RESOLUTION NO. 95-~
A RESOLUTION URGING THE FLORIDA LEGISLATURE
DURING THE 1995 LEGISLATIVE SESSION TO AMEND
SECTION 322.03, FLORIDA STATUTES, BY REVISING
THE PROVISION WHICH PERMITS INDIVIDUALS TO
RETAIN AN OUT-OF-STATE DRIVER'S LICENSE AND AT
THE SAME TIME POSSESS A VALID FLORIDA DRIVER'S
LICENSE.
WHEREAS, in 1994 the United States Congress adopted the
National Voter Registration Act (NVRA), a/k/a the "Motor-Voter
Act," effective as a Federal law on January I, 1995; and
WHEREAS, the NVRA requires the states to register voters at
various Departments of Motor Vehicles, pUblic aid agencies, other
public offices, and by U.S. mail; and
WHEREAS, Section 322.03, Florida Statutes, provides that an
individual may obtain a valid Florida driver's license without
surrendering his/her out-af-state driver'S license; and
WHEREAS, approximately one (1) million people currently have
driver's licenses issued in the state of Florida that are stamped
"Valid Florida Only" which means that those individuals may
possess more than one driver's license; and
WHEREAS, individuals holding driver's licenses in two or more
states may become registered voters in those states and not be
considered full time residents.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that:
1) The Board of County Commissioners of Collier County,
Florida, urges the Florida Legislature during the 1995 Legislative
Session to introduce and adopt a Bill that would amend Section
322.03, Florida Statutes, revising the provision which permits
individuals to retain an out-af-state driver's license and
simultaneously possess a valid Florida driver's license.
2) The Board of County Commissioners requests that the
amendment to Section 322.03, Florida statutes, require all
individuals to surrender their out-af-state driver's licenses when
they apply for a Florida driver's license.

3) The amendment to Section 322.03, Florida Statutes, would
eliminate the potential problem of the state of Florida
establishing persons registered to vote in more than one state at
the same time.
4) The amendment to Section 322.03, Florida Statutes, become
effective immediately upon adoption.
5) A certified copy of this Resolution be sent to each
member of the Collier County Legislative Delegation and
Representative Livingston.
This Resolution adopted after motion, second and majority
vote.
