RESOLUTION NO. 94- 464
A RESOLUTION AUTHORIZING THE ACQUISITION OF TEMPORARY
CONSTRUCTION EASEMENTS FOR THE CONSTRUCTION OF THE
ROADWAY SIX-LANING OF GOLDEN GATE PARKWAY FROM
GOODLETTE-FRANK ROAD TO AIRPORT-PULLING ROAD INCLUDING
THE INTERSECTION IMPROVEMENTS AT GOLDEN GATE PARKWAY AND
GOODLETTE-FRANK ROAD AND THE INTERSECTION IMPROVEMENTS
AT GOLDEN GATE PARKWAY AND AIRPORT-PULLING ROAD.
WHEREAS, the Board of County Commissioners on October 26,
1993 adopted Ordinance No. 93-78 and Resolution No. 93-493
establishing the 1993 (Fifth Annual) Capital Improvement Element
of the Growth Management Plan in order to establish priorities for
the design, acquisition and construction of the various capital
improvement projects which comprise the Transportation Element of
the County's Comprehensive Plan; and
WHEREAS, the six-Ianing improvements to Golden Gate Parkway
from Goodlette-Frank Road to Airport-pulling Road including the
intersection improvements at Golden Gate Parkway and
Goodlette-Frank Road and the intersection improvements at Golden
Gate Parkway and Airport-pulling Road component parts of the
Transportation Element of the County's Comprehensive Plan; and
WHEREAS, the Board of County Commissioners on June 29, 1993
adopted Resolution No. 93-261 authorizing the County Staff to
acquire by gift or purchase certain easements and fee simple title
to the property and property interests required and necessary for
the siX-lane construction of Golden Gate Parkway from

variables, and analyzed the safety and welfare considerations as
they relate to the construction of the siX-lane improvements for
Golden Gate Parkway from Goodlette-Frank Road to Airport-pulling
Road, including the intersection improvements at Golden Gate
Parkway and Goodlette-Frank Road and the intersection improvements
at Golden Gate Parkway and Airport-pulling Road; and
WHEREAS, the County Staff has recommended that it is

necessary and in the best interest of Collier County, Florida, to
acquire certain temporary construction easements which are
required and necessary for the construction of the six-Ianing of
Golden Gate Parkway from Goodlette-Frank Road to Airport-Pulling
Road, including the intersection improvements at Golden Gate
Parkway and Goodlette-Frank Road and the intersection improvements
at Golden Gate Parkway and Airport-pulling Road; and
WHEREAS, the construction of the six-laning of Golden Gate
Parkway from Goodlette-Frank Road to Airport-Pulling Road and the
intersection improvements is necessary in order to protect the
health, safety and welfare of the citizens of Collier County and
i8 in the best interest of Collier County.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that it has been
determined by the Board that the construction of the six-laning of
Golden Gate Parkway from Goodlette-Frank Road to Airport-pulling
Road and the intersection improvements at Golden Gate Parkway and
Goodlette-Frank Road and the intersection improvements at Golden
Gate Parkway and Airport-Pulling Road (hereinafter referred to as
"the Project") is necessary for a public purpose and is in the
best interests of Collier County.
AND IT IS FURTHER RESOLVED that the Board reviewed the Staff
analysis regarding alternative locations, environmental factors,
cost variables, safety and welfare considerations as they relate
to the construction of the Project and finds that the most
feasible locations for the additional road right-Of-way are
identified as Parcel Nos. 702, 707, 709A, 709B and 709C, more
particularly described in Exhibit "A" attached hereto and
incorporated herein; and
AND IT IS FURTHER RESOLVED that to implement said
construction of the Project it is appropriate and necessary for
the Board to acquire the temporary construction easements
identified as Parcel Nos. 702, 707, 709A, 709B and 709C, being

more particularly described in Exhibit "A", attached hereto and
incorporated herein, to be used as road right-of-way for the
construction of the six-lane improvements to Golden Gate Parkway
from Goodlette-Frank Road to Airport-Pulling Road, including
intersection improvements at Golden Gate Parkway and
Goodlette-Frank Road and Golden Gate Parkway and Airport-Pulling
Road.
AND IT IS FURTHER RESOLVED that the County staff is hereby
authorized to immediately acquire by gift, purchase or
condemnation in accordance with the provisions of Chapters 73, 74
and 127, Florida statutes, temporary construction easements
identified as Parcel Nos. 702, 707, 709A, 709B and 709C and being
more particularly described in Exhibit "A", attached hereto and
incorporated herein.
AND IT IS FURTHER RESOLVED that no mobile homes are located
on the property sought to be acquired and therefore it will not be

necessary to remove any mobile homes from the property to be
acquired.
This Resolution adopted after motion, second and majority
vote.
