RESOLUTION NO. 95-238
RESOLUTION BY THE BOARD OF COUNTY COMMISSIONERS OF
COLLIE!!. COllNTY, FLORIDA, AUTHORIZING THE SALE OF
COUNTY OVNED PROPERTY TO THE FLORIDA DEPARTMENT OF
TRANSPORTATION FOR ROADWAY IMPROVEMENTS
WHEREAS. the State of Florida Department of Transportation proposes to
construct or improve State Road No. 90, Section No. 03010-2554, in Collier County,
norida; and
WHEREAS, it is necessary that certain lands. described in Exhibit "A",
owned by Collier County be acquired by the State of Florida Department of
Transportation; and
WHEREAS. the SCate of Florida Department of Transportation has made
application to the County to execute and deliver to the State of Florida
Department of Transportation, a deed In favor of the SCate of Florida Department
of Transportation, conveying all rights, title and interest that the County has in
and to the lands required for transportation purposes, and the request having been
duly considered.
WHEREAS, the lands described in Exhibit ~A" are required for State
transportation purposes and it is not needed for County purposes.
NOll, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
COLLIER COUN'IY, FLORIDA, the application of the State of Florida Department of
Transportation for a deed is for transportation purposes which are in the public
or community interest and for public welfare and the land needed for
transportation purposes; that a deed in favor of the State of Florida Department
of Transportation conveying all right, title and interest of Collier County in and
to the lands herein described, shall be executed by this Board of County
Commissioners. Consideration shall be $20,000.00
This Resolution adopted after motion, second, and majority vote.
BE IT FURTHER RESOLVED. that a certified copy of this resolution be
forwarded forthwith to the State of Florida Department of Transportation at
Tallahassee; Florida.

PURCHASER must expend to clear encumbrances shall be deducted at closing from the purchase price shown in

SPECIAL ASSESSMENT AGREEMENT
THIS AGREEMENT, made and entered into on this 15TH day
of JlJNF. , 19~, by and between Timothv G. Hains. Trustee
hereinafter referred to as "PROPERTY OWNER",
the COLLIER COUNTY BOARD OF COUNTY COMMISSIONERS, AS EX-OFFICIO
THE GOVERNING BOARD OF THE COLLIER COUNTY WATER-SEWER DISTRICT,
hereinafter referred to as "COLLIER COUNTY WATER-SEWER DISTRICT"
and the STATE OF FLORIDA DEPARTMENT OF TRANSPORTATION,
hereinafter referred to as the DEPARTMENT OF TRANSPORTATION.

WHEREAS, the DEPARTMENT OF TRANSPORTATION is proposing to
construct transportation improvements to State Road 90; and

WHEREAS, various property owners own and occupy lands that
abut or are included in the area of the proposed improvements to
State Road 90; and
WHEREAS, the COLLIER COUNTY WATER-SEWER DISTRICT has constructed
certain sanitary sewer improvements within the public rights-of-
way and/or utility easements adjacent to and adjoining certain
properties that are included in the area of the proposed
improvements to State Road 90; and
WHEREAS, the COLLIER COUNTY WATER-SEWER DISTRICT adopted an
appropriate Resolution pursuant to Chapter 153, Part II, Florida
Statutes and Chapter 88-499, Special Act, Laws of Florida, which
levied a special sewer assessment against certain properties
receiving a special benefit from the construction of the sanitary
sewer improvements within the East and South Naples Sanitary
Sewer System; and
WHEREAS, the above referenced special sewer assessment liens
have been levied against certain properties within the area of
the proposed improvements to State Road 90; and
WHEREAS, the DEPARTMENT OF TRANSPORTATION is acquiring the
additional right-of-way in fee simple, free and clear of all
liens, mortgages and encumbrances; and
WHEREAS, pursuant to Chapter 153, Part II, Florida Statutes,
the sewer special assessment liens are a lien on the property
until paid in full and the COLLIER COUNTY WATER-SEWER DISTRICT
has no objection to the sewer special assessment lien encumbering
that portion of the PROPERTY OWNER'S remainder tract.

NOW, THEREFORE, in consideration of the mutual covenants set
forth, the parties agree as follows:
1) The PROPERTY OWNER understands and agrees that upon the
acquisition by the DEPARTMENT OF TRANSPORTATION of any
portion of the owner's property, as described in
Exhibit "A" attached hereto and incorporated herein,
the above described sewer special assessment lien shall
encumber that portion of the PROPERTY OWNER'S remainder
tract. The PROPERTY OWNER further understands that the
sewer special assessment lien shall run with the title
to the property and remain a lien on the remainder
tract until the lien is paid in full. The property
acquired by the DEPARTMENT OF TRANSPORTATION does not
in any way change or alter the special sewer benefit
received by the remainder tract as a result of the
construction of the sanitary sewer system, and that the
acquisition by the DEPARTMENT OF TRANSPORTATION does
not in any way change or alter the total amount of the
sewer special assessment.
2) The PROPERTY OWNER agrees that the balance of the sewer
special assessment lien is the sole responsibility of

3) The property being acquired ~y the DEPARTMENT OF
TRANSPORTATION as described ~n Exhibit "A" attached
hereto shall be free and clear of the sewer special
assessment lien upon recording of this document in the
Official Records of Collier county, Florida.
4) The COLLIER COUNTY WATER-SEWER DISTRICT has no
objection to this Agreement and hereby authorizes
its Chairman to sign the SEWER SPECIAL ASSESSMENT
AGREEMENTS for roadway improvements to State Road 84 or
state 90 without further action from the Board of
County Commissioners of Collier County, Florida as Ex-
Officio the Governing Board of the Collier County
Water-Sewer District.
This Agreement is binding on and inures to the benefit of
the parties and their respective legal representatives,
successors and assigns.
