A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS
OF COLLIER COUNTY, FLORIDA CANCELING THE
REMAINING 1994 TAXES UPON LAND ACQUIRED FOR
PUBLIC PURPOSE.
WHEREAS, property known as the Pelican Bay Community Park,
located at the southwest corner of Vanderbilt Beach Road and Hammock
Oak Drive, also known as Parcel "A", Pelican Bay Unit Nineteen,
according to the plat thereof recorded in Plat Book 22, Pages 15 and
16 of the Public Records of Collier County, Florida, was conveyed for
no monetary compensation to Collier County by Special Warranty Deed
for public purposes;
WHEREAS, the Special Warranty Deed was recorded in O.R. Book
1990, Pages 2087, et seq, of the Public Records of Collier County,
Florida, on October 4, 1994; and
WHEREAS, the property will be utilized for public park purposes
by Collier County, Florida; and
WHEREAS, the Board of County Commissioners of Collier County,
Florida approved Resolution No. 93-499 on November 2, 1993, approving
a policy to cancel current taxes upon land acquired by Collier
county or the Collier county Water-Sewer District without monetary
compensation for public use; and
WHEREAS, Section 196.28 and 196.29, Florida Statutes, provides
that the Board of County Commissioners of each County of the State of
Florida is given full power and authority to cancel and discharge
liens for taxes, delinquent or current, upon land held or owned by
said County for public use by a governmental unit; and
WHEREAS, the Board of County Commissioners canceled a portion of
the then current outstanding taxes from January 1, 1994 through
October 4, 1994 owed by the former property owner in the amount of
$7,985.57 on the property known as the Pelican Bay Community Park, on
October 25, 1994; and
WHEREAS, the Tax Collector's Office is requesting that the
remaining outstanding taxes for 1994 be canceled by Resolution.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that the remaining
outstanding taxes for 1994 on the property known as the Pelican Bay
Community Park, located at the southwest corner of Vanderbilt Beach
Road and Hammock Oak Drive, also known as Parcel "An Pelican Bay Unit
Nineteen, according to the plat thereof recorded in Plat Book 22,
Pages 15 and 16 of the Public Records of Collier County, Florida, are
canceled.
