RESOLUTION NO. 93- 67
FEBRUARY 23, 1993
A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS
PROVIDING FOR ASSESSMENT OF LIEN, FOR THE COST OF
THE ABATEMENT OF PUBLIC NUISANCE, IN ACCORDANCE
WITH ORDInANCE 91-47.
WHEREAS, as provided in Ordinance 91-47, the direct costs of
abatement of certain nuisances, including prescribed administrative
cost incur.red by the County, shall be assessed against such property;
and
WHEREAS, the cost thereof to the County as to each parcel shall be
calculated and reported to the Board of County Commissioners, together
with a de9cription of said parcel; and
WHEREAS, such assessment shall be a legal, valid and binding
obligation upon the property against which made until paid; and
WHEREAS, the assessment shall become due and payable thirty (30)
days after the mailing of Notice of Assessment after which interest
shall accrue at a rate of twelve percent (12.0%) per annum on any
unpaid portion thereof.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that the property described
as follows, 'and having been abated of a public nuisance after due and
proper no~ice thereof to the owner of said property, is hereby assessed

LEGAL DESCRIPTION:
B~ginning at the Northeast corner of the West 380 teet, at
the East 1070 feet of the North half (N1/2) at the Southeast quarter
(SEl/4) of the Southeast quarter (SEl/4) of Section 4, Township 47
South, Range 29 East; thence run South along the East boundary line
of said tract a distance of one hUndred (100) feet to the point of
beginning of the tract herein conveyed; thence continue South along
said East boundary line a distance of fifty (SO) feet, thence run
West one hundred twenty (120) feet; thence run North fifty (SO)
feet; th~nce run East one hundred twenty (120) feet to the point of
beginning.
Said property being also described as Lot 2 of a map ot a
subdivision proposed to be recorded by the grantors hereof under the
name LAXrlIEW PROPERTIES.

The Clerk of the Board shall mail a notice of ~ssessment of lien
to the owner or owners of the above described property, and if such
owner fails to pay such assessment within thirty (30) days hereof, a
certified copy of this Resolution shall be filed in the Office of the
Clerk of Courts, in and for Collier County, Florida, to constitute a
lien against such property according to law, unless such direction is
stayed by this Board upon appeal of the assessment of the owner.

Property Appraiser, are hereby advised that the Compliance
Services Manager, did on 1/27/92, order the abatement of a
certain nuisance existing on the above property prohibited by
Ordinance 91-47, serving notice thereof upon you, such
nuisance being:
Prohibited accumulation ot non-protected mowable
vegetation in excess of 18" in height in a subdivision
other than Golden Gat. Estates. Prohibited dumping,
accumulation, storage or burial of litter, wast. or
abandoned property.
You failed to abate such nuisance; whereupon, it was abated
by the expenditure of public funds at a direc". cost of
$95.00 and administrative cost of $200.00 for a total of
$295.00. Such costs, by Resolution of the Board of County
Commissioners of Collier County, Florida, have been assessed
days after such
assessment.

You may request a hearing before the Board of County
CO~iBsioners to show cause, if any, why the expenses and
charges incurred by the County under this Ordinance are
unwarranted or excessive or why such expenses should not
constitute a lien against the property. Such request for
hearing must be made to the Clerk of the Board of County
Comuissioners, Government Center, Naples, Florida 33962 in
writing within thirty (30) days from the date of this
assessment to be valid.
