RESOLUTION 01" THE BOARD 01" COUNTY
COMMISSIONERS, COLLIER COUNTY, FLORIDA,
AUTHORIZING PAYMENT 01" 25\ LIBRARY SYSTEM
IMPACT FEES, PARKS AND RECREATIONAL FACILITIES
IMPACT FEES, ROAD IMPACT FEES, EMERGENCY
MEDICAL SERVICES SYSTEM IMPACT FEES AND
EDUCATIONAL FACILITIES SYSTEM IMPACT FEES FOR
ONE HOUSE TO BE CONSTRUCTED BY JOSE AND
SOLEDAD C. ROSALES, ON 5119 BASS ROAD, LAKE
TRAFFORD SHORES, UNIT 1, BLOCK C, LOT 10,
COLLIER COUNTY, IMMOKALEE, FLORIDA.
WHEREAS, Collier County has recoqnized and attempted to
address the lack ot adequate and attordable housinq tor moderate,
low, and very-low income households in the County and the need
tor creative and innovative proqrams to assist in the provision
ot such housinq by includinq several provisions in the Collier
county Growth Manaqement~Plan, includinq: objective 1.4, policy
1.4.1; objective 1.5, policy 1.5.2, policy 1.5.3, policy 1.5.4,
policy 1.5.5, policy 1.5.6; objective 1.6, pOlicy 1.6.3;
objective 2.1, policy 2.1.1, policy 2.1.2, policy 2.1.3, policy
2.1.5, and pOlicy 2.1.6 ot the Housinq Element; and
WHEREAS, Collier county has received tundinq pursuant to the
State Housinq Initiatives Partnership Program set torth in
Section 420.907 et. sea., Florida Statutes and Chapter 91-37,
Florida Administrative Code; and
WHEREAS, in accordance with Collier County Ordinance No.
93-19, the County is authorized to use tundinq trom the State
Housinq Initiatives Partnership [SHIP] proqram tor deterral ot
Collier County impact tees; and
WHEREAS, Jose and Soledad c. Rosales are seekinq a deterral
ot 25\ ot impact tees; and
WHEREAS, JOBe and Soledad C. Rosales will construct one (1)
three-bedroom unit (the "OWellinq Unit") on 5119 Bass Road, Lake
Trattord Shores, Unit 1, Block C, Lot 10, Collier County,
I..okalee, Florida which i. proposed to cost Fitty-Four Thousand
Five Thousand Dollar. ($54,500.00); and
WHEREAS, the OWellinq Unit will be owned by a moderate'
income household; and

WHEREAS, Joe. and Soledad C. Rosales submitted to the county
Kanaqer's otfice an Affordable Housinq Application dated
April 11, 1994 tor a deterral ot impact tees tor the construction
ot a house on 5119 Bass Road, Lake Trafford Shores, Unit 1, Block
C, Lot 10, Collier county, IlIIlDokalee, Florida, a copy ot said
application is on tile in the Housinq and Urban Improvement
DepartJlent; and
WHEREAS, Section 3.04 ot the Library system Impact Fee
ordinance, Ordinance No. 88-97, as amended; Section 4.05 of the
Parks and Recreational Facilities Impact Fee Ordinance, Ordinance
No. 88-96, ae amended; Section 3.04 ot the Road Impact Fee
ordinance, Ordinance No. 92-22, as amended; Section 3.04 of the
Eaerqency Medical services system Impact Fee ordinance, Ordinance
No. 91-71, as amended; and Section 3.05 of the Educational
Facilities system Impact Fee Ordinance, Ordinance No. 92-33, as
aaended; an applicant may obtain a deferral ot 25\ impact tees by
qualityinq tor a deterral; and
WHEREAS, Jose and Soledad C. Rosales have qualitied tor a
25\ impact tee deferral based upon the followinq representations
liade:
A. The owellinq Unit shall be owned by a tirst-time home
buyer.
B. The owellinq Unit shall be owned by a household with a
moderate income level as those terms are detined in the
Appendices to the respective Impact Fee Ordinances and
the monthly payment to purchase the unit must be within
the attordable housinq guidelines established in the
AppendiceB to the respective Impact Fee ordinances.
c. The OWellinq Unit Bhall be the Homestead ot the owner.
D. The owellinq Unit shall remain affordable tor tifteen
(15) years trom the date the certificate ot occupancy
is issued, unless the impact fee is repaid to the
COUNTY.

llOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMKISSIONERS OF COLLIER COUNTY, FLORIDA, that:
1. The Board ot County COIIIlDiseioners hereby authorizee the
County Manaqer to iesue an Authorization tor deterral
ot impact tees to Jose and soledad C. Rosales tor one
(1) house located at 5119 Bass Road, Lake Trattord
Shores, unit 1, Block C, Lot 10, Collier county,
Florida.
upon receipt by the Housinq and Urban Development
Director ot an oriqinal purchase contract tor the
purchase ot the owellinq Unit siqned by the purchaser,
or other documentation acceptable to the County
Attorney, the Board ot County cOIIIlDissioners hereby
authorizes the payment by Collier County ot the
tOllowinq impact tees trom the Attordable Housinq Trust
Fund, Fund (191), in the tollowinq amounts tor the one
(1) house to be built on 5119 Bass Road, Lake Trattord
Shoree, Unit 1, Block C, Lot 10, Collier County,
Florida:

C. Parks and Recreational Facilities
