FLORIDA.
WHEREAS, the Legislature ot the State ot Florida in Chapter 125,
Florida Statutes, has conterred on all counties in Florida the power to
establish, coordinate and entorce zoning and such business regulations
as are necessary tor the protection ot the PUblic, and
WHEREAS, the County pursuant thereto has adopted a Land
Devel~nt Code (Ordinance no. 91-102) which establishes regulations
tor the zoning ot particular geographic diVisions ot the County, among
~icb is the granting ot variances, and
WHEREAS, the Board ot Zoning Appeals being the duly elected
constituted board ot the are. hereby attected, has heid a public
hearing atter notice as in said regulations made and provided, and has
considered the advisability ot a reduction ot the overall parking
require..nt ot 320 spaces or two spaces per unit to 247 spaces or
approxicately 1.54 spaces per unit tor the Oak Haven Housing Project as
shown on the attached plot plan, Exhibit "A" in a VR zone tor the
property hereinatter described, and has tound as a matter ot tact that
satistactory provision and arrange.ent has been made concerning all
applicable matters required by said regulations and in accordance with
Section 2.7.5 ot the Zoning Regulations ot said Lind Development Code
tor the unincorporated area ot Collier County, and
WHEREAS, all interested parties have been given opportunity to be
heard by this Board in public .eeting assembled and the Board having
considered all matters presented,
HOW THEREfORE BE IT RESOLVED BY THE BOARD OF ZOI/IIIG APPEALS ot
Collier County, Florida, that:

AGREEMENT
I, Jett Purse, as owner or authorized agent tor Petition
V-93-32, agree to the tolloving stipulations requested by the
Collier County Planninq comaission in their public hearing on
February 17, 1994.
PIAIOfmG:

This variance request is granted for a reduction in the
required parking tor the 160 affordable housing dwelling
units troa 320 spaces (2.0 per unit) to 240 spaces (1.5
per unit). Parking tor all other proposed uses (i.e. child
care center) shall be provided as required by the Land
Development Code, unless a specitic variance is granted.
