RESOLUTION NO. 94- 228
A RESOLUTION AUTHORIZING THE ACQUISITION OF LAND
IN FEE SIMPLE FOR THE ROAD PIGHT-OF-WAY FOR THE
CONSTRUCTION OF THE ROADWAY FOUR-LANING OF C.R. 951
PHASE I (FROM U.S. 41 NORTH TO C.R. 864 (RATTLESNAKE
HAMMOCK ROAD) .
WHEREAS, the Board of County Commissioners on October 26,
1993 adopted Ordinance No. 93-78 and Resolution No. 93-493
eetablishing the 1993 (Fifth Annual) capital Improvement Element
of the Growth Management Plan in order to establish priorities for
the design, acquisition and construction of the various capital
t.prov...nt projects which comprise the Transportation Element of
the COUnty's comprehensive Plan; and
WHEREAS, the four-laning improvements to C.R. 951 from U.S.
41 North to C.R. 864 (Rattlesnake Hammock Road) are component
parts of the Transportation Ele.ent of the County'. Comprehensive
Plan; and
WHEREAS, the County Staff has evaluated alternative
locations, reviewed the environmental factors, considered the cost
variable., and analyzed the safety and welfare considerations as
they relate to the construction of the four-lane improvements for
C.R. 951 from U.S. 41 North to C.R. 864 (Rattlesnake Hammock
Road); and
WHEREAS, the county Staff has recommended that it is
necessary and in the best interest of Collier County, Florida, to
acquire all of the road right-of-way required and necesAary for
the construction of the four-laning of C.R. 951 from U.5. 41 North
to C.R. 864 (Rattlesnake Hammock Road) in fee simple; and
WHEREAS, the construction of the four-laning of C.R. 951 from
U.S. 41 North to C.R. 864 (Rattlesnake Hammock Road) is necessary
in order to protect the health, safety and welfare of the citizens
of Collier County and is in the best interest of Collier County.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
OOKMISSIONERS OF COLLIER COUNTY, FLORIDA, that it has been

determined by the Board that the construction of the four-laning
ot C.R. 951 fram U.S. 41 Korth to C.R. 864 (Rattlesnake Hammock
Road) (hereinafter referred to as "the Project") is necessary for
a public purpose and is in the best interests of Collier County.
AND IT IS FURTHER RESOLVED that the Board reviewed the Staff
analysis regarding alternative locations, environmental factors,
cost variables, safety and welfare considerations as they relate
to the construction of the Project and finds that the most
t..sible locations for the additional road right-Of-way are
described in Exhibit "A" attached hereto and identified as Project
Parcel Kos. 101 and 102; and
AND IT IS FURTHER RESOLVED that to implement said
construction of the Project it is appropriate and necessary for
the Board to acquire fee simple title in the lands for project
Parcel Kos. 101 and 102 being more particularly described in
Exhibit "A", attached hereto and incorporated herein, to be used
as road right-Of-way for the construction of the four-lane
improvements to C.R. 951 from U.S. 41 North to C.R. 864.
AND IT IS FURTHER RESOLVED that the County staff is hereby
authorized to immediately acquire by gift, purchase or
condemnation in accordance with the provisions of Chapters 73, 74
and 127, Florida Statutes, fee simple title to the property
identified as Project Parcel Nos. 101 and 102 and being more
particularly described in Exhibit "A", attached hereto and
incorporated herein.
AND IT IS FURTHER RESOLVED that no moblle homes are located
on the property sought to be acquired and therefore it will not be
necessary to remove any mobile homes from the property to be
acquired.
