considered a matter of state policy or state concern as it relates to
that government agency. A normal example are the downtrodden old town centers that were
subject to degradation or decaying waterfronts that have been successful CRAs in Florida.
There is more specificity in the Section that would also need to be addressed as well.
In order to support a finding of slum or blight, Section 163.355 requires that a finding
of necessity be supported by data and analysis which either meet the definition of Slum as
set forth in Section 163.340(7) or Blight as set forth in Section 163.340181, I am aware
you have the Florida Statutes and the full context is easier to interpret when going back
and forth from one section to another. If the local government makes a finding of
necessity supported by data and analysis then the local government would pass a resolution
that states the conditions enumerated in Section 163.355. Subsequent to that finding, the
governing body would then create the community redevelopment agency in accordance with the
provisions in Section 163.356, F.B.
In summary, the criteria involve slum and blight related to a finding of necessity.

Attached are the applicable sections referenced in my prior e-mail. I would recommend
starting with the definitions of slum and blight and then review those definitions in the
context of the findings of necessity. The pivotal question is what geographic area will
be the subject of discussion.
163.335 Findings and declarations of necessity.--
(1) It is hereby found and declared that there exist in counties and municipalities of
the state slum and blighted areas which constitute a serious and growing menace, injurious
to the public health, safety, morals, and welfare of the residents of the state; that the
existence of such areas contributes substantially and increasingly to the spread of
disease and crime, constitutes an economic and social liability imposing onerous burdens
which decrease the tax base and reduce tax revenues, substantially impairs or arrests
sound growth, retards the provision of housing accommodations, aggravates traffic
problems, and substantially hampers the elimination of traffic hazards and the improvement
of traffic facilities; and that the prevention and elimination of slums and blight is a
matter of state policy and state concern in order that the state and its counties and
municipalities shall not continue to be endangered by areas which are focal centers of
_disease, promote juvenile delinquency, and consume an excessive proportion of its revenues
3cause of the extra services required for police, fire, accident, hospitalization, and
~ther forms of public protection, services, and facilities.
(2) It is further found and declared that certain slum or blighted areas, or portions
thereof, may require acquisition, clearance, and disposition subject to use restrictions,
as provided in this part, since the prevailing condition of decay may make impracticable
the reclamation of the area by conservation or rehabilitation; that other areas or
portions thereof may, through the means provided in this part, be susceptible of
conservation or rehabilitation in such a manner that the conditions and evils enumerated
may be eliminated, remedied, or prevented; and that salvageable slum and blighted areas
can be conserved and rehabilitated through appropriate public action as herein authorized
and the cooperation and voluntary action of the owners and tenants of property in such
areas.
(3) It is further found and declared that the powers conferred by this part are for
public uses and purposes for which public money may be expended and police power
exercised, and the necessity in the public interest for the provisions herein enacted is
declared as a matter of legislative determination.
(4) It is further found that coastal resort and tourist areas or portions thereof which
are deteriorating and economically distressed due to building density patterns, inadequate
transportation and parking facilities, faulty lot layout, or inadequate street layout,
could, through the means provided in this part, be revitalized and redeveloped in a manner
that will vastly improve the economic and social conditions of the community.
(S) It is further found and declared that the preservation or enhancement of the tax base
from which a taxing authority realizes tax revenues is essential to its existence and
financial health; that the preservation and enhancement of such tax base is implicit in
the purposes for which a taxing authority is established; that tax increment financing is
~ effective method of aChieving such preservation and enhancement in areas in which such
~ax base is declining; that community redevelopment in such areas, when complete, will
enhance such tax base and provide increased tax revenues to all affected taxing
authorities, increasing their ability to accomplish their other respective purposes; and
that the preservation and enhancement of the tax base in such areas through tax increment

financing and the levying of taxes by such taxing authorities therefore and the
appropriation of funds to a redevelopment trust fund bears a substantial relation to the
purposes of such taxing authorities and is for their respective purposes and concerns.
~This subsection does not apply in any jurisdiction where the community redevelopment
rency validated bonds as of April 30, 1984.
(6) It is further found and declared that there exists in counties and municipalities of
the state a severe shortage of housing affordable to residents of low or moderate income,
including the elderly; that the existence of such condition affects the health, safety,
and welfare of the residents of such counties and municipalities and retards their growth
and economic and social development; and that the elimination or improvement of such
condition is a proper matter of state policy and state concern and is for a valid and
desirable public purpose.
(7) It is further found and declared that the prevention or elimination of a slum area or
blighted area as defined in this part and the preservation or enhancement of the tax base
are not public uses or purposes for which private property may be taken by eminent domain
and do not satisfy the public purpose requirement of s. 6(a), Art. X of the State
Constitution.

