',' RESOLUTION NO. 94- 356 A RE30LUTION AUTHORIZING THE ACQUISITION OF NON- EXCLUSIVE PERPETUAL DRAINAGE EASEMENTS AND TEMPORARY CONSTRUCTION EASEMENTS FOR THE CONSTRUCTION OF THE ROADWAY FOUR-LANING OF BONITA BEACH ROAD PHASE II (BETWEEN FORESTER ROAD AND VANDERBILT DRIVE) . WHEREAS, the Board ot county Commissioners on October 26, 1993 adopted ordinance No. 93-78 and Resolution No. 93-493 establiShing the 1993 (Fitth Annual) capital Improvement Element of the Growth Management Plan in order to establish priorities for the design, acquisition and construction ot the various capital t.provement projects which comprise the Transportation Element ot the County's Comprehensive Plan; and WHEREAS, the tour-laning improvements to Bonita Beach Road between Forester Road and Vanderbilt Drive are component parts ot the Transportation Element ot the County's Comprehensive Plan; and WHEREAS, the Board ot county commissioners on December 7, 1993 adopted Resolution No. 93-550 authorizing the county Staff to acquire by gift or purchase certain easements and fee simple title ~ the property and property interests required and necessary for the four-lane construction ot Bonita Beach Road Phase II between Forester Road and Vanderbilt Drive; and WHEREAS, the county Staff has evaluated alternative locations, reviewed the environmental tactors, considered the cost variables, and analyzed the safety and welfare considerations as they relate to the construction ot the four-lane improvements for Bonita Beach Road Phase II, between Forester Road and Vanderbilt , ,. Drive; and WHEREAS, the County Statt has recommended that it is necessary and in the best interest of Collier county, Florida, to acquire certain non-exclusive perpetual drainage easements and temporary construction easements are required and necessary for the construction of the four-laning of Bonita Beach Road Phase II, between Forester Road and Vanderbilt Drive; and WHEREAS, the construction of the four-laning of Bonita Beach "'~"""-'--T~-~-'---"'"'-'-------~~'-'^ li!t:, I~/ 'i,t: ~jt ',~' I " ~.~ !: 1E 'l.:l! ;ri~ '4{~.:- P:' 1;-"'- ~' , 1',," " Road Phase II, between Forester Road and Vanderbilt Drive is necessary in order to protect the health, satety and welfare of the citizens of collier county and is in the best interest of COllier county. BOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COKKISSIO!fERS OF COLLIER COUNTY, FLORIDA, that it has been deterained by the Board that the construction of the four-laning of Bonita Beach Road Phase II, between Forester Road and ~ ;1" ,. "c. j' ji ~ Vanderbilt Drive (hereinafter referred to as "the Project") is necessary for a public purpose and is in the best interests of Collier county. Drive. ! ARD IT IS FURTHER RESOLVED that the County staff is hereby authorized to immediately acquire by gift, purchase or condemnation in accordance with the provisions of Chapters 73, 74 and 127, Florida statutes, certain non-exclusive perpetual drainage easements and temporary construction easements more particularly described in Exhibit "A", attached hereto and I': incorporated herein. aDDK oca P~',! 51 KAY 17. 1994 ARD IT IS FURTHER RESOLVED that no mobile homes are located on the property sought to be acquired and therefore it will not be necessary to remove any mobile homes from the property to be acquired .
