Resolution 1994-421 RESOLUTION NO. 94-421 RESOLUTION APPROVING WITH CONDITIONS PETITION CCSL-94-4 REQUESTING A VARIANCE FROM THE COASTAL CONSTRUCTION SETBACK LINE TO ALLOW THE RETAINMENT OF FILL PLACED ON THE PROPERTY OF SUNSET BAY CONDOMINIUM DESCRIBED AS THE SOUTH PART OF LOT XIII, AND NORTH PART OF LOT XII, IN BLOCK "B", AND ALL OF LOT XIV, BLOCK "A", UNIT NO.1, CONNORS VANDERBILT BEACH ESTATES SUBDIVISION OF A PORTION MARKED "NOT INCLUDED IN THIS PLAT" AS PER PLAT BOOK 3, PAGES 8 AND 9, PUBLIC RECORDS OF COLLIER COUNTY, IN SECTIONS 29 AND 32, TOWNSHIP 48 SOUTH, RANGE 25 EAST, COLLIER COUNTY, FLORIDA. WHEREAS, the petitioner, Sunset Bay Condominium Association through their representative Mr. Robert T. Gracey of Management By Association, Inc. requests a variance from the Coastal Construction Setback Line (CCSL) as required by Collier County Ordinance No. 91-102 Division 3.13, as amended, to allow the retainment of fill placed on the property of Sunset Condominium; and WHEREAS, the existing fill extends approximately one hundred feet (100') seaward of the adopted CCSL; and WHEREAS, previously approved structures fill and have established a reasonably continuous and uniform construction line closer to the line of mean high water than the adopted CCSL; and WHEREAS, the petition is consistent with the Collier County Land Development Code Division 3.13, as amended; and WHEREAS, the petition is consistent with the Collier County Growth Management Plan Conservation and Coastal Management Element. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that: Variance Petition CCSL-94-4 be approved subject to the following conditions: 1. A permit from the Florida Protection , Division of Beaches copy shall. be submitted to Environmental Review Staff within of the approval of this petition. Department of Environmental and Shores is required and a the Community Development one hundred twenty (120) days -1- JUNK 14, 1994 2. The petitioner shall re-vegetate the dune where the dune is devoid of coastal dune vegetation. The re-vegetation shall be completed according to a plan, submitted to and approved by Community Development Environmental Review staff within thirty (30) days of the approval of this petition. 3. Minor revisions to Coastal Construction Setback Line Variance CCSL-94-4 (including changes in siting and structures) may be approved, in writing, by the Site Development Review Director or hiS/her designee.