163.355 Finding of necessity by county or municipality.--No county or municipality shall
exercise the community redevelopment authority conferred by this part until after the
governing body has adopted a resolution, supported by data and analysis, which makes a
legislative finding that the conditions in the area meet the criteria described in s.
163.340(7) or (8). The resolution must state that,
(1) One or more slum or blighted areas, or one or more areas in which there is a shortage
of housing affordable to residents of low or moderate income, including the elderly, exist
.in such county or municipality; and
\2) The rehabilitation, conservation, or redevelopment, or a combination thereof, of such
area or areas, including, if appropriate, the development of housing which residents of
low or moderate income, including the elderly, can afford, is necessary in the interest of
the public health, safety, morals, or welfare of the residents of such county or
municipality.

163.340 Definitions.--The following terms, wherever used or referred to in this part,
have the following meanings:
(7) "Slum area!l means an area having physical or economic conditions conducive to
disease, infant mortality, juvenile delinquency, poverty, or crime because there is a
predominance of buildings or improvements, whether residential or nonresidential, which
are impaired by reason of dilapidation, deterioration, age, or obsolescence, and
exhibiting one or more of the following factors:
(a) Inadequate provision for ventilation, light, air, sanitation, or open spaces;
(b) High density of population, compared to the population density of adjacent areas
within the county or municipality; and overcrowding, as indicated by government-maintained
statistics or other studies and the requirements of the Florida Building Code; or
(c) The existence of conditions that endanger life or property by fire or other causes.
(8) !IBlighted areal! means an area in which there are a substantial number of
~teriorated, or deteriorating structures, in which conditions, as indicated by
~overnment-maintained statistics or other studies, are leading to economic distress or
endanger life or property, and in which two or more of the following factors are present:
(a) predominance of defective or inadequate street layout, parking facilities, roadways,

bridges, or public transportation facilities;
(b) Aggregate assessed values of real property in the area for ad valorem tax purposes
have failed to show any appreciable increase over the 5 years prior to the finding of such
'~ondi tions;
(c) Faulty lot layout in relation to size, adequacy, accessibility, or usefulness;
(d) Unsanitary or unsafe conditions;
(e) Deterioration of site or other improvements;
(f) Inadequate and outdated building density patterns;
(g) Falling lease rates per square foot of office, commercial, or industrial space
compared to the remainder of the county or municipality;
(h) Tax or special assessment delinquency exceeding the fair value of the land;
(i) Residential and commercial vacancy rates higher in the area than in the remainder of
the county or municipality;
(j) Incidence of crime in the area higher than in the remainder of the county or
municipality;
(k) Fire and emergency medical service calls to the area proportionately higher than in
the remainder of the county or municipality;
(1) A greater number of violations of the Florida Building Code in the area than the
number of violations recorded in the remainder of the county or municipality;
(m) Diversity of ownership or defective or unusual conditions of title which prevent the
free alienability of land within the deteriorated or hazardous area; or
n) Governmentally owned property with adverse environmental conditions caused by a
public or private entity.
However, the term lIblighted areal! also means any area in which at least one of the factors
identified in paragraphs (a) through (n) are present and all taxing authorities subject to
s. 163.387(2) (a) agree, either by interlocal agreement or agreements with the agency or by
resolution, that the area is blighted. Such agreement or resolution shall only determine
that the area is blighted. For purposes of qualifying for the tax credits authorized in
chapter 220, "blighted areal! means an area as defined in this subsection.

163.356 Creation of community redevelopment agency.--
(1) Upon a finding of necessity as set forth in s. 163.355, and upon a further finding
that there is a need for a community redevelopment agency to function in the county or
municipality to carry out the community redevelopment purposes of this part, any county or
municipality may create a public body corporate and politic to be known as a lIcommunity
redevelopment agency.!! A charter county having a population less than or equal to 1.6
million may create, by a vote of at least a majority plus one of the entire governing body
of the charter county, more than one community redevelopment agency. Each such agency
shall be constituted as a public instrumentality, and the exercise by a community
redevelopment agency of the powers conferred by this part shall be deemed and held to be
.~.he performance of an essential public function. Community redevelopment agencies of a
~unty have the power to function within the corporate limits of a municipality only as,
if, and when the governing body of the municipality has by resolution concurred in the
community redevelopment plan or plans proposed by the governing body of the county.

