RESOLUTION NO. 95-245
RESOLUTION FOR PETITION AV 94-018 TO VACATE
AND EXTINGUISH A 60 FOOT ROAD, UTILITY AND
DRAINAGE EASEMENT LOCATED ON A PARCEL OF LAND
LYING IN SECTION 11, TOWNSHIP 50 SOUTH, RANGE
26 EAST, AS RECORDED IN O.R. BOOK 824, PAGE
214, OF THE PUBLIC RECORDS OF COLLIER COUNTY,
FLORIDA.

WHEREAS, pursuant to Section 336.09, Florida
MeAnly, Asher' Associates, P.A., as agent for owner, Clyde C.
Quinby, Trustee, does hereby request the vacation of 60 foot
road, utility, and drainage easement as recorded in O.R. Book
306, Page 530, of the Public Records of Collier County, Florida:
and
WHEREAS, the Board has this day held a public hearing to
consider vacating said 60 foot road, utility, and drainage
easement as more fully described below, and notice of said public
hearing to vacate was given as required by law: and
WHEREAS, the granting of the vacation will not adversely
affect the ownership or right of convenient access of other
property owners.
WHEREAS, the vacation would benefit the general public
welfare and is in the best interest of the pUblic in the
following particulars:
1. The pUblic benefit is the grant of an easement over the
north 30 feet of the NE 1/4 of NE 1/4 of Section 11, TownShip 50
South, Range 26 East.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that the following be
and is hereby vacated:
See Exhibit "A" attached hereto and incorporated herein.
BE IT FURTHER RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS
OF COLLIER COUNTY, FLORIDA, that the road right-of-way easement
more particularly described in Exhibit "Bn attached hereto and
incorporated herein is hereby accepted as the replacement
easement for the 60 foot road, utility and drainage easement
vacated hereupon.

The Board of County Commissionen of Collier County, Florida, its successors and
assigns, as Grantee,
WITNESSETH:
GrantrJr, for and in consideration of TEN DOLLARS and other valuable
consideration paid by the Grantee, the receipt and sufficiency of which is hereby
acknowledged, hereby conveys, grants, bargains, and sells unto the Grantee, its successors
and assigns, a perpetual, non-exclusive easement, license, and privilege for public road,
drainage, and utility purposes on the following described lands in Collier County. to wit:

Subject to easements, restrictions. and reservations of record.
