J 994 RESOLUTION NO. 94-151 A RESOLUTION CREATING THE COLLIER COUIITY PRIVATIZATIOll PWS TASJ: FORCE; PROVIDING FOR THE PURPOSE OF THE TASK FORCE; PROVIDING FOR APPOINTMENT AIID COMPOSITION OF THE TASJ: FORCE MEKBERSHIP; PROVIDING FOR REMOVAL FROM OFFICE AIID FAILURE TO ATTEND MEETINGS: PROVIDING FOR OFFICERS, QUORUM, AIID RULES OF PROCEDURE: AIID SETTING FORTH THE FUNCTIONS, POWERS AIID DUTIES OF THE TASK FORCE. WHEREAS, pursuant to Collier County Ordinance No. 86-41, .. &Mnded, it b necessary that a Resolution be adopted settinq torth the purpose, powers and duties ot an ad-hoc C<maitt:ee; and WHEREAS, it has been deterained by the Board ot County eo.aissioners ot Collier County, Florida, that it would be in the best interest. ot the County to appoint a task torce C<maitt:ee to review and research Ilatters relating to privatization ot governmental tunctions and services, the benetit. and detriaent. ot regulation versus deregulation ot various area. ot governaent, the adaptability ot private aarketplace considerations to the operation ot government and any other such aatters relating to the study, analysis or iaprovement ot government tunction. or service. that the Board ot County Coaais.ioners shall assign trom tiae to tille. IlOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COIIXISSIOIlERS OF COLLIER COUNTY, FLORIDA, that: SECTION ONE. CREATION OF THE PRIVATIZATION PLUS TASK FORCE. The Collier County Privatization Plus Task Force (herein reterred to as the Task Force) is hereby created as an ad-hoc C<maittee tor a period ot one (1) year, which tera shall automatically be extended tor an additional one (1) year tera, unless the Task Force is dissolved or the term otherwise changed by resolution ot the Board ot County COllllissioners. SECTION TWO. PURPOSE OF THE TASK FORCE. The Task Force shall review, research and provide recom- _ndation. to the Board ot County co_issioners regarding (1) the privatization ot governmental tunctions and services, (2) the benetits and detriments ot regulation versus deregulation 81l1lf Oon'ICe ~? HARCH 8, 1994 ot various areas ot government, (3) the adaptability ot private aarketplaca considerations to the operation ot government, (4) the County's eaployee incentives (non-monetary) program, and (5) any other matters relating to the study, analysis or iaprov...nt ot government functions or services that the Board ot County Coaaissioners shall assign trOlll time to time. In furtherance of its above-described purposes, the Task Force is hereby authorized to torm study COIlIlittees frOlll its membership, each of which shall be assigned the review of one or more specific County functions or services (e.g. solid wast:e/landtill, County permitting processes, parks and recreation, eaployee incentives (non-Ilonetary]) by the Task Force. SECTIOII THREE. COIlPOSITIOIl OF THE TASK FORCE. A. The Task Force shall consist of twelve (12) members vbo are appointed by resolution of the Board ot County Ooaaissioners. one aeaber of the Task Force shall be a Ooaaissionsr designated by the Board of County commissioners who shall serve as a non-voting liaison and as Chairman of the Task Force. The Study CoIlIlittees of the Task Force shall be coaposed ot a ainimum ot three (3) and maximum of five (5) Task Force m8lllbers per study COIlIlittee. B. Kembers of the Task Force shall be appointed by and serve at the pleasure of the Board of County Commissioners. Said members shall be permanent residents and electors ot Collier County. C. 110 member ot the Task Force shall be appointed in the event such person has contracted with the Board of County ComIissioners to provide services or has otherwise provided services in the last two calendar years, the total amount at which has exceeded $30,000 paid by the Board. No member of the Task Force shall, after appointment, contract with or otherwise provide services to the Board of County Commissioners in excess of a value to be paid by the Board of $15,000 annually. These requireaents shall apply to both the individual member and any corporate or o';her business entity of whom the member is a ......... -, abareholder (5\ or more shares], director, partner or employee. It the Board of county Commissioners is made aware ot a member vbo has violated or b in violation of this provision, the member's seat shall be declared vacant and a new member appointed. SECTIOII FOUR. REMOVAL FROK OFFICE; FAILURE TO ATTEND KEETINGS. A. Any a8lllber of the Task Force may be removed from ottica, with or without cause, by a majority vote of the Board ot County Commissioners. B. It any member of the Task Force fails to attend two (2) consecutive Task Force or study COIlIlittee meetings without a satistactory excuse or it a member is absent frOlll more than one-halt ot the Task Force or study Committee meetings in a qiven tiscal year, the Task Force shall declare the member's seat to be vacant and the vacancy shall be filled by the Board ot County Ooaaissioners. SECTIOII FIVE. OFFICERS; QUORUM; RULES OF PROCEDURE. A. The Task Force shall be Chaired by a Commissioner designated by the Board ot County COIlIlissioners who shall be a non-voting member and liaison between the Task Force and the Board. B. The presence of seven (7) or more Ilembers of the Task Force shall constitute a quOrl1lll which is necessary to take action and transact business. In addition, an affirmative vote of at least six (6) members present and voting shall be necessary in order to take ofticial action, regardless ot the number of members of the Task Force present at the meeting. A aiaple majority of the appointed members to any study Committee shall constitute a quorum to transact business. SECTION SIX. FUNCTIOIlS, FOWERS AND DUTIES. The tunctions, powers and duties ot the Task Force shall be as follows: A. To review, research and provide recommendations to the Board ot County Commissioners regarding: 1. Any other such aatters relating to the study, analysis or improvement ot government tunctions or services that the Board ot County COIlIlissioners shall assign trolll ti.e to time. B. The Task Force shall prepare a written interim report no later than every six (6) months to the Board ot County Coaaissioners describing its progress, areas reviewed, and other pertinent data regarding the Task Force's review. C. The Task Force may tora study COIlIlittees as described in Section Two of this Resolution in order to carry out its various functions and duties as described above. The .embership ot the Study Committees shall be approved by the Board of County COIllIIissioners by resolution specifically as recollllended by the Task Force. D. The Tasle Force lillY, by majority vote of the entire .embership, adopt rules ot procedure tor the transaction ot business and shall keep a written record of .eetings, resolutions, tindings and deterainations. Copies ot all Committee minutes, resolutions, reports, and exhibits shall be submitted to the Board of County co..-issioners. E. The Task Force may adopt and amend "Guidelines" to govern their operation. F. The Task Force .eetings, including any Study Coaaittees seetings, shall be open to the public. SECTIOII SEVEN. REIMBURSEMENT OF EXPENSES.