(2) When the governing body adopts a resolution declaring the need for a community
redevelopment agency, that body shall, by ordinance, appoint a board of commissioners of
the community redevelopment agency, which shall consist of not fewer than five or more
than nine commissioners. The terms of office of the commissioners shall be for 4 years,
,~'- xcept that three of the members first appointed shall be designated to serve terms of 1,
,/ and 3 years, respectively, from the date of their appointments, and all other members
shall be designated to serve for terms of 4 years from the date of their appointments. A
vacancy occurring during a term shall be filled for the unexpired term. As provided in an
interlocal agreement between the governing body that created the agency and one or more
taxing authorities, one or more members of the board of commissioners of the agency may be
representatives of a taxing authority, including members of that taxing authority's
governing body, whose membership on the board of commissioners of the agency would be
considered an additional duty of office as a member of the taxing authority governing
body.
(3) (a) A commissioner shall receive no compensation for services, but is entitled to the
necessary expenses, including travel expenses, incurred in the discharge of duties. Each
commissioner shall hold office until his or her successor has been appointed and has
qualified. A certificate of the appointment or reappointment of any commissioner shall be
filed with the clerk of the county or municipality, and such certificate is conclusive
evidence of the due and proper appointment of such commissioner.
(b) The powers of a community redevelopment agency shall be exercised by the
commissioners thereof. A majority of the commissioners constitutes a quorum for the
purpose of conducting business and exercising the powers of the agency and for all other
purposes. Action may be taken by the agency upon a vote of a majority of the commissioners
present, unless in any case the bylaws require a larger number. Any person may be
appointed as commissioner if he or she resides or is engaged in business, which means
owning a business, practicing a profession, or performing a service for compensation, or
serving as an officer or director of a corporation or other business entity so engaged,
within the area of operation of the agency, which shall be coterminous with the area of
operation of the county or municipality, and is otherwise eligible for such appointment
,~~nder thi s part.
,c) The governing body of the county or municipality shall designate a chair and vice
chair from among the commissioners. An agency may employ an executive director, technical
experts, and such other agents and employees, permanent and temporary, as it requires, and
determine their qualifications, duties, and compensation. For such legal service as it
requires, an agency may employ or retain its own counsel and legal staff. An agency
authorized to transact business and exercise powers under this part shall file with the
governing body, on or before March 31 of each year, a report of its activities for the
preceding fiscal year, which report shall include a complete financial statement setting
forth its assets, liabilities, income, and operating expenses as of the end of such fiscal
year. At the time of filing the report, the agency shall publish in a newspaper of general
circulation in the community a notice to the effect that such report has been filed with
the county or municipality and that the report is available for inspection during business
hours in the office of the clerk of the city or county commission and in the office of the
agency.
(d) At any time after the creation of a community redevelopment agency, the governing
body of the county or municipality may appropriate to the agency such amounts as the
governing body deems necessary for the administrative expenses and overhead of the agency,
including the development and implementation of community policing innovations.
(4) The governing body may remove a commissioner for inefficiency, neglect of duty, or
misconduct in office only after a hearing and only if he or she has been given a copy of
the charges at least 10 days prior to such hearing and has had an opportunity to be heard
in person or by counsel.

In addition to the grants awarded to the City of Marco Island, Collier County's comprehensive
affordable-workforce housing program is available to all residents of the County, including the citizens
of Marco Island. The program includes incentives such as the deferral of impact fees, down payment
and closing cost assistance, residential rehabilitation and hurricane hardening and mitigation. Residents
interested in becoming new homeowner's may schedule a personal consultation with a member of the
Housing and Human Services Department. Through the County, residents may partner with local banks
to provide home loans for households earning less than $55,850 per year. All interested parties may

INTERLOCAL AGREEMENT
THIS INTERLOCAL AGREEMENT (the "Agreement") is entered into this
~ day of ~ ' 2000, by and between THE CITY OF MARCO
ISLAND, FlO DA, hereinafter called the "City", and the BOARD OF
COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, hereinafter
called the "County". The City and the County are sometimes collectively
referred to herein as the "parties" or individually as the "party".
WITNESSETH:
WHEREAS, the City was incorporated by special act of the Florida
legislature that was approved on August 28, 1997 and by referendum; and
WHEREAS, Chapter 163, Florida Statutes, requires all municipal
governments to prepare and adopt a Comprehensive Plan, including a
Housing Element, within three years of incorporation; and
.
WHEREAS, the City is located within Collier County, Florida; and
WHEREAS, the County has successfully implemented a Housing
Program pursuant to the Housing Element contained in the County's Growth
Management Plan to address affordable housing needs and issues; and
WHEREAS, Section 163.01 (2), Florida Statutes, permits local
governmental units to make the most efficient use of their resources by
enabling them to cooperate with each other to provide services in a manner
that will accord best with geographic, economic, population and other
factors influencing the needs and development of local communities; and
WHEREAS, the parties recognize that affordable housing is not only a
county-wide concern but also a regional concern and that a consolidated
approach presents a rational means to effectively address affordable housing
needs both on Marco Island and throughout unincorporated Collier County;
and
WHEREAS, the County desires to assist the City and serve all of the
citizens of Collier County by expanding the County's Housing Program,
including but not limited to all operational, managerial and programmatic
services, to encompass the City; and

