RESOLUTION AUTHORIZING THE NORTH NAPLES FIRE AND
RESCUB DISTRICT TO UTILIZE COUNTY OWNED PROPERTY,
LOCATED ADJACENT TO THE CURRENT COUNTY LIBRARY ON
VANDERBILT BEACH DRIVE, IN ACCORDANCE WITH THE
ATTACHED LEASE AGREEMENT.
WHEREAS, Collier County is the owner of the certain property
described in that Quit-Claim Deed recorded in Official Record Book
1338, Page 50 of the Public records of Collier County, Florida and
again described in Exhibit "A" of the attached Lease Agreement,
hereinafter referred to as nproperty", and
WHEREAS, the North Naples Fire and Rescue District (District)
is desirous of entering into a Lease Agreement with Collier County to
utilize said Property for a period of thirty (30) years, with a
renewal option of four (4) additional ten year terms, for the sole
purpose of operating a fire and rescue station, and
WHEREAS, in lieu of rent payments, the District shall: (1)
Provide fire and rescue services when such need arises, for the sole
purpose of protecting the lives and property of citizens located
within the North Naples Fire and Rescue District area (service area);
(2) Upon written request by the County for emergency service space at
any existing facility owned by the District, the District may provide
such space in its sole discretion and upon terms mutually agreeable.
District agrees such terms shall include nominal rental payments,
and,
WHEREAS, both parties have reviewed and approved the terms and
conditions for the use of the Property, as outlined on the attached
Lease Agreement, and
WHEREAS, the Lease Agreement has been reviewed by the County
Attorney's Office and Risk Management Department, and
WHEREAS, Section 125.38, Florida Statutes, provides that the
Board of County Commissioners may lease property to the state of
Florida or any political subdivision or agency thereof if the Board
is satisfied that such property is required for such use and is not
needed for County purposes. Advertising of' said lease property shall
not be required.
NOW, THEREFORE BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS, COLLIER COUNTY, FLORIDA that:
1. The Property is required by the District for use as a fire
and rescue station.
2. The Property is not needed for County purposes.
3. Collier County shall enter into the Lease Agreement with
the' District, and the District is hereby authorized to use the
Property for the purpose of operating a fire and rescue station in
accordance with the terms and conditions stated in the Lease
Agreement attached hereto.
