RESOLUTION 95-~
RELATING TO A REQUEST BY DONALD L. ARNOLD
TO PLACE FILL MATERIAL ON PROPERTY
HEREAFTER DESCRIBED IN COLLIER COUNTY,
FLORIDA.
WHEREAS, the Legislature of the State of Florida in
Chapter 125, Florida statutes, has conferred on all counties
in Florida the power to establish, coordinate and enforce
zoning and such business regulations as are necessary for the
protection of the public; and
WHEREAS, the County pursuant thereto has adopted a Land
Development Code (Ordinance 91-102, as amended) which
restricts specific site work such as grading and filling lots
until such time that applicable building permits have been
issued; and
WHEREAS, on January 3, 1995, the Board of County
Commissioners heard a request by Donald L. Arnold to move
excess fill material fr0rn two sites in the Collier County
Production Park to upland areas of an approximate I)-acres
site located north of Jeepers Drive, immediately east of
Bayshore Drive, which has been more specifically described
herein and is referred to as the Jeepers Drive property; and
WHEREAS, the excess fill material resulted from the
Production Park MSTU infrastructure improvements; and
WHEREAS, the Board of Commissioners has acknowledged
that a building permit for site construction has not been
issued to Donald L. Arnold of Collier County Commercial
Development Corp. at this site; and
WHEREAS, Donald L. Arnold has agreed to remove all
exotic vegetation from the Jeepers Drive property; and
WHEREAS, the Board of County Commissioners has found
that a public benefit will result from the removal of exotic
vegetation and construction debris; and

WHEREAS, the Board of County Commissioners has found no
environmental or wildlife concerns on the upland portions of
the Jeepers Drive property, and further acknowledged that Mr.
Arnold has received proper work authorization from other
applicable regulatory jurisdictions;
NOW THEREFORE BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS of Collier County, Florida, that:
The written request of Donald L. Arnold of Collier
County Development Corp. to fill portions of the property
legally described as:
(See Exhibit "A")
is hereby approved subject to the following conditions:
1. Removal of material from the Production Park sites
and filling of the Jeepers Drive property shall be
completed within 9 months of execution of this
Resolution. The work schedule shall require that
all fill material be removed from the Production
Park sites by May 15, 1995 and that final grading
and site work is completed at the Jaepers Drive
property no later than September 15, 1995.
2. The permittee shall post an irrevocable letter of
credit in the amount of $25,000 to insure that the
final grading of the Production Park property and
the Jeepers Drive property meet County standards
consistent with Section 3.5.7.6 of the Land
Development Code. The maximum finished grade on
the Jeepers Drive property shall be 9' NGVD.
3. Prior to the placement of fill on the Jeepers Drive
property, the applicant shall submit a detailed
description of the fill and site work activity
including a plan indicating fill placement
locations and depths, surface water management
improvements and perimeter landscaping for review
and approval to Collier County.
4. A County vegetation removal permit shall be issued
prior to removal of exotic vegetation from the
Jeepers Drive property.

BE IT RESOLVED that this Resolution, relating to a
request by Donald L. Arnold to place fill material on
property herein described, be recorded in the minutes of this
Board.