WHEREAS, by inclusion of the City in the County's Housing Program,
such program shall serve as the primary source for affordable housing
programs and services to address moderate, low and very low income
household needs and opportunities both on and off Marco Island; and
WHEREAS, the City has requested that the County provide assistance
to the City by including the City in the County's Housing Program to address
affordable housing issues both on and off Marco Island.
NOW, THEREFORE, in consideration of the mutual covenants
contained herein, the parties hereby agree as follows:
1 . The County will provide the services of the County Housing and
Urban Improvement staff ("County Staff") to incorporate the
City into the County's Housing Program, and to provide the
citizens of Marco Island all the services, programs, and other
benefits available to all other persons served by the Housing
Program.
2. The City will provide adequate space for the public display of
housing information and materials, and further will devote
nominal staff time to assist in the dissemination of information
related to the Housing Program.
3. The geographical boundaries of the City of Marco Island shall be
included as part of the County's Urban Area Boundary (map
attached), and such housing programs and activities
contemplated by this agreement shall occur within such Urban
Area Boundary.
4. That upon incorporation of the City into the County's Housing
Program, all current and future estimates of affordable housing
needs shall be calculated utilizing population data and economic
conditions/factors that encompass the Urban Area Boundary
covered by the Housing Program. Any future affordable
housing needs or obligations that may be attributable to the City
shall not be calculated independently, but rather shall be
included in overall Housing Program area calculations.
5. The City shall defer to the County all decisions regarding the
allocation and use of all sources of Housing Program funding.
In return the County shall provide the City with monthly reports
in a format mutually agreed upon.

6. That the County shall be able to utilize and include demographic
figures for the City of Marco Island for any future funding or
grant proposals prepared by County staff or designee to
advance programs and/or services under the Housing Program.
7. That the expansion of the County's Housing Program to
incorporate the City shall make the County's program the
primary source for housing programs and opportunities,
including affordable housing, on and off Marco Island.
8. TERMS OF AGREEMENT. This Agreement shall be for an initial
term of thirty-six (36) months beginning October 1, 2000, and
ending September 30, 2003. This initial term shall be
automatically renewed for additional three-year terms
commencing October 1 of the applicable year and terminating
September 30 three years thereafter unless one party delivers a
written notice of termination to the other party prior to April 1
of the applicable termination year.
The parties further agree that this Agreement may be
terminated upon a finding by the Florida Department of
Community Affairs, in writing, of one or more of the following:
(i) that the Agreement is contrary to the intent of Chapter 163,
Florida Statutes, (ii) that the agreement is contrary to policies
contained in the Southwest Regional Policy Plan, (iiil the
agreement is not in the best interest of the County, City, and
affected residents of Collier County.
9. NOTICES. All notices that are required hereunder, or which
either party may desire to serve upon the other party, including
but not limited to a change of address for either party, shall be
in writing and shall be presumed served when delivered
personally, or when deposited in the United States mail,
postage prepaid, addressed in accordance with each party's
current address of record. The initial address of record for each
party is:

1 O. COMPENSATION. For the services rendered by the County
pursuant to this Agreement the City shall provide compensation
which the County must allocate to affordable housing activities.
The compensation paid by the City will equal 10% of annual
building permit fees collected by the City, or $50,000.00,
whichever is greater. Calculation of annual City building permit
fees collected shall not include any required impact fees or state
mandated fees. Further, for any qualified project within the City
which is eligible for building fee reduction or waiver, the amount
of building fee reduction, waiver or deferment shall be deducted
from the total amount of annual compensation. Said payments
from the City to the County shall be made to the Board of
County Commissioners. The payments by the City shall be paid
in quarterly installments beginning January 1, 2001 or as
governed by Chapter 218, Florida Statutes (The Florida Prompt
Payment Actl.
11. INSURANCE. The County's liability coverages will extend to
both the County and County's staff for this Agreement subject
to normal exclusions.
12. RECORDING. This Agreement shall be recorded In the Official
Records of Collier County, Florida.
