RESOLUTION NO. 94- 355
A RESOLUTION AUTHORIZING THE ACQUISITION OF LAND
IN FEE SIMPLE FOR THE ROAD RIGHT-OF-WAY FOR THE
CONSTRUCTION OF THE ROADWAY FOUR-LANING OF BONITA
BEACH ROAD PHASE II (BETWEEN FORESTER ROAD AND
VANDERBILT DRIVE).
WHEREAS, the Board ot County commissioners on October 26,
1993 adopted ordinance No. 93-78 and Resolution No. 93-493
..tablishinq the 1993 (Fitth Annual) capital Improvement Element
ot the Growth Manaqement Plan in order to establish priorities tor
the desiqn, acquisition and construction ot the various capital
taprovement projects which comprise the Transportation Element ot
the county's Comprehensive Plan; and
WHEREAS, the four-laninq improvements to Bonita Beach Road
between Forester Road and Vanderbilt Drive are component parts ot
the Transportation Element of the County's comprehensive Plan; and
WHEREAS, the Board ot County Commissioners on December 7,
1993 adopted Resolution No. 93-550 authorizinq the county Staff to
acquire by qift or purchase certain easements and fee simple title
to the property and property interests required and necessary for
the four-lane construction ot Bonita Beach Road Phase II between
Forester Road and Vanderbilt Drive; and
WHEREAS, the County Staff has evaluated alternative
locations, reviewed the environmental factors, considered the cost
variables, and analyzed the safety and weltare considerations as
they relate to the construction of the four-lane improvements for
Bonita Beach Road Phase II, between Forester Road and Vanderbilt
Drive; and
WHEREAS, the County Staff has recommended that it is
necessary and in the best interest ot Collier county, Florida, to
acquire all of the road riqht-ot-way required and necessary for
the construction of the four-laninq of Bonita Beach Road Phase II,
between Forester Road and Vanderbilt Drive in fee simple; and
WHEREAS, the construction of the four-laninq of Bonita Beach
Road Phase II, between Forester Road and Vanderbilt Drive is

necessary in order to protect the health, safety and welfare ot
the citizens of Collier county and is in the best interest of
COllier county.
.OW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
OOKKISSIONERS OF COLLIER COUNTY, FLORIDA, that it has been
deterained by the Board that the construction ot the four-laninq
of Bonita Beach Road Phase II, between Forester Road and
Vanderbilt Drive (hereinafter reterred to as "the Project") is
necessary for a public purpose and is in the best interests of
COllier County.
AND IT IS FURTHER RESOLVED that the Board reviewed the Statf
analysis reqardinq alternative locations, environmental factors,
cost variables, safety and weltare considerations as they relate
to the construction of the Project and finds that the most
feasible locations for the additional road right-Of-way are
described in Exhibit "A" attached hereto; and
AND IT IS FURTHER RESOLVED that to implement said
construction of the Project it is appropriate and necessary for
the Board to acquire fee simple title in the lands as described in
Exhibit "A", attached hereto and incorporated herein, to be used
as road right-Of-way for the construction ot the four-lane
iaprovements to Bonita Beach Road Phase II, between Forester Road
and Vanderbilt Drive.
AND IT IS FURTHER RESOLVED that the County staff is hereby
authorized to immediately acquire by gitt, purchase or
condemnation in accordance with the provisions of Chapters 73, 74
and 127, Florida Statutes, fee simple title to the property more
particularly described in Exhibit "A", attached hereto and
incorporated herein.
AND IT IS FURTHER RESOLVED that no mobile homes are located
on the property souqht to be acquired and therefore it will not be
necessary to remove any mobile homes from the property to be
acquired.
