Resolution 1994-062 RESOLUTION NO. 94-~ FEBRUARY 8, ]994 RELATING TO PETITION NUMBER A VARIANCE ON PROPERTY DESCRIBED IN COLLIER COUNTY, V-9J-3l, FOR HEREINAFTER FLORIDA. WHEREAS, t~e Legislature of the state of Florida in Chapter 125, Florida Statutes, has conferred on all counties in Florida the power to establish, coordinate and enforce zoning and such business regulations as are necessary for the protection of the public, and WHEREAS, the County pursuant thereto has adopted a Land Development Code (Ordinance No. 91-102) which establishes regulations tor the zoning of particular geographic divisions of the County, among which is th~ granting of variances, and WHEREAS, the Board of ~;oning Appeals being the duly elected constituted board of the area hereby affected, has held a public hearing after notice as in said regulations made and provided, and has r.onsidered the actvisahility of a 7.5 foot side yard variance from the required 15 feet for boat dock pilings as shown on the attached plot .clan, Exhibit "A" in a RMF-16 zone for the property hereinafter described, and has found as a matter of fact that satisfactory provision and arrangement has been made concerning all applicable matters required by said regulations and in accordance with Section 2.7.5 of the Zoning Regulations of said Land Development Code for the unincorporatf:l:d area of Collier County, and WHEREAS, all interested parties have been given opportunity to be heard by thin Board in public meeting assembled and the Board having considered all matters presented, NOW THEHEFORE BE IT RESOLVED BY THE BOARD OF ZONING APPEALS of Collier County, Florida, that: The Petition V-9J-Jl filed by Wayne Furfey of Custom Dock and Repair Inc. representing Andreas Kertscher with respect to the property hereinafter described as: Lots 21-23, Block 338, Islander Cove Condominium 1305, Unit 10, Marco Beach according to the Plat thereof, as recorded in Plat Book 6, Page 74-79, of the Public Records of Collier County, Florida. be and the same hereby is approved for a 7.5 foot side yard variance trom the required 15 feet for boat dock pilings as shown on the attached plot plan, Exhibit "A" of the R11F-16 zoning diE>trict wherein said property is located, subject to the following condi~ions: 1001 ~~;" "~R FEBRUARY 8, 1994 BE IT I~ESOI~VEU tllat this Resolution relating to Pe~ition Number commissioner Norris V-93-31 be recorded in the minutes of this Board. offered the foregoing Resolution and woved for its ~doption, seconded by Commissioner Volpe and upon roll call the vote ~as: NAYS: AYES: Corrmissioner Norris, Carmissioner Volpe, Comnissionec Saund~r5 and Comr.,issioner Constantine ABSENT AND tlOT VOTING: Corrmissionec Matthe....:s ABSTENTION: Done this 13th day of Februar:v .)iH/rij .,.: '-. -..... ,t.J. .:-\TTEST:.... . ~. i,."./ DWIGHT E .BR:>C'J\, 'CLERK '..
