RELATING TO PETITION NO. PU-90-26 FOR PROVISIONAL
USE OF PROPERTY HEREiNAFTER DESCRIBED IN COLLIER
COUNTY, FLORIDA.
WHEREAS, the Legislature of the State of Florida in Chapter
67-1246, Laws of Florida, and Chapter 125, Florida Statutes, has
conferred on Collier County the power to establish, coordi~~te
and enforce zoning and such business regulations as are
necessary for the protection of the public; and
WHEREAS, the County pursuant thereto has adopted a
Comprehensive Zoning Ordinance establiShing regulations for the
zoning of particular geographic divisions of the County, among
which is the granting of Provisional Uses; and
WHEREAS, the Collier County Planning Commission, being the
duly appointed and constituted planning board for the area
hereby affected, has held a public hearing after notice as in
said regulations made and provided, and has considered the
advisability of Provisional Use "a" in the "E" (Estates) zone
for a church and church related facilities on the property
hereinafter described, and has found as a matter of fact
(Exhibit "A") that satisfactory provision and arrangement has
been made concerning all applicable matters required by said
regulations and in accordance with Section 13.1.d of the Zoning
Regulations for the Collier County Planning Commission; and
WHEREAS, all interested parties have been given opportunity
to be heard by this Board in a pUblic meeting assembled and the
Board having considered all mattors presented.
NOW, THEREFORE BE IT RESOLVED, BY THE BOARD OF ZONING
APPEALS of Collier County, Florida that the petition filed by
Reno J. Spagna of Florida Urban Institute, Inc., representing
Unity.Faith Missionary Baptist Church with respect to the

Coimdssion in their public hearing on January 17, 1991..
1. .PLANNrNG SERVICES:
. a. Expansion ot the uses identitied and approved within
this Provisional Use application, or major chanqes to
the site plan submitted as part ot this application,
shall require submission ot a new Provisional Use
request and shall comply with all applicable County
ordinances in aftect at the time of submittal
includinq Section 10.5 ot Collier County Zoning
Ordinance No. 82-2.
2. WATER MANAGEMENT AND ENGINEERrNG:
a.
Design and construction of all improvements shall be
subject to compliance with the appropriate provisions
ot the Collier County Subdivision Requlations.
This project shall be required to meet all County
Ordinance in etfect at the time tinal construction
documents are submitted tor development appro~al.
A portion, not exceed 70' at the required parkinq,
may be developed with a qrass surface per the Collier
.County Zoninq Ordinance Section 8-12C. The driveway
aisles, however, shall be paved. All parkinq must be
considered paved tor stormwater purposes.

3. ENVIRONMENTAL:
a. Prior to preliminary site Development Plan approval,

CONSIDBRATIONSI This petition has been reviewed for
environmental, transportation, utilities, tire and other
engineering considerations. All agencies and statt involved
in the review process have provided a recommendation ot
approval, subject to the stipulations listed on the Agreement
Sheet.
In view ot the low trattic volumes generated by this proposed
church, the project's access should operate adequately and
with an acceptable level ot satety.
The Collier County Planning Commission reviewed this petition
on January 17, 1991, and based on their Findings ot Facts,
forwarded petition PU-90-26 to the Board ot zoning Appeals
with a unanimous recommendation ot approval, SUbject to the
stipulations in the Agreement Sheet.

,ISCAL IMPACTI This amendment by and ot itselt will have
no tiscal impact on the County. However, it this amendment
achiev.s its objective, the land will be developed. The .ere
fact that new development has been approved will result in a
future fiscal impact on county public facilities. The County
collects impact fees prior to the issuance of building
permits to help ott-set the impact ot each new development on
public facilities. These impact tees are used to fund
projects in the Capital Improvement Element needed to
aaintain adopted levels of service for public facilities. In
the event that impact tee collections are inadequate to
aaintain adopted levels ot service, the County must provide "
