RESOLUTION NO. 95-~
A RESOLUTION RELEASING AND SATISFYING TAX
PARCEL NO. 99 WITHIN THE NAPLES PRODUCTION
PARK IMPROVEMENT ASSESSMENT DISTRICT FROM THAT
CERTAIN SANITARY SEWER ASSESSMENT ADOPTED BY
RESOLUTION NO. 93-324.
WHEREAS, the Board of County Commissioners of Collier County,
Florida (hereinafter referred to as COUNTY) adopted Ordinance No.
85-39 which created the Naples Production Park Municipal Service
Taxing and Benefit Unit for the purpose of constructing road
improvements, drainage improvements, water distribution system and
sanitary sewer system (hereinafter referred to as the PROJECT);
and
WHEREAS, on August 7, 1990, the Board of County Commissioners
adopted Resolution No. 90-409 initiating a program for the purpose
of providing for the construction or reconstruction of the Project
and the cost of said improvements to be paid by a special
assessment against the benefited properties within the Naples
Production Park Improvement Assessment District; and
WHEREAS the Board of County Commissioners on June 29, 1993
adopted Resolution No. 93-268 fixing the date, time and place for
the public hearing to approve the preliminary assessment roll and
to adopt the non-ad valorem assessment roll to utilize the uniform
method of collection pursuant to Section 197.3632, Florida
Statutes; and
WHEREAS, said public hearing was duly advertised and
regularly held, at the Board of County Commissioners meeting room,
Building "F", Third Floor, 3301 East Tamiami Trail, Naples,
Florida on July 27, 1993 and August 3, 1993; and
WHEREAS, the Board of County Commissioners on August 3, 1993
adopted Resolution No. 93-324 confirming the preliminary
assessment roll as the final assessment roll; and
WHEREAS, Resolution No. 93-324 is recorded in OR Book
1853, Pages 00001 through 000054, inClusive, of the Official
Records of Collier County, Florida; and
WHEREAS, the special assessments constitute a lien upon the
property assessed and described in Resolution No. 93-324; and

WHEREAS, Resolution No. 93-324 contained a sanitary sewer
assessment for Tax Parcel No. 99 in the principal amount of
$6,769.06; and
WHEREAS, it has now been determined that Tax Parcel No. 99
previously received sanitary sewer service and, therefore, did not
receive a benefit from the sanitary sewer improvements constructed
as part of this project.
NOW, THEREFORE, BE IT RESOLVED BY THE !lOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that:
SECTION ONE. The special assessment for the sanitary sewer
improvements contained in Resolution No. 93-324 for Tax Parcel No.
99, Section 36, Township 49 South, Range 25 East, Property Folio
No. 00275600002 in the principal amount of $6,769.06 is hereby
released and satisfied.
SECTION THO. The special assessments for the paving/Drainage
Improvements in the principal amount of $16,468.27 and the potable
water improvements in the principal amount of $3,463.20 shall
remain as a lien on Parcel No. 99, Property Folio No. 00275600002
until paid in full in accordance with Resolution No. 93-324 that
is recorded in OR Book 1853, Pages 00001 through 000054, inclusive
of the Official Records of Collier County, Florida.
SECTION THREE. The Clerk is hereby directed to record this
Resolution in the Official Records of collier County.
SECTION FOUR. This Resolution shall become effective
immediately upon its passage.
This Resolution adopted after motion, second and majority
vote.
