UTILITY EASEMENT AGREEMENT

THIS EASEMENT is hereby granted this ~ day of
~ r.JN"lA~ , 1992, by RADNOR/LAKESIDE CORPORATION, a Delaware
corporation (herein referred to as Grantor), the record owner of
property described in Exhibit "A", and located in Col1ier County,
Florida, to The Board of County Commissioners as the Governing
Body of Col1ier County, and as Ex-Officio the Governing Board of
the Collier County Water-Sewer District, its successors and
assigns, a Political Subdivision of the State of Florida, Florida
Power & Light Company, United Telephone Company, Cable
Television, and all other utility providers (herein referred to
collectively as Grantee).
For and in consideration of the sum of Ten and no/l00
($10.00) Dollars and other good and valuable consideration, the
receipt of which is hereby acknowledged, the Grantor hereby does
grant, sell and convey unto Grantee an Easement over, across and
under the property described in Exhibit "A", all under the terms
and conditions as set forth below~
1. The easement, rights and privileges herein granted to
Collier County shall be used only for the purpose of installing
and maintaining all water and sewer facilities and ingress and
egress for such purposes. Such water and sewer facilities to be
deeded to Collier County upon acceptance of the improvements by
Collier County on the Exhibit "A- property.
2. The easement, rights and privileges herein granted to
Florida Power & Light Company, United Telephone Company, Cable
Television and all other utility providers shall be used only for
the purpose of installation and maintenance of their respective
facilities and ingress and egress for such purposes.
3. The easement, rights and privileges herein granted
shal1 be perpetual.
4. The easement, rights and privileges granted herein are
nonexclusive, and Grantor reserves and retains the right to
convey similar rights and easements to such other persons or
entities as Grantor may deem proper. Grantor agrees to notify
Grantee of any such conveyance.
5. In addition to the easement, rights and privileges
herein conveyed, Grantee shall have the right to use so much of
the surface of the above described property of Grantor as may be
reasonably necessary to construct, install, repair or replace
within the easement granted hereby, the facilities contemplated
by this grant. Upon the completion of such construction,
installation, restoration or replacement, Grar"tee shall replace
and restore all vegetation, landscaping, pavement, or other
pipelines and equipment within the area cover.ed by this grant
which were installed by other persons or entities to whom Grantor
may have conveyed similar easement rights, which may have been
disturbed, defaced, damaged, relocated or removed by Grantee
during the construction period.
6. Grantor also retains, reserves, and shall continue to
enjoy use of the property which is the subject of this grant for
any and all purposes which do not interfere with and prevent the
use by Grantee of the within easement. If the Grantor or any of
Grantor's successors or assigns shall dedicate all or any part of
the property affected by this easement, the Grantee and its
successors and aSSigns shall execute all instruments that may be
necessary or appropriate to effectuate such dedication, without,
however, extinguishing the easement rights herein granted.

corporation (herein referred to as Grantor), the record owner of
property described in Exhibit "A", and located in Collier County,
Florida, to COLLIER COUNTY, its successors and assIgns, a
Political Subdivision of the State of Florida and LAKESIDE OF
NAPLES RESIDENTS' ASSOCIATION, INC. (herein referred to
collectively 4S Grantee).
For and In consideration of the sum of Ten and no/lOa
($10.00) Dollars and other good and valuable consideration, the
receipt of which is hereby aCknowledged, the Grantor hereby does
grant, sell and convey unto Grantee an Easement over, across and
under the property described in Exhibit "A", all under the terms
and conditions AS set forth below!
1. The easement, rights and privileges herein granted
shall be used only for the purpose of placing, constructing,
operating, repairing, maintaining, rebuilding, replacing and
removing drainage facilities on the Exhibit "A" property.
2. Collier County shall have no maintenance responsibility
with respect to the drainage easement and drainage facilities.
Lakeside of Naples Residents' ^98ociation, Inc. shall have the
maintenance responsibility for the drainage easement and all
drainage facilities within said easement.
3. The easement, rights and privileges herein granted
shall be perpetual.
4. The easement, rights and privileges granted herein are
nonexclusive, and Grantor reserves and retains the right to
convey similar rights and easements to such other persons or
entities as Grantor may deem proper. Grantor agrees to notify
Grantee of any such conveyance.
5. In addition to the easement, rights and privileges
herein conveyed, Grantee shall have the right to use so much of
the surface of the above described property of Grantor as may be
