RESOLUTION AUTHORIZING THE CHAIRMAN OF THE BOil-1lQ. p~
COUNTY COMMISSIONERS TO EXECUTE A CONSERVATION EK5Jffi~lf~S
TO THE SOUTH FLORIDA WATER MANAGEMENT DISTRICT TO RETAIN
A" CONSERVATION AREA EXCLUSIVELY AS SUITABLE HABITAT FOR
FISH, PLANTS AND WILDLIFE AS PART OF THE GOLDEN GATE
PARKWAY SIX LANING PROJECT.
WHEREAS I Collier County ("County") is desirous to construct
the Golden Gate Parkway Six Laning Project (lIproject"). said
Project will impact wetlands under the regulatory jurisdiction
of the South Florida Water Management District ("District").
WHEREAS, the District Surface Water Management Permit No.
11-01304-$ ("Permit") authorizes activities which affect surface
waters in the State of Florida:
WHEREAS, the County has developed and proposed as part of the
permit conditions a conservation tract and maintenance buffer
involving preservation of certain wetland systems on the
Property identified in the Conservation Easement ("Property");
and
WHEREAS, the County, in consideration of the consent granted
by the Permit, is agreeable to granting and securing to the
District a perpetual conservation easement as defined in Section
704.06, Florida Statutes (1993), over the Property.
NOW, THEREFORE BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA that in consideration
of the issuance of the Permit to construct and operate the
permitted activity, the County hereby grants, crl?:ates, and
establishes a perpetual conservation easement for the District
upon the Property which shall run with the land and be binding
upon the County, its successors and assigns, and shall remain in
full force and effect forever.
AND IT IS FURTHER RESOLVED that the Board of County
Commissioners does hereby approve the attached Conservation
Easement to the South Florida Water Management District.
AND IT IS FURTHER RESOLVED that the Chairman of the Board of
County Commissioners of Collier County, Florida, is hereby
authorized to execute the attached Conservation Easement to the
South Florida Water Management District.
This Resolution adopted after motion, second and majority
