A
A RESOLUTION BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA,
SUPPORTING THE PASSAGE OF HOUSE BILL 5 AND
SENATE BILL 438 RELATING TO ACCESS BY MEMBERS
OF THE PUBLIC TO LOCAL PUBLIC OFFICIALS.
WHEREAS, Article I, Section 5, Florida Constitution, provides
the people of the State of Florida the right to peaceably
assemble, to instruct their representatives and to petition for
redress ot qrievancesj and
WHEREAS, the interpretations of Jenninas v. Dade County
relating to ex-parte communications and quasi-judicial proceedings
may have obstructed or impeded access to local elected public
officials; and
WHEREAS, House Bill 5 and Senate Bill 438 would provide any
person that is not otherwise prohibited by law the right of access
to local public officials and the right to discuss or otherwise
communicate the merits of any matter on which action may be taken
by any board or commission; and
WHEREAS, House Bill 5 and Senate Bill 438 also provide for
disclosure of ex parte communications with local public officials
relating to a quasi-judicial action and further provides that such
communications, upon disclosure, shall not be presumed prejudicial
to the action taken.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that:
1) The Board supports and requests that the Legislature,
during the 1995 Legislative Session, enact House Bill 5 and Senate
Bill 438.
2) A certified copy of this Resolution be sent to the
Collier County Legislative Delegation, and Representative
Constantine, Senator Silver, Senator Kurth and Senator McKay.
This Resolution adopted after motion, second and majority
vote.
