Resolution 1994-016 "., . .;~ RESOLUTION NO. 94-l2- JANUARY J I, 1994 RESOLUTION APPROVING WITH CONDITIONS PETITION CCSL-93-8 REQUESTING A VARIANCE FROM THE COASTAL CONSTRUCTION SETBACK LINE TO ALLOW THE RETAINMENT OF A DECK ADDITION BY THE BAYSHORES OF VANDERBILT BEACH CONDOMINIUM ON LOTS 44, 45, AND 46, BLOCK A, REPLAT OF UNIT NO.1, CONNERS VANDERBILT BEACH ESTATES, IN SECTION 29, TOWNSHIP 48 SOUTH, RANGE 25 EAST, COLLIER COUNTY, FLORIDA. WHEREAS, the petitioners, Bayshores of Vanderbilt Beach Condoainium thrcugh their representative Mr. Ronald L. Stetler requests a variance from the Coastal Construction Setback Line (CCSL) as required by Collier County Ordinance No. 91-102 Division 3.13, as amended, to allow the retainment of a deck addition which has been constructed on the property of Bayshores of Vanderbilt Beach CondominiuD; and WHEREAS, the existing deck addition extends twenty-six and half (26.5) feet seaward of the adopted CCSL; and WHEREAS, such structures are ninor structures and are " consistent with Subsection 161.55(2), Florida Statutes, the Coastal . ..... (;;, ~'r; l'I!' l ~~:"'" ~..- ,. , '" " iI;, i, t Zone Protection Act of 1985 and the Collier County Growth Management Plan - Conservation and Coastal Managenent Element Policy 11.4.7; and WHEREAS, structures whiCh extend no further seaward than the parallel line established by adjacent permitted structures is consistent with the Collier County Ordinance No. 91-102, Division 3.13, as amended; and NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COKKISSIONERS OF COLLIER COUNTY, FLORIDA, that: Variance Petition CCSL-93-8 be approved subject to the following conditions: 1. The project shall be designed in accordance with the stand~rds ot the Florida Department ot Environmental Protection (FDEP) and approved by the FDEP Division of Beaches and Shores. 2. OUtdoor lighting associated with construction, or development within three hundred (300) teet of the high tide line, shall be in compliance with Division 3.10 of Collier County Land Development Code. eoO( 000 fl: 20 day ot Januarv , 1994. '", JANUARY", 1994 3. Minor revisions to Coastal Construction Setback Line variance CCSL-93-8 may be approved, in writing, by the site Development Review Director. 4. The petitioner shall re-vegetate the dune where the dune is devoid ot coastal dune vegetation. The re-vegetation shall be C01Ipleted according to a plan, submitted to and approved by Project Plan Review Environmental Staff, within thirty (30) days ot the approval of this petition.
