COMMISSIONERS OF COLLIER COUNTY, FLORIDA,
AMENDING ORDINANCE NUMBER 03-46, WHICH
ESTABLISHED THE ARTESA POINTE PLANNED
UNIT DEVELOPMENT (PUD), BY AMENDING THE
STATEMENT OF COMPLIANCE AND SECTION 1.2,
ENTITLED "LEGAL DESCRIPTION IN ORDER TO
REMOVE A 0.88 +/- PARCEL OF LAND FROM THIS
PUD, AND REPLACING EXHIBIT "A," THE PUD
MASTER PLAN, WITH A NEW EXHIBIT "A," PUD

WHEREAS, Wayne Arnold, AICP, of Q. Grady Minor and Associates, P.A., and Richard D.
Yovanovich, Esq., of Goodlette, Coleman, Johnson, Yovanovich & Koester, P.A., representing KRG
95] & 4], LLC, petitioned the Board of County Commissioners to amend Ordinance Number 03-46,
as amended, for the Artesa Pointe Planned Unit Development.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that:
SECTION ONE: AMENDMENTS TO STATEMENT OF COMPLIANCE
The introductory paragraph of the Statement of Compliance of Ordinance Number 03-46, as
amended, (Artesa Pointe Planned Unit Development) is hereby amended to read as follows:
The purpose of this Section is to express the intent of Gateway Shoppes, LLC,
hereinafter referred to as the Development, to create a Planned Unit Development
(PUD) on ~ ~ +/- acres of land located in Section 3, Township 51 South, Range 26
East, Collier County, Florida. The name of this Planned Unit Development shall be
Artesa Pointe. The development of Artesa Pointe will be in compliance with the
planning goals and objectives of Collier County as set forth in the Growth
Management Plan. The development will be consistent with the growth policies and
land development regulations adopted pursuant to the Growth Management Plan,
Future Land Use Element and other applicable regulations for the following reasons:

SECTION THREE: AMENDMENTS TO MASTER PLAN
Exhibit A, the PUD Master Plan, of Ordinance Number 03-46, as amended, (Artesa Pointe
Planned Unit Development) is hereby replaced with a new Exhibit "A," PUD Master Plan.
SECTION FOUR: EFFECTIVE DATE
This Ordinance shall become effective upon filing with the Department of State.
