GWD-94-~ RESOLUTION DIRECTING THE COUNTY ATTORNEY'S OFFICE TO INSTITUTE FORECLOSURE ACTIONS ON DELINQUENT WATER AND/OR SEWER SPECIAL ASSESSMENTS. WHEREAS, the Board ot County Commissioners, as the Governing Body ot Collier County, Florida, and as Ex-otticio the Governing Board ot the Collier County Water-Sewer District and the Marco Water and Sewer District, has levied special water and/or sewer assessments against benetited properties within various utility special assessment districts; and WHEREAS, Section lS3.?3(11)(t), Florida Statutes, provides that the Board ot County Commissioners as Ex-otticio the Governing Board ot the various Districts shall direct its attorney not later than thirty (30) days atter the annual installments are due and payable to institute toreclosure actions on delinquent water and sewer special assessment liens, within two (2) months atter such direction. to entorce the collection ot all special assessments tor assessable improvements made under said section and remaining due and unpaid; and WHEREAS, the utility special assessment districts annual installments are due and payable prior to and became delinquent on April 1, 1994; and WHEREAS, it is the duty ot the District Board to entorce the prompt collection ot all delinquent special assessments. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA. AS THE GOVERNING BODY OF COLLIER COUNTY AND EX-OFFICIO THE GOVERNING BOARD OF THE COLLIER COUNTY WATER-SEWER DISTRICT. THE KARCO WATER AND SEWER DISTRICT AND THE GOODLAHD WATER DISTRICT, that: 1) All delinquent water and/or sewer special assessments are to be collected pursuant to Chapter 153.73. Florida Statutes, by toreclosure action in the Circuit Court ot Collier County, Florida. 2) The County Attorney's Ottice is hereby authorized and 80lll: 1100.",100 APIllL 26, 1994 directed to proceed within the next two (2) months to institute foreclosure actions in the circuit Court to entorce the collection of all delinquent special assessments tor assessable improvements within the tollowing Special Assessment Districts: Collier County Regional Water Assessment District No. 1 Willoughby Acres Water Assessment District Willoughby Acres Sewer Assessment District Pal. Springs Water Assessment District Sewer Service Area "A" Assessment District Blue Heron Lake Park Water Assessment District Trinity Place Water Assessment District Davis Blvd. Water Assessment District Harco Sewer Phase t Assessment District Harco Sewer Phase II Assessment District Goodland Water District 3) The County Attorney's Ottice is also authorized and directed to make the necessary arrangements and obtain title reports tor all properties with a delinquent special assessment within the atorementioned districts, the costs ot the title reports and all other costs incurred in the toreclosure actions shall be paid by the utilities Division and are subject to recovery in the tore closure actions.
