RESOLUTION NO. 94- 462
A RESOLUTION AUTHORIZING THE ACQUISITION OF LAND
IN FEE SIMPLE FOR THE ROAD RIGHT-OF-WAY FOR THE
CONSTRUCTION OF THE ROADWAY SIX-LANING OF GOLDEN
GATE PARKWAY FROM GOODLETTE-FRANX ROAD TO AIRPORT-
PULLING ROAD INCLUDING THE INTERSECTION IMPROVEMENTS
AT GOLDEN GATE PARKWAY AND GOODLETTE-FRANX ROAD AND
THE INTERSECTION IMPROVEMENTS AT GOLDEN GATE PARKWAY AND
AIRPORT-PULLING ROAD.
WHEREAS, the Board ot County Commissioners on October 26,

1993 adopted Ordinance No. 93-78 and Resolution No. 93-493
establishing the 1993 (Fitth Annual) Capital Improvement Element
ot the Growth Management Plan in order to establish priorities tor
the desiqn, acquisition and construction ot the various capital
iaprovement projects which comprise the Transportation Element ot
the County's Comprehensive Plan; and
WHEREAS, the six-laning improvements to Golden Gate Parkway
troa Goodlette-Frank Road to Airport-Pulling Road including the
intersection improvements at Golden Gate Parkway and
Goodlette-Frank Road and the intersection improvements at Golden
Gate Parkway and Airport-Pulling Road component parts ot the
Transportation Element ot the County's Comprehensive Plan; and
WHEREAS, the Board ot County Commissioners on June 29, 1993
adopted Resolution No. 93-261 authorizing the County statt to
acquire by gitt or purchase certain easements and tee simple title
to the property and property interests required and necessary tor
the siX-lane construction ot Golden Gate Parkway trom
Goodlette-Frank Road to Airport-Pulling Roa~; and
WHEREAS, the County Statt has evaluated alternative
locations, reviewed the environmental tactors, considered the cost
variables, and analyzed the satety and weltare considerations as
they relate to the construction ot the siX-lane improvements tor
Golden Gate Parkway trom Goodlette-Frank Road to Airport-Pulling
Road, including the intersection improvements at Golden Gate
Parkway and Goodlette-Frank Road and the intersection improvements
at Golden Gate Parkway and Airport-pulling Road; and
WHEREAS, the County statt has recommended that it is

necessary and in the best interest ot Collier County, Florida, to
acquire allot the road right-ot-way required and necessary tor
the construction ot the six-Ianing ot Golden Gate Parkway trom
Goodlette-Frank Road to Airport-Pulling Road, including the
intersection improvements at Golden Gate Parkway and
Goodlette-Frank Road and the intersection improvements at Golden
Gate Parkway and Airport-Pulling Road in tee simple; and
WHEREAS, the construction ot the six-Ianing ot Golden Gate
Parkway tram Goodlette-Frank Road to Airport-Pulling Road and the
intersection iRprovements is necessary in order to protect the
health, satety and weltare ot the citizens ot Collier County and
is in the best interest ot Collier County.

NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that it has been
determined by the Board that the construction ot the six-Ianing ot
Golden Gate Parkway tram Goodlette-Frank Road to Airport-Pulling
Road and the intersection improvements at Golden Gate Parkway and
Goodlette-Frank Road and the intersection improvements at Golden
Gate Parkway and Airport-Pulling Road (hereinatter reterred to as
wthe Project") is necessary tor a public purpose and is in the
best interests ot Collier County.
AND IT IS FURTHER RESOLVED that the Board reviewed the Statt
analysis regarding alternative locations, environmental tactors,
cost variables, satety and weltare consider~tions as they relate
to the construction ot the Project and tindd that the most
teasible locations tor the additional road right-ot-way are
identitied as Parcel Nos. 103 and 104, more particularly described
in Exhibit "A" attached hereto and incorporated herein; and
AND IT IS FURTHER RESOLVED that to implement said
construction ot the Project it is appropriate and necessary tor
the Board to acquire tee simple title in the lands identitied as
Parcel Nos. 103 and 104, being more particularly described in
Exhibit "A", attached hereto and incorporated herein, to be used
as road riqht-ot-way tor the construction ot the six-lane

Airport-Pulling Road, including intersection improvements at
Golden Gate Parkway and Goodlette-Frank Road and Golden Gate
Parkway and Airport-Pulling Road.
AND IT IS FURTHER RESOLVED that the County statt is hereby
authorized to i..ediately acquire by gitt, purchase or
condemnation in accordance with the provisions ot Chapters 73, 74
and 127, Florida Statutes, tee simple title to the property
identitied as Parcel Nos. 103 and 104 and being more particularly
described in Exhibit "A", attached hereto and incorporated herein.
AND IT IS FURTHER RESOLVED that no mobile homes are located
on the property sought to be acquired and there tore it will not be

necessary to remove any mobile homes tram the property to be
acquired.
This Resolution adopted atter motion, second and majority
vote.
