Resolution 1994-021 ,~ .~ JAlIUARY 11,1994 RESOLUTION NO. 94-~ RElATI!lG TO PETITION NUMBZR A VARIANCE ON PROPERTY DESCRIBED IN COLLIER COUNTY, V-93-30, FOR HEREINAFTER f'LORID.... WHVDEAS, the Legislature ot the State ot Florida in Chapter 125, Florida statutes, has conterred on all counties in Florida the power to establish, coordinate and entorce zoning and such business regulations .. are necessary tor the protection ot the public, and WHEREAS, the County pursuant thereto has adopted a Land Davel~nt Code (ordinance No. 91-102) which establishes regulations to~ the zoning ot particular geographic divisions ot the County, among which is the granting ot variances, and WHEREAS, the Board ot Zoning Appeals being the duly elected constituted board ot the area hereby attected, has held a public hearing atter notice as in said regulations made and provided, and has cons14ared the advisability ot 5 toot variances from the required north and south side yards ot 15 teet to 10 teet as shown on the attached plot plan, Exhibit ....., in a POD zone tor the property hereinatter described, and has tound as a .atter ot tact that satistactory provision and arrangement has been .ade concerni~g all applicable aatters required by said regulations and in accordance with Section 2.7.5 ot the Zoning Regulation. ot said Land Development Code tor the unincorporated area ot Collier County, and WHEREAS, all interested parties have been given opportunity to be heard by this Board in public aeeting assenbled and the Board having considered all aatters presented, If OW THEREFORE BE IT RESOLVED BY THE BO"'RD OF ZONING APPEALS ot Collier County, Florida, that: The Petition V-93-30 tiled by Jack Killer, representing Lorenz Raeder, with respect to the property hereinatter described as: Lot 3, Block 16, Hideaway Beach, as recorded in Plat Book 12, Page. 80-85, ot the Public Records ot Collier County, Florida. be and the same hereby is approved tor 5 toot variances trom the required north and south side yards ot 15 feet to 10 teet as shown on the attached plot plan, Exhibit .A., ot the PUD zoning district wherein said property is located, subject to the tol10wing conditions: EXHIBIT .B.
