Resolution 1993-137 " !1ARCH 30, 1993 RESOLUTION NO. 93--1l2 A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, WAIVING THE REQUIREMENTS THAT AN ANNUAL APPLICATION OR STATEMENT BE MADE FOR AGRICULTURAL CLASSIFICATION OF PROPERTY AFTER THE INITIAL APPLICATION IS MADE AND THE AGRICULTURAL CLASSIFICATION IS GRANTED; WAIVING THE REQUIREMENTS THAT AN ANNUAL APPLICATION OR STATEMENT BE MADE FOR HOMESTEAD EXEMPTION OF PROPERTY AFTER AN INITIAL APPLICATION IS MADE AND THE HOMESTEAD EXEMPTION IS GRANTED UNLESS THE PROPERTY IS SOLD OR OTHERWISE DISPOSED OF OR THE OWNERSHIP CHANGES IN ANY MANNER OR THE APPLICANT CEASES TO USE THE PROPERTY AS HIS HOMESTEAD, AND WAIVING THE ANNUAL APPLICATION FOR WHOLLY EXEMPT PROPERTIES AFTER AN INITIAL APPLICATION IS MADE AND APPROVED UNLESS THE THE STATUS OF THE OWNER OR USE OF THE PROPERTY CHANGES ON THE WHOLLY EXEMPT PROPERTIES SO AS TO CHANGE THE EXEMPT STATUS OF THE PROPERTY. WHEREAS, the Board of County Commissioners on October 20, 1987 approved waiving t~e requirements that an annual application or statement be made for homestead exemption of property after an initial application is made and the homestead exemption is granted unless the property is sold or otherwise disposed of or the ownership changes in any manner or the applicant ceases to use the property as his homestead; and WHEREAS, the Florida Legislature during the 1990 Legislative Session amended Section 193.461, Florida Statutes, which provides that the Board of County Commissioners may, at the request of the Property Appraiser, waive the requirement that an annual application or statement be made for classification of agricultural property within the county after an initial application is made and the agricultural classification is granted; and WHEREAS, the Board of County Commissioners on January 7, 1992 adopted County Resolution No. 92-10 waiving the requirements for an annual application or statement for homestead exemption, agricultural classification of property and wholly exempt properties after the initial application has been made and approved unless the property is sold or otherwise disposed of or the ownership changes in any manner which would change the exempt status of the property; and &001( obo PA'.! 287 .~ MARCH 30, 1993 WHEREAS, the Board of County Commissioners of Collier County, Florida, finds it in the best interest of the citizens of Collier County to approve the request of the Property Appraiser to clarify the County's position to waive the requirements for an annual application for the agricultural classification, wholly exempt properties and homestead exemption. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that: 1) Pursuant to Section 193.461, Florida statutes (1992), the requirement of an annual application or statement is hereby waIved for the classifi~ation of agricultural property after the initial application is made and the agricultural classification has been granted by the Property Appraiser or the Value Adjustment Board. 2) Pursuant to Section 196.011, Florid~ Statutes (1992), the requirement of an annual application or statement is hereby waived for homestead and wholly exempt properties after an initial application is made and the homestead and wholly exempt status is granted by the Property Appraiser or the Value Adjustment Board. The property owner must refile for homestead exemption, in accordance with Chapter 196, Florida Statutes, (1992), if the homestead property is sold or otherwise disposed of, the ownership changes in any manner, or the applicant for homestead exemption ceases to use the property as his or her homestead. When the status of the owner or use of the property changes on wholly exempt property so as to change the exempt status of the property, the applicant must refile for said exemption pursuant to Chapter 196, Florida statutes, (1992). 3) The Clerk to the Board shall provide the Property Appraiser with a certified copy of this Resolution.
