RECORDED IN PLAT BOOK
THE PUBLIC RECORDS

AV 94-021 TO VACATE A
PORTIONS OF 6 FOOT
UTILITY EASEMENTS AS
5, PAGES 135-146, OF
OF COLLIER COUNTY,
WHEREAS, pursuant to Sections 177.101, 336.09 and 336.10,
Florida Statutes, Butler Engineering, Inc. and Bill Hoover, as
agents for owners, Alan & Inez Moniz, Trustees of the Alan and
Inez Moniz Living Trust, dated October 29, 1991, Salvatore Cina,
Daryl , Bradley Damico, and Thomas Grant, do hereby request the
vacation of a 20 foot alleyway and portions of 6 foot drainage
and utility easements located on a portion of the plat of Golden
Gate Unit 7, as recorded in Plat Book 5, Pages 135-146, of the
Public Records of Collier County, Florida; and
WHEREAS, the Board has this day held a public hearing to
consider vacating a portion of said plat as more fully described
below, and notice of said public hearing to vacate was given as
required by law; and
WHEREAS, the granting of the vacation will not adversely
affect the ownership or right of convenient access of other
property owners.
WHEREAS, the petitioner is requesting vacation of the
northerly 10 feet of the 20 foot alleyway and the public
ingress/egress rights to the southerly 10 feet of the 20 foot
alleyway, while retaining the public utility and drainage rights.
WHEREAS, the vacation and abandonment of the 20 foot
alleyway on a portion of the plat of Golden Gate Unit 7, as
recorded in Plat Book 5, Pages 135-146, of the Public Records of
Collier County, Florida, would benefit the general pUblic welfare
and is in the best interest of the public in the following
particulars:
1. Petition agrees to clear and maintain the alley area.
2. Petitioner agrees to lighting the area to discourage crime.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that the following be
