Resolution 1995-074 .".- 13A J.i. . RESOLUTION NO. 9S-~ RELATING TO PETITION NUMBER SV-94-S, FOR SIGN VARIANCE ON PROPERTY HEREINAFTER DESCRIBED IN COLLIER COUNTY, FLORIDA. WHEREAS, the Legislature of the State of Florida in Chapter 125, Florida Statutes, has conferred on all counties in Florida the power to establish, coordinate and enforce zoning and such business regulations as are necessary for the protection of the public, and WHEREAS, the County pursuant thereto has adopted a Land Development Code (Ordinance No. 91-102) which establishes regulations for the zoning of particular geographic divisions of the County, among which is the granting of variances, and WHEREAS, the Board of Zoning Appeals, being the duly elected constituted Board of the area hereby affected, has held a public hearing after notice as in said regulations made and provided, and has considered the advisability of a 50-foot variance from the required ISO-foot lot frontage to 100 feet to allow for the placement of a V-type pole sign, as shown on the attached plot plan, Exhibit "AIf in an "A-ACSC/ST" zone for the property hereinafter described, and has found as a matter of fact that satisfactory provision and arrangement has been made concerning all applicable matters required by said regulations and in accordance with Section 2.7.5 of the Zoning Regulations of said Land Development Code for the unincorporated arf~a of Collier County, and WHEREAS, all interested parties have been given opportunity to be heard by this Board in public meeting assembled and the Board havin<] considered all matters presented, NOW THEREFORE BE IT RESOLVED BY THE BOARD OF ZONING APPEALS of Collier County, Florida, that: The Petition SV-94-4 filed by Eva Weeks, representing Robert L. Weeks, with respect to the property hereinafter described as: EXHIBIT "B" '. 13A be and the same hereby is approved for a 50-foot variance from the required ISO-foot lot frontage to 100 feet to allow for the placement of a v-type pole sign, as shown on the attached plot plan, Exhibit "A", of the "A-ACSC/ST zoning district wherein said property is located, and subject to the following conditions: a. The approval of this variance does not include the approval of the sign itself. The petitioner shall comply with Division 2.5 (Collier County Sign Code) at the time of sign permit submittal. A strip of land 100 feet in width lying 50 feet on each side of the center line of Grantor's former main line track formerly running between Sunniland and the City of Everglades; said strip of land beginning in Section 25, Township 52 South, Range 29 East on the South line of S.R. 90 (Tamiami Trail) as established by deed from Grantor to the State of Florida Department of Transportation dated January (7, 1978, and said strip of land extending southwesterly and southwardly through Sections 25, 36 and 35 of Township 52 South, Range 29 East, and Section s 2 and 11 of Township 53 South, Range 29 East, 14,992 feet, more or less, to the South line of the NW 1/4 of the NE 1/4 of said Section 11; LESS AND EXCEPT, any portion hereof conveyed by Grantor to Martin J.
